1990.11.21_CEB_Minutes_Workshop,t TOWN OF HIGHLAND BEACH CODE ENFORCEMENT BOARD WORKSHOP MEETING - MINUTES Wednesday, November 21, 1994! 9:45 A.M. Chairman Pamela J. Perona called this Workshop Meeting of the Code Enforcement Board to order in Commission Chambers at 9:45 A.M. Deputy Town Clerk Doris Trinley called the roll. Present were the Chairman, Vice Chairman Victor P. Hadeed and Regular Members Edward J. Pearlstein, Theodore F. Boepple, Mertin Rubin and Horace Leng. Regular Member Lowell Blum was absent. Also present were Town Attorney Kenneth Zeilberger, Building Official Harry Heithaus and members of the general public. No discussion took place regarding the minutes of the Workshop and Regular Meetings of July 18, 1990. OLD BUSINESS: Building Official Heithaus addressed the panel, explaining that two outstanding Town citations were now in compliance with Code, having met requirements of the DER and DNR also: Citation 2296. 2540 S. Ocean Blvd., Lot 124N (Bassolino/Owner). DER approved the installation of a wave break and a permit was applied for and issued. Citation 2290. 4011 S. Ocean Blvd., Lot 50E (Ressler/Owner). The deck in violation has been moved to the satisfaction of the DNR, who issued a Notice of Compliance. Mr. Heithaus said he had inspected the two properties and found them to be in accordance with Town Code also; therefore, the violations have been satisfied. NEW BUSINESS: Citation No. 2321. Frank Sanchez, Trust., c/o D. Sanchez. 4117 S. Ocean Blvd., Lot 3$E. Sec. 15.3(a). The Building Official apprised the members of events leading up to the issuance of this Citation, which had to do with the property not being properly maintained. He advised that it was for sale and when the first Notice of Violation was issued the property was brought into Code by the real estate company holding the listing. However, he added, that company no longer was involved in the possible sale and the .property was again in violation of code for non-maintenance. Mr. Heit- haus said the second Notice of Violation, sent certified mail to the i ' Code Enforcement Board Workshop Meeting - Minutes November 21, 1990 Page 2 of 2 only address available for the owners (out-of-state), was undeliverable and it was believed the owners were out of the country. Consequently, he continued, a Citation was issued and members of the police force tried to deliver it to the property in violation; however, it too was undeliverable as the property is vacant, with no realtor's sign. Mr. Heithaus then told the Board that in a conversation with Town At- torney Zeilberger previous to today's meeting, he was advised that this Citation should not be addressed at the Regular Meeting because it was not posted somewhere on the property when found to be undeliverable. Attorney Zeilberger then addressed the members, advising that according to Town Code and State Statutes, posting is required should the Cita- tion be undeliverable; also, an affadavit that posting has been done should be made for the record. When proper legal procedures are fol- lowed, he added, there should be no impediment in securing a lien if the owner fails to pay costs incurred by the Town in maintaining the property. Mr. Zeilberger also suggested posting be done today, so the Citation could be addressed at the next regularly scheduled meeting of the Board. Mr. Heithaus assured the members that posting would be accomplished this date.
