Highland Beach, Florida 33487 1. CALL TO ORDER Mayor Hillman called the meeting to order at 1:30 P.M. 2. PRESENT UPON ROLL CALL Commissioner John Shoemaker Commissioner Evalyn David Commissioner Peggy Gossett-Seidman (arrived at 1:32 P.M.) Vice Mayor Natasha Moore Mayor Douglas Hillman Town Manager Marshall Labadie Town Attorney Glen Torcivia Town Clerk Lanelda Gaskins CHARTER REVIEW BOARD MEMBERS PRESENT Chairperson Barry Donaldson Member Richard Greenwald Member Khi Thai Member Ronald Reame (virtually) 3. PLEDGE OF ALLEGIANCE The Town Commission led the Pledge of Allegiance. 4. APPROVAL OF THE AGENDA MOTION: David/Moore - To approve the agenda as presented. The motion passed unanimously on a 5 to 0 vote. 5. PUBLIC COMMENTS Mayor Hillman called for public comments. Town Clerk Gaskins stated that there were no public comments. Town Commission Special Meeting Minutes Date: October 26, 2021 Page 2 of 5 6. DISCUSSION OF THE CHARTER REVIEW BOARD'S FINAL REPORT A. Charter Review Board's Final Report Mayor Hillman introduced this item. He also read the title of each Section. In addition, there were discussions between the Town Commission, Town Manager Labadie, Town Attorney Torcivia, and input from the Charter Review Board Members on the below topics. Section 1.06(3) Terms of Office The Town Commission accepted the Charter Review Board's recommendation with a few modifications to this section. Section 1.06 (5) Commission Eligibility The Town Commission agreed with the Charter Review Board's recommendation not to amend this section. Section 1.06(11) Vacancy in the Commission The Town Commission agreed with the Charter Review Board's recommendation not to amend this section. Section 1.07 Rules of Procedures: Quorum: Meetings The Town Commission discussed the Charter Review Board's recommendation to change the word "should" to "shall" within this section. The consensus of the Town Commission was that they did not see a need to change the wording from "should" to shall." Section 2.01(6) Fills Town Commission discussed the possibility of implementing an ordinance to prevent trade agreements concerning the mangroves. Town staff will further investigate this matter. Section 2.01(9) Fire and rescue protection The Town Commission accepted the Charter Review Board's recommendation as follows: The Town may not abolish, merge with, sell, or otherwise transfer managerial control and decision making to any other entity the essential services of Fire Rescue, Police or Water unless approved by a referendum vote of the electorate in accordance with Section 166.031, Florida Statutes, as amended from time to time." Also, the Town Commission discussed adding language to the Charter that would require a referendum to enter into any interlocal agreements as it pertains to the Police Town Commission Special Meeting Minutes Date: October 26, 2021 Page 3 of 5 Department, Water Plant, and Fire and Rescue services. Town Commission also discussed ballot language in pertinence to this item. Section 2.01(14) Drainage The Town Commission concurred with the Charter Review Board's recommendation not to amend this section. Section 2.01 (30) Funding Limits Town Commission decided to discuss the Funding Limits at the November 09, 2021, Town Commission meeting. In addition, Town staff will research the history of $350,000 funding limits and define terms used (for example, what constitutes a single project). Section 3.02 (1) Payment of lawful debts The Town Commission suggested additional language be added to this section as follows: "If neither the Town Manager nor the Finance Director are available, then two Commissioners can sign checks." The Town Commission also recommended Town staff draft an ordinance that establishes a maximum dollar amount per check for Commissioners to sign. The draft ordinance must include a provision to review the ordinance every five years. Town Attorney Torcivia explained that the Town's Charter is the constitution, and the ordinance will supplement it. Section 3.05 Salaries of Commissioners and Mayor Charter Review Board members Thai, Greenwald, Reame, and Chairperson Donaldson provided input related to the salaries of the Town Commissioners. The consensus of the Town Commission was to accept the recommendation of the Charter Review Board and have Town staff bring back additional information for the ordinance. Section 4.02 Mayor The Town Commission discussed making changes to the Charter that would require three 3) Commissioners to suspend the Town Manager with just cause. The consensus of the Town Commission was to accept the recommendation of the Charter Review Board not to amend this section. Article 4, New Section 4.05 (Multiple Sections affected) Section 4.01 Town Manager The Town Commission discussed whether or not it was necessary to place the positions of the Chief of Police, Town Clerk, and Fire Chief under the direct supervision of the Town Manager. The consensus of the Town Commission was to leave the positions of the Chief of Police and Town Clerk as written in the Town's Charter and add the position of the Fire Town Commission Special Meeting Minutes Date: October 26, 2021 Page 4 of 5 Chief. In addition, Town Commission suggested that Town Attorney Torcivia draft an ordinance to include the Fire Chief position in the Town's Code of Ordinances. Mr. Ronald Reame provided comments about the need to place all positions under the direct control of the Town Manager. Section 5.01 (c) Calling a Special Meeting The Town Commission agreed that this section should remain as written in the Town's Charter. Mr. Ronald Reame provided public comments about derogatory statements from the Committee to Save Highland Beach. 7. APPROVAL OF COMMISSION MINUTES A. October 19, 2021, Commission Meeting Minutes MOTION: David/Gossett-Seidman -To approve the October 19, 2021, Meeting Minutes as corrected. The Meeting Minutes passed unanimously on a 5 to O vote. 8.ANNOUNCEMENTS October 28, 2021 -5:00 P.M. to 7:00 P.M. Food Truck Event November 02, 2021 -7:00 AM. to 7:00 P.M. Special Referendum Election November 03, 2021 - 1 :00 P.M. Natural Resources Preservation Advisory Board Regular Meeting November 09, 2021 - 1 :30 P.M. Town Commission Meeting November 10, 2021 -9:30 AM. Planning Board Regular Meeting 9.TOWN COMMISSION COMMENTS Commissioner John Shoemaker spoke about the following: Mr. John Rand's family was happy about the article in the Manager's Minutes, the concerns with apathy as it relates to the upcoming election, the increase in real estate costs in Highland Beach, and Pastor Father Horgan and St. Lucy Catholic Church raising funds for the people in Afghanistan. Lastly, he urged the residents to support the referendum. Commissioner Evalyn David had no comments. Commissioner Peggy Gossett-Seidman spoke about the Palm Beach League of Cities meeting that she recently attended. Mayor Douglas Hillman spoke about the increase of insurance cost related to condominiums and inquired about water rates increases. Town Manager Labadie indicated that it might take months before the Town Commission see the data related to the water rates revenues. There was discussion about scheduling a Town Commission Special meeting on Tuesday, November 09, 2021, at 10:00 A.M.; the Town Commission were in favor of the meeting date and time. 10.
