WORKSHOP MEETING - MINUTES
Wednesday, November 20, 1991 9:45 A.M.
Chairman Pamela J. Perona called the Workshop Meeting to order in Com-
mission Chambers at 9:45 A.M.
Deputy Town Clerk Doris Trinley called the roll. Present were the
Chairman, Vice Chairman Victor P. Hadeed and Members Theodore F.
Boepple, Horace Leng, Merton Rubin and Arthur Hamerman. Member Elleh '
B. Gerber was absent.
Town Attorney Kenneth E. Zeilberger and Building Official Harry
Heithaus were also present; Commissioner John F. Rand was in the
audience.
Upon MOTION by Mr. Leng/Mr. Rubin, the Minutes of the October 16 meet-
ings were moved to the Regular Meeting for approval.
OLD BUSINESS
• Building Official Heithaus advised the members of the status of out-
standing Citations. Regarding No. 2325, issued to Mary Ann and Edward
DeJoseph at 1121 Bel Air Drive, he said that the project was in
progress, with work being done on the lining of parking spaces and
installation of stops. He added that it would appear all work would be
completed within the six (6) months allowed by the Board. Mr. Heithaus
also advised that Citation No. 2328, issued to Lisa and Jeffrey Miller
at 1133 Boca Cove Lane regarding conversion of the garage into a play-
room, was on the agenda for the next Planning Board and Community Ap-
pearance Board meetings, as per decision of the Board to give them 90
days to gain approvals.
NEW BUSINESS
Citation No. 2338. Issued to Tony Magri (Royal Cove Joint Venture), all
Lots, B & C Site, Royal Cove Drive. Chapter 13, Section 3 (Trash and
Excessive Growth).
Mr. Heithaus gave the members details leading up to the issuance of the
Citation, saying a previous Citation had been cancelled because the
site had been cleaned up; however, it was now again in a state of dis-
order with construction debris and vegetation overgrowth. He noted
that the Braemer Isle Condominium overlooks the site.
In response to questioning, Mr. Heithaus said as far as he knew Royal
Cove Joint Venture was still in business, although there had been no
construction activity at the site for approximately three (3) months.

After a Consensus to move deliberation of Citation No. 2330 to the
Regular Meeting, the Workshop was adjourned upon proper Motion at
9:55 A.M.

REGULAR MEETING - MINUTES
Wednesday, November 20, 1991 10:00 A.M.
Chairman Pamela J. Perona called the Regular Meeting to order in Com-
mission Chambers at 10:00 A.M.
Deputy Town Clerk Doris Trinley called the roll. Present were the
Chairman, Vice Chairman Victor P. Hadeed and Members Theodore F.
Boepple, Horace Leng, Merton Rubin and Arthur Hamerman. Member Ellen
B. Gerber was absent.
Town Attorney Kenneth E. Zeilberger and Building Official Harry
Heithaus were also present; Commissioner John F. Rand was in the
audience.
Upon MOTION by Mr. Leng./Mr. Hamerman, the Minutes of the October 16
meeting were unanimously approved.
OLD BUSINESS
• At the request of the Chairman, Building Official Heithaus reiterated
his remarks regarding outstanding Citations 2325 and 2328 for the
record. (See Workshop Minutes.)
NEW BUSINESS
Citation No. 2330. Issued to Tony Magri (Royal Cove Joint Venture), all
Lots, B & C Site, Royal Cove Drive. Chapter 13, Section 3 (Trash and
Excessive Growth.
It was noted for the record that neither Tony Magri nor any other
representative of Royal Cove Joint Venture was present at this meeting.
Substantial discussion took place regarding information the Building
Official had disclosed during the Workshop, including that a previous
Citation (No. 2329), issued for the same violation, had been cancelled
because the site was cleaned up before it came to agenda. Mr. Heithaus
repeated that the site was again in violation, with construction debris
and vegetation overgrowth on all lots. He again advised that although
as far as he knew Royal Cove Joint Venture was still in business, there
had been no construction activity at the site for approximately three
(3) months.
Substantial deliberation took place among the members and Attorney
Zeilberger. It included consideration that this was a large piece of
. property comprised of 22 or 23 lots and not a single family situation,

as well as possible future options of the Board should the violation
not come into compliance, or comply and be repeated, in the future. In
conclusion, the following MOTION was made by Mr. Hadeed Mr. Boepple:
THE CODE ENFORCEMENT BOARD FIND5 TONY MAGRI (ROYAL COVE
JOINT VENTURE) IN VIOLATION OF TOWN CODE AS SET FORTH IN
CITATION 2330 AND IMOSES A FINE OF $250.00 A DAY, COM-
MENCING IN SEVEN (7) DAYS.
Before vote was taken, Mr. Leng suggested the members consider giving a
30-day grace period before the $250.00 fine was imposed. After some
discussion in this regard, Chairman Perona requested roll call for the
Motion on the floor, which resulted as follows:

Motion passed four (4) to two (2).
The Chairman then recognized Commissioner John F. Rand and noted the
Town's Government Open House, which will take place Thursday, December
5. She encouraged the Code Enforcement Members to attend.
Announcing the next meetings would take place December 18, Chairman
Perona adjourned the meeting upon proper Motion at 10:15 A.M.
