CODE ENFORCEMENT BOARD
WORKSHOP MEETING - MINUTES
Wednesda December 18, 1991 9:45 A.M.
Vice Chairman Victor P. Hadeed called the Workshop Meeting to order in
Commission Chambers at 9:45 A.M.
Deputy Town Clerk Doris firinley called the roll. Present were the Vice
Chairman and Members Theodore F. Boepple, Horace Leng, Merton Rubin and
Ellen B. Gerber. Chairman Pamela J. Perona and Member Arthur Hamerman
were absent.
Also present were Town Attorney Kenneth E. Zeilberger, Code Enforce-
ment Officer Harry Heithaus and members of the general public. Commis-
sioner John F. Rand was also in the attendance.
OLD BUSINESS
Building Official Heithaus advised that Citation 2330, issued to Royal
Cove Joint Venture regarding the Boca Highland B & C site, for viola-
tion of Town Code Chapter 13, Section 3 (trash and excessive growth)
• had come into compliance per CEB order.
NEW BUSINESS
Citation No. 2331. Issued to Lillian Aaron, 2909 S. Ocean Blvd., #1-C.
Chapter 30, Section 8.1 and SSBC Section 103 (Storm Shutters Installed
Without Permit).
The Building Official explained that storm shutters were installed on
the outside of the apartment windows without permit. He added the
Citation had been issued pursuant to a complaint from a representative
of the Condominum's Association (Wiltshire House); besides not being
permitted, the shutters were non-conforming to others installed on the
building.
During discussion it was noted that while the Board has no jurisdiction
in matters pertaining to a unit owner and his condominium association,
it was for the protection of all concerned, including the Town, that
written approval from the concerned condominium association for work
such as this be presented to the Building Department at the time permit
was requested. It was agreed that such procedure would prevent the oc-
currence of conflicts like that under review today.
Attorney Zeilberger noted that, strictly speaking, only the matter of
the work being done without permit would come under the Board's pervue.
However, for the Town to have a procedure or policy in place regarding
. the submission of condominium approval prior to issuance of permit was

was not inherently wrong. He added that most probably condominium
documents would be more restrictive than Town Code as regards any
changes to a building. His remarks were made after review of a copy of
a letter written by Town Attorney Thomas E. Sliney to Town Manager Mary
Ann Mariano had been presented to him by Mr. Heithaus prior to the
start of this meeting (copy attached to and made part of these
minutes).
Upon questioning, Mr. Heithaus said that all building managers are
aware of what is required for permitting; however, most units owners
are most probably not aware.
There being no further business to come before the Board at this time,
the Workshop was adjourned upon MOTION by Mr. Boepple/Mr. Leng at 9:55
A.M.

Per our conversation today concerning safeguards when dealing
with applications for permits from condominiums or other home-
owners association, it would be my suggestion that the Building
Official require that the association submit a letter from the
President of the association stating that the Board of Directors
has approved the change, renovation, etc. which is being requested
in the building permit application. This may be a conservative
approach but it would seem to me that if we have a letter from
the President of the association concerned stating that his
Board has approved it, even if there should be dissent in the
association, we have on record for the Town the statement from
the President that his Board has approved the change requested.
