CODE ENFORCEMENT BOARD
WORKSHOP MEETING - MINUTES
Wednesday, November 18, 1992 9:30 A.M.
Vice Chairman Victor P. Hadeed called the Workshop Meeting to order in
Commission Chambers at 9:30 A.M.
Deputy Town Clerk Doris Trinley called the roll. Present were the Vice
Chairman and Members Merton Rubin, Horace Leng and Ellen Gerber.
Chairman Pamela J. Perona was absent, as were members Theodore F.
Boepple and Arthur Hamerman.
Also present were Town Attorney Thomas E. Sliney, Building Official/
Code Enforcement Officer Lee Leffingwell and members of the general
public.
Ms. Leffingwell formally introduced herself to the members and
addressed the following Citations:
No. 2336. Joel Messinger, Property Manager, Community Association
Services re 1043 Boca Cove Lane , Lot 15S; Gordan Noonan , Un i t Owner .
Chapter 28-1/2, Section 23.
• There was no permit applied for regarding the removal of a black olive
tree at 1043 Boca Cove Lane, Lot 15S. The owner, Gordon Noonan,
claimed the tree had been blown over, but there was no evidence to
substantiate this. However, Ms. Leffingwell stated the Homeowner's
Association had agreed to install in the area where the black olive
tree was removed, a hibiscus tree similar in style and nature to the
hibiscus trees found in various locations on the property. She
directed the members to a letter from the Homeowner's Association to
this effect.
Discussion took place regarding permitting for the removal and the
planting, as well as a time certain for the planting. The members also
expressed concern that a hibiscus tree was a suitable replacement as
regards Code. It was noted that neither the unit owner or anyone from
the Association was present for the Workshop.
No. 2338. Ken Sharp, Highland Beach Associates, 1119 and 1123 Highland
Beacl' Drive, Chapter 13, Sections 1 and 3; Chapter 25, Section 1;
Chapter 17, Section 3.
Ms.Leffingwell advised the members that this property had been an
ongoing problem regarding violations of Town Codes. The property con-
sists of eight duplexes and is in a state of general disrepair. The
pool was shut down by the Health Department a year ago; its condition
remains a hazard as well as a nuisance. Heavy tree limbs rest on
some portions of the roof and tree limbs overhang the roadway. Ms.
Leffingwell presented pictures of the violations to the members and ad-
vised that Mr. Sharp was in attendance and would address the members
during the Regular Meeting.

Discussion among the members included the types of permits and
occupational licenses needed for tree trimming in Town and also the
amount of time needed in terms of bringing this property into
compliance. Regarding the pool, Ms. Leffingwell suggested it should be
drained and covered, made operable, or filled in.
Citation 2339. Richard Mendelson re 1224 Highland Beach Dr., Chapter
17, Section 2; Chapter 6, Section 30(b).
Ms. Leffingwell noted the loose tiles on Mr. Mendelson's roof had been
an ongoing problem for a very long time. She said Mr. Mendelson was in
attendance and would address the members during the Regular Meeting to
explain the circumstances leading to the Citation; the members were
also referred to a letter written by Mr. Mendelson in this regard.
However, regardless of the explanations given by Mr. Mendelson, Ms.
Leffingwell said the project had gone on for too long and needed to be
addressed, including a time certain put in place as to when Mr.
Mendelson should come into compliance. Pictures of the violation were
presented to the Board.
OTHER. In an effort to conserve on paperwork and streamline the Code
Enforcement process, Ms. Leffingwell presented the members and the Town
Attorney with standardized forms to be used as regards Notices of
Violation and Hearing. She explained the Notice of Violation would be
unnumbered and carried with her as she goes about her work in Town.
Violators would be noticed on the spot and get a copy of the violation
at the time it was written, rather than having to send it through the
mail. Case numbers, rather then Citation numbers, would be used in
sending out the Claim of Violation and Notice of Hearing forms.
Upon review, the members agreed that it would be a good idea to sim-
plify the process and the Town Attorney had no legal objection to usage
of the forms as presented,
There being no further business to come before the Workshop Meeting at
this time, the meeting was adjourned upon MOTION by Mrs. Gerber/Mr.
Leng at 10:10 A.M.
