Highland Beach, Florida 33487 1. CALL TO ORDER Mayor Hillman called the meeting to order at 1:30 P.M. 2. PRESENT UPON ROLL CALL Commissioner John Shoemaker Commissioner Evalyn David Commissioner Peggy Gossett-Seidman Vice Mayor Natasha Moore Mayor Douglas Hillman Town Manager Marshall Labadie Town Attorney Glen Torcivia Town Clerk Lanelda Gaskins 3. PLEDGE OF ALLEGIANCE The Town Commission led the Pledge of Allegiance. 4. APPROVAL OF THE AGENDA MOTION: David/Moore - To approve the agenda as presented. The motion passed unanimously on a 5 to 0 vote. 5. PRESENTATIONS / PROCLAMATIONS A. Marine Unit Presentation by Chief of Police Craig Hartmann Chief of Police Craig Hartmann presented a PowerPoint presentation on the Marine Patrol Unit. After the presentation, there were conversations about creating a Marine Patrol Unit. The Town Commission was in favor of moving forward with creating a marine unit. Additionally, the Town Commission suggested that Town staff obtain the following: • Estimate of 12-month run rates, including costs for personnel, insurance, fuel, ongoing training, and maintenance. Town Commission Meeting Minutes Date: October 19, 2021 Page 2 of 6 • Written authorization from an association or a community donating a boat slip to the Town's Marine Patrol Unit. • Estimate as to when the Marine Patrol Unit will be operational. Discussion continued about moving forward with securing the marine vessel. Town Manager Labadie explained that town staff would prepare a budget resolution and a proposal for the November 09, 2021, Town Commission meeting. 6. PUBLIC COMMENTS Mayor Hillman called for public comments. Town Clerk Gaskins stated that there were no public comments. 7. ANNOUNCEMENTS Mayor Hillman read the announcements as follows: Board Vacancies Code Enforcement Board - One vacancy for a three-year term Meetings and Events October 28, 2021 - 5:00 P.M. to 7:00 P.M. Food Truck Event November 02, 2021 - 7:00 A.M. to 7:00 P.M. Special Referendum Election November 09, 2021 - 1:30 P.M. Town Commission Meeting November 10, 2021 - 9:30 A.M. Planning Board Regular Meeting Board Action Report 1. September and October 2021 Board Action Reports (For Information Only) 8. ORDINANCES A. Proposed Ordinance An Ordinance of the Town Commission of the Town of Highland Beach, Florida, amending the administrative amendments to the 7th (2020) Edition of the Florida Building Code to provide for reinspection and recertification of existing threshold buildings; providing for the repeal of all ordinances in conflict; providing for severability and codification; and providing for an effective date. Mayor Hillman read the title of the Proposed Ordinance into the record. Building Official Jeff Remas presented this item, and Town Commission discussions followed about the changes to the proposed ordinance. Town Commission Meeting Minutes Date: October 19, 2021 Page 3 of 6 Mayor Hillman called for a ten-minute recessed at 2:29 P.M. The meeting reconvened at 2:49 P.M. Discussions continued about additional changes to the proposed ordinance, such as: removing the word "conducting" from Section 105.16 (c)(5), changing the word "shall" to "may" in Section 110.9(2)(c) and including language in the Building Official's written determination letter about the appeals process. Town staff will present the ordinance as a second/final reading at the November 16, 2021, Town Commission meeting. MOTION: David/Moore - To approve the Proposed Ordinance with the suggested changes as discussed. The Proposed Ordinance passed unanimously on a 5 to 0 vote. 9. CONSENT AGENDA A. None. 10. UNFINISHED BUSINESS A. Continued discussion on the introduction to revised ordinance regarding right- of-way (ROW) protection. Mayor Hillman read the title of Item 10.A. into the record. Town Planner Ingrid Allen presented this item. She explained the modifications to the revised ordinance, such as: changing the definition of "swale," removal of dome shaped buttons from the list of improvements permitted in the public right-of-way, and a provision to allow an appeals process for denial of a right-of-way permit to the Board of Adjustment and Appeals Board. Discussions followed about swales along State Road A1A, the potential impact of the Florida Department of Transportation (FDOT) future RRR project and providing the Town Commission the permitting authority to approve right-of-way permits along State Road A1A until the RRR project is finished. Once the RRR project is completed, the permitting authority will revert as specified in the revised ordinance. Town staff will draft a resolution giving the Town Commission the permitting authority to approve right-of-way permits along State Road A1A. In addition, Town staff will present the proposed ordinance and the resolution at the November 09, 2021, Town Commission meeting. Town Commission Meeting Minutes Date: October 19, 2021 Page 4 of 6 11. NEW BUSINESS A. Discussion on the timeline and schedule for reviewing the Charter Review Board's final report. Mayor Hillman read the title of Item 11.A. into the record. Conversations followed with regards to the timeline and schedule for reviewing the Charter Review Board's final report. The Town Commission's consensus was to schedule a Special Commission meeting on Tuesday, October 26, 2021, at 1:30 P.M., invite the Charter Review Board members, and discuss the following topics: Funding Limitations, Fire and Rescue Protection, and Term of Office for Town Commission. B. Approval of Commission Meeting Minutes October 05, 2021, Commission Meeting Minutes MOTION: David/Gossett-Seidman - To approve the October 05, 2021, Meeting Minutes as amended. October 05, 2021, Meeting Minutes passed unanimously on a 5 to 0 vote. 12. TOWN COMMISSION COMMENTS Commissioner John Shoemaker spoke about the progress of the Veteran Heroes of Highland Beach webpage. He also talked about a written apology that he and Mayor Hillman received from a Highland Beach resident via a newsletter. Commissioner Evalyn David thanked the Charter Review Board members for their time and input. Commissioner Peggy Gossett-Seidman talked about her dog advocating for the upcoming election. Vice Mayor Natasha Moore spoke about the Vote by Mail Canvassing Board meeting that she and Town Clerk Gaskins attended on Thursday, October 14, 2021 . She encouraged the residents to sign their vote by mail ballot before returning them to the Supervisor of Elections Office. Mayor Douglas Hillman also thanked the Charter Review Board members. 13. TOWN ATTORNEY'S REPORT Town Attorney Torcivia had no comments. 14. TOWN MANAGER'S REPORT Town Manager Labadie reported the following: Town Commission Meeting Minutes Date: October 19, 2021 Page 5 of 6 • He has engaged the Raftelis Financial Consultants. The Consultants are reevaluating the Water/Sewer Rate Study with the injection of the American Rescue Funding and incoming revenues. They have provided a proposal and will be providing the Commission with an update at a future Town Commission meeting. • Update on the City of Delray Beach: o He met with City Manager Terrence Moore last week. o He has received the document related to the public records request. o The City has submitted its revised budget for next year. Town Manager Labadie will follow up with City Manager Moore about this matter. • Forensic Audit: o The Town Manager will share the City of Delray Beach documents with Mr. Zucker of Zucker & Associates, P.A. • The Town received a response from the Florida Department of Environmental Protection (DEP) for a grant and has been selected as it relates to the engineering details for the flooding/drainage along State Road A1A. • The next Food Truck Event is Thursday, October 28, 2021. • He spoke about the December 02, 2021, Mingle & Jingle Food Truck Event, including trolley services for residents and installation of the holiday decorations. Mayor Hillman inquired about the crosswalk downlights. Town Manager Labadie explained that the contractor would be installing the lights by the end of the month.
