CODE ENFORCEMENT BOARD
WORKSHOP MEETING - MINUTES
Wednesday, January 20, 1993 9:30 A.M.
Chairman Victor P. Hadeed called the Workshop Meeting to order in Com-
mission Chambers at 9:30 A.M.
Deputy Town Clerk Doris Trinley called the roll. Present were the
Chairman, Vice Chair Ellen B. Gerber and Members Merton Rubin, Horace
Leng, Arthur Hamerman, David Augenstein and Joseph A. Sarubbi.
Also present were Building Official/Code Enforcement Officer Lee
Leffingwell, Town Attorney Carol Sullivan and members of the general
public.
Chairman Hadeed welcomed new Member Joseph A. Sarubbi, who was
recently appointed to the Board, as well as Attorney Carol Sullivan,
who was serving as Town Counsel at today's meetings.
Citation No. 2338-92. Ken Sharp/Highland Beach Drive Associates re 1119

Sec. 1; Chapter 17, Sec. 3.

Citation No. 2341-93. Highland Beach Drive Associates, Ltd., c/o
Lavalle, et al re 1119 and 1123 Highland Beach Drive. Chapter 17, Sec.
3; Chapter 13, Sec. 1 and 3; Chapter 25, Sec. 1; Chapter 12 (Std.
Housing Code), Sec. 103.2.1.
The members addressed the citations at the same time since they related
to the same properties. Ms. Leffingwell advised there had been no word
from Mr. Sharp since the last CEB meeting on December 16; Highland
Beach Drive Associates, Ltd, c/o Lavalle et al, had been cited based on
information recently obtained from the 1992 tax rolls.
Substantial discussion took place regarding exactly who owned the
properties and if, in fact, the Board had the authority to cite other
than the actual owner(s) of record. The question also arose as to
whether there was a condominium association involved since some of the
violations had to do with what could be considered common elements.
Attorney Sullivan responded that she would research the question of
citing other than the owner(s) of record; she did mention that if a
Citation reached the lien process, citing the owner of record would be
imperative.

Ms. Leffingwell advised that both Harvey McClintock and Christine Beams
had responded to the Citations and would probably appear to testify
during the Regular Meeting.
Substantial discussion again took place regarding ownership of the
property under citation, specifically as it related to the vacant lots
versus two (2) existing homes; RTC was noted as possibly being involved
with the vacant land and it was questioned if Boca Bank owned only the
construction mortgages on the existing homes or the homes themselves.
The need to cite the proper owner(s) was again discussed at length, and
Ms. Leffingwell noted that her Department makes every effort to do
this short of a title search; however, if a Citation is indeed served
in error, then the party wrongfully served is asked to inform the Town
of the legal ownership, either to Ms. Leffingwell directly so the
Citation can be directed to the owner of record, or by appearing before
the Board and setting the record straight.
Since the properties under discussion at this meeting each had compli-
cated and unclear origins of ownership, Ms. Sullivan noted the com-
puter in the Town Attorney's office had the capability to do title
searches and she would get the correct information for transmittal to
the Board,
There being no further business to come before the Board, the meeting
was adjourned upon MOTION by MR. AUGENSTEIN/MR. HAMERMAN at 9:57 A.M.
