Hadeed called the Regular Meeting to order in Com- mission Chambers at 10:00 A.M. Deputy Town Clerk Doris Trinley called the roll. Present were the Chairman, Vice Chair Ellen B. Gerber and Members Merton Rubin, Arthur Hamerman, Joseph A. Sarubbi and Leonard D. Bell. Member Russell Richardson was absent. Also present were Town Attorney Carol Sullivan, Building Official) Code Enforcement Officer Lee Leffingwell and members of the general public. MINUTES Upon MOTION by MRS. GERBERlMR. SARUB61, the Minutes of the Workshop and Regular Meetings of March 17, 1993 were unanimously approved. OLD BUSINESS Citations 2340-92, 2340-A-92, 2340-B-92 and 2340-C-92 and 2343-93 (All relating to Royal Cove B & C Site). Chapter 13, Sec. 1 through 3A, 4, 5, and 6 [Land Clearance]. For the record, Ms. Leffingwell again advised that all violations re- lating to Royal Cove B & C site had been corrected. [Affadavits of Compliance will be sent to all parties who were issued citations]. Citation 2339-92. Richard Mendelson, 1124 Highland Beach Dr ., Block 2, Lot 8 Bel Lido. Chapter 17-2 and 6-30(b) [Nuisances and Buildings & Structures]. Ms. Leffingwell repeated there had been no contact from either Mr. Mendelson or his architect since the Board had given a two-month ex- tension (March 17, 1993 meeting) to allow time for Mr. Mendelson's applications to the Planning and Community Appearance Boards; as of this date, the loose tiles remained stacked on the roof. She reiterated the need for definitive action due to the imminence of hurricane season. Skip Jackman, architect for Mr. Mendelson, was sworn in and gave a synopsis of the reasons why the tiles remained loose on the roof. He said Mr. Mendelson had twice changed his mind about what kind of remodeling job he wanted done and, just recently, had advised he was moving from Town and would not be proceeding with remodeling plans of ~, Code Enforcement Board Regular Meeting - Minutes i May 19, 1993 Page 2 of 3 any kind; rather quotes had been requested for putting the tiles back in their original state on the roof and two (Z) bids had been re- ceived from certified roofers as of this date. He added that Mr. Mendelson, due to his changed personal circumstances, was anxious to complete this work and come into compliance; in this regard, Mr. Jackman asked that the Board consider a short extension to complete the job. Substantial discussion took place, with emphasis on the longevity of this violation as well as the impending safety factor regarding hurricane season. In conclusion, it was the consensus of the members to grant a short extension and set a time certain for completion, with a fine to be imposed daily if work was not completed as directed. MOTION by MR. HAMERMAN/MR. SARUBBI was made as follows: THE CODE ENFORCEMENT BOARD GRANTS A TWO-WEEK EXTENSION, UNTIL JUNE 2, 1993, FOR THE TILES ON THE ROOF OF RICHARD MENDELSON'S RESIDENCE AT 1124 HIGHLAND BEACH DRIVE, BLOCK 2, LOT 8, BEL LIDO TO BE PUT BACK IN PLACE. IF THIS WORK IS NOT COMPLETED BY JUNE 2, 1993, A FINE OF $100.00 PER DAY WILL BE IMPOSED UNTIL SUCH TIME MR. MENDELSON COMES . INTO COMPLIANCE. Before a vote was taken, Chairman Hadeed tabled this Motion and called for a Motion to determine 'Findings of Fact.' He asked Ms. Leffingwell if both violations as noted for two (2) Code sections in the Citation still applied and she advised that Mr. Mendelson had com- plied with that portion of the Citation having to do with Chapter 17-2. Accordingly, MR. HAMERMAN/MR. SARUBBI made the following MOTION: THE CODE ENFORCEMENT FINDS RICHARD MENDELSON GUILTY OF VIOLATING TOWN CODE, CHAPTER 6, SECTION 30(b), AS SO CHARGED IN CITATION 2339-92. Roll was first called on this Motion, followed by roll ca11 on the previously tabled Motion. Both met with unanimous favorable vote. NEW BUSINESS For the record, Mrs. Gerber noted this was Mr. Bell's first CEB meeting and, on behalf of the members, welcomed him to the Board. There being no further business to come before the Board at this time, the meeting was adjourned upon MOTION by MRS. GERBER/MR.
