CODE ENFORCEMENT BOARD
WORKSHOP MEETING MINUTES

Wednesday, July 21, 1993 9:30 a.m.
In the absence of Chairman Victor P. Hadeed, Vice Chair Ellen B.
Gerber called the Workshop Meeting to order at 9:30 a.m. in the
Commission Chambers.
Town Clerk Anne M. Kowals called the roll. In addition to Vice
Chair Gerber, present were Members Merton Rubin, Arthur Hamerman,
Joseph A. Sarubbi, Leonard D. Bell, and Russell M. Richardson.
Also in attendance were Town Attorney Carol Sullivan, Building
Official/Code Enforcement Officer Lee Leffingwell, and members of
the general public.
OLD BUSINESS

Members were advised Ms. De Angelis installed a closet with a
portable air conditioner without permission from her Association
or benefit of a Town permit. Ms. De Angelis, upon approval from
her Association to either 'screen in' or 'glass enclose' the
closet, will be required to obtain the proper Town permit in order
to come into compliance.

Noting Boca Dock has obtained a permit to repair the seawall cap,
the Building Official advised Mr. Lemon has been cutting/trimming
the vegetation and someone has been engaged to remove the debris
from the property. Ms. Leffingwell noted copies of Mr. Lemon's
letter of 7/18/93 were distributed to the Members, for their
consideration, this morning.

Ms. Leffingwell stated she discussed the condition of the property
with the new owner who complied with a request to board up the
building as it is unsafe and we are concerned with the structure.
At that time, it was also requested the property be cleared of the
overgrown vegetation to permit visibility of abandoned building by
our Police Officers patrolling the area. Noting the owner was
subpoenaed to attend this meeting as the overgrowth was not
attended to, Ms. Leffingwell advised this matter is before the CEB
for the first time.
Mr. Bell, alluding to a report of May 11, 1993 from the Code En-
forcement Officer to this Board, was advised this matter is not an
agenda item therefore it is not up for discussion.

Following the CAB's recommended approval to clear the property,
sod and plant trees on said parcel, the Building Department issued
the necessary permit to allow work to commence. A 'Notice of Vio-
lation' was issued when work was halted and the site became a
safety problem with children playing in the mud-holes and the area
is a breeding ground for mosquitoes. It was noted this property
is affecting the bike path due to erosion and many complaints
regarding the site were received in Town Hall.
Ms. Leffingwell, noting a permit is null and void after ninety
days if no work commences, advised the property should be fenced
in, filled in and graded with the front area, next to the bike
path, bermed.
There being no further business to come before the Board at this
time, the Workshop Meeting was adjourned at 9:55 a.m.

I must apologise for being unable to keep my appointment with
the Board on Wednesday, but it was not possible to change an
important appointment on July 21. I have to go up to the Shand
Medical~Center, Gainesville with my wife. She has waited for four
months to get this appointment for an examination pertaining to a
kidney transplant, and to miss this appointment would jeopardise
her standing on the waiting list.
It is her health problems, and the finances involved, and my
health also that have been the cause of the delays in dealing with
the seawall repairs and pruning work on our property.
The larger Brazilian Pepper trees I had removed by Pete and
Rons Tree Service in April, but after that the final cleaning up
• was delayed by a bronchial asthma condition I had, and which I have
finally overcome in the past two weeks. All the vegetation along
the property lines has now been pruned back and the trimmings are
ready to be hauled away.
I signed a contract with Boca Seawall on June 25 and was
assured that the work would be handled within a week or ten days.
Unfortunately they have had delays due to weather and they were not
able to start until Friday, July 16. The work will be completed by
Tuesday of this week. I have arranged with this same company to
have fill hauled in next week.
Once this work is completed I will then resod the whole
property. I have arranged with Sylvester Hollis, Yard Service to
have this done, and they will maintain the property from now on.
The front driveway is to be paved by Riggs Concrete Service, in
Delray, who have given me a satisfactory estimate, so hopefully
everything is now coming together.
I do assure you that I am as anxious as you are to make the
property shipshape again, because we built this house in 1970, and
I was able to maintain it in good condition until quite recently.
This past three years have been very difficult, and I sincerely
regret the delays that have occurred.

and to answer any questions they may have. In the meantime I would
be most grateful if you would accept my assurances that everything
