Highland Beach, Florida 33487 1. CALL TO ORDER Mayor Hillman called the meeting to order at 1:30 P.M. 2. PRESENT UPON ROLL CALL Commissioner John Shoemaker Commissioner Evalyn David Commissioner Peggy Gossett-Seidman Vice Mayor Natasha Moore Mayor Douglas Hillman Town Manager Marshall Labadie Town Attorney Glen Torcivia Town Clerk Lanelda Gaskins 3. PLEDGE OF ALLEGIANCE The Town Commission led the Pledge of Allegiance. 4. APPROVAL OF THE AGENDA Commissioner Gossett-Seidman added a "Discussion on Blue-Green Algae" as Item 11.G. under New Business. MOTION: David/Moore - To approve the agenda as presented. The motion passed unanimously on a 5 to 0 vote. 5. PRESENTATIONS / PROCLAMATIONS A. None. 6. PUBLIC COMMENTS Mayor Hillman called for public comments. ANNOUNCEMENTS Mayor Hillman read the announcements as follows: Board Vacancies Code Enforcement Board - One vacancy for a three-year term Meetings and Events October 07, 2021 - 9:30 A.M. Board of Adjustment & Appeals Regular Meeting October 11, 2021 Town Hall Closed in observance of Columbus Day October 12, 2021 - 2:00 P.M. Code Enforcement Board Regular Meeting October 14, 2021 - 9:30 P.M. Planning Board Regular Meeting Board Action Report None. 8. ORDINANCES A. None. 9. CONSENT AGENDA A. Approve and authorize the Public Works Director to purchase new Sonic Water Meters from Sunshine Meter and Supply Inc, in the amount of $37,253.36. Town Manager Labadie presented this item. MOTION: David/Gossett-Seidman - To approve the Consent Agenda as presented. The Consent Agenda passed unanimously on a 5 to 0 vote. 10. UNFINISHED BUSINESS A. Continued discussion of the new Fire Rescue insignia. Mayor Hillman presented this item along with a PowerPoint presentation. He explained why the Town could not use a red caduceus symbol on the Fire and Rescue insignia. Following the presentation, the Town Commission agreed with the blue caduceus symbol, the red fire hydrant symbol, and that the words "Fire Rescue" would remain red in color. Building Official Jeffery Remas informed the Town Commission of the updated changes related to Section 3, 110.9, Recertification of Building Components, of the proposed ordinance. Discussion followed, and the Town Commission suggested additional modifying to the proposed ordinance. Mayor Hillman suggested that Commissioner David work with Town staff and the Town Attorney on this matter (For more information about this item, please visit the Town's Media Archives & Minutes webpage to access and view the audio/video recording). 11. NEW BUSINESS A. Approve and authorize the Town Manager to execute the contract with Rubin, Turnbull & Associates, Inc. for lobbying services for the fiscal year 2022. Town Manager Labadie presented this item. He also introduced Matt Sacco with Rubin, Turnbull & Associates, Inc. Mr. Saco provided comments about his firm and the services that it would offer to the Town. MOTION: David/Hillman - To approve and authorize the Town Manager to execute the contract with Rubin, Turnbull & Associates, Inc. for lobbying services for the fiscal year 2022. The motion passed unanimously on a 5 to 0 vote. B. Approve and authorize the Mayor to execute the Voting Processing Equipment Use and Elections Services Agreement with Wendy Sartory Link Palm Beach County Supervisor of Elections for the November 2, 2021, Special Referendum Election. Mayor Hillman read the title of Item 11.B. into the record. MOTION: David/Hillman - To approve the Voting Processing Equipment Use and Elections Services Agreement. Resolution No. 2021-034 A Resolution of the Town Commission of the Town of Highland Beach, Florida, calling a Special Referendum Election to be held on Tuesday, November 2, 2021, for the purpose of submitting to the electorate a proposed question regarding the establishment and funding of a town Fire and Rescue Department; directing the election to be held within the municipal boundaries of the town between the hours of 7:00 a.m. until 7:00 p.m.; requesting the Palm Beach County Supervisor of Elections to conduct the Town's Special Referendum Election; providing for the publication of notice of the special referendum election; designating the members of the town's canvassing board; and providing for severability, conflicts, and an effective date. Mayor Hillman read the title of Item 11.C. into the record. Vice Mayor Moore volunteered to participate as a member of the Canvassing Board. Mayor Hillman provided additional comments about Election Day. MOTION: David/Hillman - To approve Resolution No. 2021-034 designation Vice Mayor Natasha Moore as a member of the Canvassing Board. Resolution No. 2021-034 passed unanimously on a 5 to 0 vote. D. Resolution No. 2021-035 A Resolution of the Town Commission of the Town of Highland Beach, Florida, correcting a scrivener's error in Resolution No. 2021-027 referencing the Aggregate Debt Service Millage for the fiscal year beginning October 1, 2021, and ending September 30, 2022; providing that the Final Aggregate Debt Service Millage Rate shall be corrected to 0.3930 Mils; providing for severability, conflicts, and an effective date. Mayor Hillman read the title of Item 11.D. into the record. MOTION: David/Hillman — To approve Resolution No. 2021-035. Resolution No. 2021-035 passed unanimously on a 5 to 0 vote. E. Approval of the proposed Town Commission meeting schedule for fiscal year 2021-2022. Mayor Hillman read the title of Item 11.E. into the record. Town Commission discussed removing July 5, 2022, meeting from the schedule. MOTION: David/Gossett-Seidman - To approve the Proposed Town Commission meeting schedule for fiscal year 2021-2022 as amended. Approval of Commission Meeting Minutes September 21, 2021, Commission Meeting Minutes September 21, 2021, Commission Special Second Public Hearing Budget Meeting Minutes Mayor Hillman read the title of Item 11.F. into the record. MOTION: David/Gossett-Seidman - To approve September 21, 2021, Commission Meeting Minutes and September 21, 2021, Commission Special Second Public Hearing Budget Meeting Minutes, as amended. The Meeting Minutes passed unanimously on a 5 to 0 vote. G. Discussion on the Blue-Green Algae. Commissioner Gossett-Seidman (This item was added to the agenda) Commissioner Gossett-Seidman presented this item. Assistant to the Town Manager, Terisha Cuebas, provided comments about the blue-green algae incident last week. 12. TOWN COMMISSION COMMENTS Commissioner John Shoemaker spoke about Dan Bellante as it relates to the dunes and beach restoration. He also talked about the sense of culture that the current Town Commission has created. He encouraged the residents to communicate with the Town Commission about their concerns. Commissioner Evalyn David commented on the dune restoration and the timing of looking into Town-related concerns. Commissioner Peggy Gossett-Seidman spoke about a meeting that she attended last week with Florida State Representative Michael Caruso (District 89), District Four Secretary Gerry O'Reilly, with the Florida Department of Transportation and his two associates, John "JJ" Piskadlo, Legislative Assistant to Florida State Senator Tina Polsky's (District 29), and Town staff (Terisha Cuebas, Pat Roman, Jeff Remas and Craig Hartmann) regarding swales. Chief of Police Craig Hartmann also provided remarks about the meeting. A. Report on Palm Beach League of Cities meeting Commissioner Gossett-Seidman reported that there were conversations about mass transit. Town Commission Meeting Minutes Date: October 05, 2021 Page 6 of 6 Vice Mayor Natasha Moore asked if there was another community event before the November 2, 2021, Special Referendum Election. Town Manager Labadie replied that the next Food Truck Event is scheduled for October 28, 2021. Mayor Douglas Hillman commented about the Food Truck sign-up. He also provided comments about simplifying the communication with the Town residents concerning the Special Referendum Election in a direct letter from the Mayor. 13. TOWN ATTORNEY'S REPORT Town Attorney Torcivia had nothing to report. 14. TOWN MANAGER'S REPORT Town Manager Labadie provided an update as follows: • The signs regarding the November 2nd Special Referendum Election. • Kudos to Accreditation Manager Eric Aronowitz and Officer Gerry Riccio for assisting the Palm Beach County School District with training. • Greetings to the new residents that he met at the Food Truck events. • The Fire and Rescue project is progressing. • The forensic audit related to the public records requests that the Town submitted to the City of Delray Beach in June. 15.
