REGULAR. MEETING MINUTES
Wednesday, November 17, 1993 9:30 a.m
Chairman Victor P. Hadeed called the Regular Meeting of the Code
Enforcement Board of the Town of Highland Beach, Florida, to order
in the Commission Chambers at 9:30 a.m.
Town Clerk Anne M. Kowals, CMC, called the roll. In addition to
Chairman Hadeed, present were Vice Chair Ellen B. Gerber, Members
Merton Rubin, Joseph A. Sarubbi, Leonard D. Bell, and Russell M.
Richardson. Absent was Member Arthur Hamerman.
Also in attendance were Town Attorney Thomas E. Sliney, Code
Enforcement Officer Lee Leffingwell, and members of the general
public.
APPROVAL OF MINUTES
Submitted for consideration were the July 21, 1993 Workshop and
Regular Meeting Minutes as well as the September 15, 1993 Special
Workshop Meeting Minutes.
• Following a brief discussion regarding the September 15 Special
Workshop Meeting Minutes, MOTION was made by MR. SARUBBI/MR. BELL
to approve the three sets of Minutes as submitted. The MOTION
carried without objection.
OLD BUSINESS
At this point, individuals who would be giving testimony at this
meeting, namely Dr. Roy Lemon and Mr. Steven Bruckner, were 'sworn
in' by the Town Clerk.
Code Enforcement Officer Lee Leffingwell informed the Board this
matter, tabled from the previous Code Enforcement Board Meeting,
has existed for six months or more. Ms. Leffingwell noted the
cracks in the seawall were repaired; however, the back-fill along
the seawall has not been done. It was noted that it had been
suggested Dr. Lemon engage a contractor to correct the matter of
the overgrown vegetation which is now a fire hazard.

Dr. Roy Lemon of 4201 Intracoastal Drive, noting he had some
personal problems that prevented his correcting the violations,
apologized to all for having been remiss in maintaining his prop-
erty. Noting a tree service from West Palm Beach has been engaged
to address the matter of the overgrown vegetation, Dr. Lemon ad-
vised Boca Seawall, having completed repairs to his seawall, will
back-fill along the seawall as soon as the land clearing is done.
Dr. Lemon noted, following the land clearing, the entire lot will
be resodded and he will continue maintaining the property.
Mr. Steven Bruckner of 4205 Intracoastal Drive, adjacent to Dr.
Lemon's property, advised he appreciates the apology, however, his
concern is that the property be properly maintained in order to
avoid any hazards (i.e. a large tree falling and pulling down
power lines). Noting he is on an annual contract with a seawall
service, Mr. Bruckner advised Dr. Lemon's seawall, if not properly
maintained, will have an adverse affect on his seawall. It was
noted Dr. Lemon's parcel is so overgrown that it would not be
possible to get to the seawall for the purpose of back-filling.
Following substantial deliberation VICE CHAIR GERBER/MR. SARUBBI
made the following MOTION:
"The Code Enforcement Board finds Dr. Roy and Mary Lemon are
• in violation of the three sections cited above." (By his own
testimony, Dr. Lemon conceded violations do exist.)
The MOTION was favorably received by all Members.
Further, MR. SARUBBI/MR. RICHARDSON proposed a MOTION to issue an
ORDER that would allow Dr. Lemon until December 15, 1993 to
complete the work; if the work is not completed by that date, it
will be the intent of the Code Enforcement Board to impose a daily
fine until the work is completed. This MOTION received unanimous
approval.
The Agenda being fully addressed, MOTION was made by VICE CHAIR
GERBER/MR. BELL to adjourn. CHAIRMAN HADEED adjourned the Regular
Meeting of the Code Enforcement Board at 10:10 a.m.
