(Minutes) Highland Beach Town Co~nmaissioa. May 2, 1956. A Regular Monthly Meeting originally scheduled for 5/1/56, but postponed by unanimous consent of all five commissioners until May 2, 1956 at 2;30 P.M. following the special meeting which was held to canvass the Election results. The meeting was called to order at 2:30 p.m. by Mayor Smith. Also present were Comm. Hertwig, Noble and Weber. Comm. Eypel was absent. In accordanas with the Charter Act and the Town Code, each Commissioner prose®ded to subscribe to the following oath, to wit: I DO SOLEMNLY STIrEAR ( OR AFFIRM) THAT 2 WILL SUPPORT, DEFEND AND PROTECT THE CONSTITUTION AND GOVERNMENT OF THE UNITED STATES~AND OF THE. STATE OF FLORIDA AGAINST ALL ENEMIES, DOMESTIC OR FOREIGN, AND THAT I WILL BEAR TRUE FAITH, LOYALTY AND ALLEGIANCE TO THE SAME, AND THAT I AM ENTITLED TO HOLD. OFFICE UNDER THE CONSTITUTION OF THE UNITED STATES AND THE CONSTITUTION OF THE STATE OF FLORIDA, AND THAT I WILL FAITHFITLLY PERFORM ALL THE DUTIES OF THE OFFICE OF COMMISSIONER, ON WIiICH I AM ABOUT TO ENTER, SO HELP ME GOD. There was considerable discussion about the failure of the owners to carry out any improvement on the former Totterdals Tract which has bash recorded under the Hams of "Delray-by-the-Sea", Under Res- olution #50 the Town had made valuable concessions to the owners in order to encourage earl~t and rapid development which has not taken place. Comm. Noble moved that Resolution ~ 50 be referred to the Town Attorneys to see what steps may properly be taken to protect the interests of the Town and cancell the concessions which were made. Comm. Weber seconded the motion and it was adopted by the affirmative votes of Comm. ?Hertwig, Noble, Smith and Weber. There was no dissent. Comm. Hertwig moved that the Town Treasurer be authorized and direct- ed to pay from the sinking fund at the First Federal Savings & Loan of Delray Beach, the semi-annual interest, and X2,000.00 in principal due to be paid on the Water Bonds on the first of June. The motion was seconded by Comm. Noble and adopted by affirmative votes of Comm. 3ertwig, Noble, Smith and Weber. There was no dies ti vote. Hartwig explained that an audit of the Town accounts was overdue and requested a renewal of the authorization to have the accounts audited as nearly as feasible to the present time. Comm. Weber moved that the Town Clerk be authorized and directed have Mr. Howard Smith bring the audit up to date. The motion was seconded by Comm. Noble and adopted by affirmative votes of Comm. Hartwig, Noble, Smith and Weber, with no dissent. Comm. Hartwig moved that the meeting be recessed to ?;30 p.m. on Thd~rsday May 10, 1956. The motion was seconded by Comm. Highland Beach Town Commission. May 2, 1956. A Special Meeting held in accordance with the Election Ordinance of the Town, to canvass the Election results. The meeting was called to order at 2:00 p.m. by Mayor Smith; also present were Comm. Hartwig, Noble and Weber. Comm. Eypel was absent. Mr. Donald F. Ross, Clerk of the Election Board presented the certi- fication of the reaults,of the Election held May 1, 1956, which ware as follows: A total of 32 ballots were voted. For Mayor-Commissioner, J. Morrison Smith received......32 votes. For Vic®-Mayor-Commissioner, Arthur Eypel received......31 votes. For Vice-Mayor-Commissioner, Alfred Sinsey received..... 1 vote. For Town Clerk-Commissioner, Rudolph W. Hartwig raceived3l votes. For Town Clerk-Commissioner, Donald F. Rosa received.... 1 vote. For Town Commissioner, Mildred S. Nobl® raceived........31 votes. For Town Commissioner, H. F. R. Weber received..........31 votes. The following papers accompanied the Election Board+s Certification of the, results of the Election. Signature list of those who voted in the Election. Specimen copy of the Official Ballot. IIpon examination, the Election Board+s certification and the accom- panying papers were Pound to be in order and correct and the mem- bers of the Town Commission Pound them to be so. Thereupon, Comm. Weber moved for adoption of Resolution ~` 61 declaring the official results of the Election. The motion was seconded by Comm. Noble and adopted by affirmative votes of Cow. Hartwig, Noble, Smith and Weber. There was no dissenting vote. Resolution # 61 appears on the following page, page 2 of these minutes.
