Highland Beach, Florida 33487 1. CALL TO ORDER Mayor Hillman called the meeting to order at 1:30 P.M. 2. PLEDGE OF ALLEGIANCE The Town Commission led the Pledge of Allegiance. APPROVAL OF THE AGENDA Mayor Hillman added a "Discussion of the new insignia for the Fire and Rescue Department" to the agenda as Item F, under New Business. MOTION: David/Moore - To approve the agenda as modified. The motion passed unanimously on a 5 to 0 vote. 4. PUBLIC COMMENTS A. Stewart Perlow's Email Mayor Hillman called for public comments. Town Clerk Gaskins read Mr. Perlow's email concerning his observation of an incident at the Toscano West Condominium involving a resident. Delray Beach Fire Chief Tomey provided comments about the incident involving the resident at the Toscano West condominium. Town Commission Special Meeting Minutes Date: July 13, 2021 Page 2 of 6 Mr. Joe Mauceri commented about the holiday decoration related to the Americans for Freedom Movement. Mr. Jerry Wolfe voiced his concerns about the increased water rates. Ms. Rhony Svenstrup commented about an article in the Coastal Star regarding the creche and menorah. She also voiced her concerns about the wonderful traditions of the holiday decorations. 5. PRESENTATION A. Legislative Sessions Updates by Florida State Representative Michael Caruso (District 89) Florida State Representative Michael Caruso (District 89) gave an update on the Legislative Session and spoke about the Florida House of Representative and the Florida Senate approved budget for fiscal year 2022, as well as the appropriations that he sponsored. He also provided an overview on the following bills that passed in both the House and Senate: House Bill 1: Combating Public Disorder, Senate Bill 90: Elections, House Bill 15: Taxation, Senate Bill 2512: Stamp Tax Distribution, House Bill 7045: School Choice, House Bill 365: Motor Vehicle Rentals, House Bill 319: Substance Abuse Service Providers, House Bill 805: Volunteer Ambulance Services, and House Bill 31: Public Accountancy. 6. NEW BUSINESS A. Resolution No. 2021-019 A Resolution of the Town Commission of the Town of Highland Beach, Florida, setting the proposed not to exceed millage rate pursuant to Section 200.065(2)(B), Florida Statutes, and setting the date, time, and place at which the public hearing will be held to consider the proposed millage rate and tentative budget. Mayor Hillman read Resolution No. 2021-019 title into the record. Finance Director Matthew Lalla presented this item. MOTION: David/Moore - To accept (approve) Resolution No. 2021-019. Upon roll call, Resolution No. 2021-019 passed on a 5 to 0 vote. B. Resolution No. 2021-020 A Resolution of the Town Commission of the Town of Highland Beach, Florida, amending Resolution No. 20-017, which appropriated funds for the 2020-2021 fiscal year budget and providing an effective date. MOTION: David/Gossett-Seidman - To accept (approve) Resolution No. 2021-020. Resolution No. 2021-020 passed unanimously on a 5 to 0 vote. C. Discussion on Building Department Recertification Process Building Official Jeffrey Remas presented this item. He explained that Miami Dade and Broward counties have the recertification process in place, and both had adopted 40-year programs. A potential process with surrounding agencies such as Palm Beach County and the City of Boca Raton are in discussion. He spoke about the Florida Building Code to include the town's own amendments, residents contacting the Building Department expressing concerns about their buildings, and about threshold buildings. He gave the definition that threshold buildings are any buildings greater than three stories or have an occupancy load of greater than 500 persons. He suggested a proactive letter be sent to condominium associations letting them know about the pending ordinance and legislation changes. There was dialog among the Town Commission which ultimately resulted in their consensus that Town staff would prepare a letter which will remind condo associations about the incident that occurred in the Town of Surfside, Florida, and to inform them that Town Management is in the process of formulating a building recertification program. The letter will come from the Town Commission and will include the Town Manager and Building Official names on it. D. Designation of a Voting Delegate for the Florida League of Cities 95th Annual Conference — Required Business Meetings. MOTION: David/Moore —To nominate Commissioner Peggy Gossett-Seidman as the Voting Delegate for the Florida League of Cities 95th Annual Conference. Item 6.D. passed unanimously on a 5 to 0 vote. E. Approval of Commission Meeting Minutes Mayor Hillman read Item 6.E. title into the record. April 06, 2021, Commission Meeting Minutes April 20, 2021, Commission Meeting Minutes May 05, 2021, Commission Meeting Minutes May 18, 2021, Commission Meeting Minutes MOTION: David/Shoemaker - To approve the Meeting Minutes as corrected. The Meeting Minutes passed unanimously on a 5 to 0 vote. Mayor Hillman commented that the meeting minutes were supposed to be reduced to summary minutes only. Then reiterated that the Town Commission decided to keep the Town Commission Special Meeting Minutes Date: July 13, 2021 Page 4 of 6 audio/video recordings permanently, and that detailed meeting minutes are no longer necessary because the audio/recordings are maintained permanently and are available on the Town's website. F. Proposed Highland Beach Fire and Rescue Department Insignia (This item was added to the agenda) Mayor Hillman presented this item. He gave a PowerPoint Presentation of various Fire Department insignia designs, the history of the Maltese Cross, and the proposed insignia for the Highland Beach Fire and Rescue Department. Following the presentation, there were several suggestions from the Town Commission to modify the insignia as follows: Consider an EMS logo on the left side instead of the latter/helmet image, thin out or eliminate the black outline, reduce the size of the word "rescue" because the letter "E" bleeds onto the handle of the hatchet, remove the helmet/latter and the fire hydrant, place a banner on the bottom of the insignia with the words "Fire Rescue" curving upward (similar to Delray Beach Fire Rescue insignia), turn the helmet image forward and put an emblem on it, make the background color white behind the latter/helmet, the fire hydrant and the words "fire rescue"; remove the hatchets and clean up the top banner. Mayor Hillman will share the Town Commission suggestions with Mr. Rodrigo Griesi and bring the renderings back at a future meeting. 7. TOWN COMMISSION COMMENTS Commissioner John Shoemaker had no comments. Commissioner Evalyn David spoke about the State of Florida focusing on no rioting and a letter that the Town received from the Freedom from Religion Foundation involving holiday decorations. There were conversations about the letter and the holiday decorations. It was the suggestion of the Town Commission to keep the holiday decorations such as the menorah, nativity set, and the tree. Commissioner David mentioned that if someone in the Town would like to add tasteful decorations of a different religion, that would be fine so long as the decorations fit in with the Town's decor. Town Attorney Torcivia stated that he would research this matter and report back to the Town Commission at the next meeting. Mayor Natasha Moore spoke about the water usage and water rate structures and about a calculation issue that she discovered when researching/reviewing sample water bills of several condominiums associated with sewer usage. Town Manager Labadie explained that there was a billing software issue. Vice Mayor Moore emphasized to the residents to look at their water usage on every utility bill. Lastly, she provided comments about the tax savings, assessed value, and increased water rates. Commissioner Peggy Gossett-Seidman provided comments about possibly obtaining a lobbyist for the Town and the costs associated with obtaining a lobbying firm. She also Town Commission Special Meeting Minutes Date: July 13, 2021 Page 5 of 6 commented that the National League of Cities Association as it relates to forcing the issue of federal dollars being provided to smaller municipalities in light of COVID-19 to help with restructuring. Discussion ensued about including money in the budget for a lobbying firm. Mayor Douglas Hillman spoke about the written communication prepared by each Town Commissioner and the Town Manager's Minutes. It was the consensus of the Town Commission for Town staff to mail the Town Manager's Minutes every other month and mail the Town Commission letters to the residents sequentially. Town Attorney Torcivia has no comments. Town Manager Labadie gave an update on the following: • The technical difficulties with the software program related to the sewer rate structure. • The authorized work to commence with the contractor for the sewer lining project will begin over the next four to six weeks. • Completion of the side streets video camera inspection (closed-circuit television inspection) and some problems found in Bel Lido, which are urgent repairs. • Fire and Rescue Project: Next Tuesday, the Town Manager will present a contract to the Town Commission for the lead consultant. The Town Manager's Office will schedule one-on-one meetings on Tuesday morning for each Town Commissioner to speak with Mr. Glen Joseph, the Lead Consultant who assists with the Fire and Rescue Department implementation team. Town Attorney Torcivia has drafted the recertification process. • The town staff is making progress with the Building Recertification process. • The budget is in great shape. • Charter Review Board has made much progress; their next meeting is on Monday, Town staff will be working on the Charter Review Board Report, and Town Attorney Torcivia is putting together the ballot language. • The Town Commission will be discussing the referendum language at the August 5th Town Commission meeting. • PACE Marketing Firm is currently working on the Town's marketing plan. • Implementing Food Truck Thursdays in September and October to welcome residents to meet the Town Commissioners to talk about community issues, create a sense of community, and educate the residents on the Fire and Rescue campaign.
