Several members of the Commission found it advisable, in the interests
of the Town, to attend a meeting in Delray Beach relative to the proposed
new Beach District. Therefore when Comm. Hertwig called the meeting to
order at 7:30 p.m. no other commissioners were present and the meeting
was declared recessed to 7;30 p.m. on October 9, 1956.

The meeting was called to order at 7:30 p.m. by Mayor Fypel. Also pre-
sent were Comm. Breckenridge, Hertwig, Noble and Weber.

held on September 18, 1956 as well as minutes of the regular monthly.
meeting of the Town Commission held on September 18, 1956, were read and
approved on Motion of Comm. Breckenridge, seconded by Comm. Weber and
the affirmative votes of Comm. Breckenridge, Eypel, Hertwig, Noble and
u'Veber.
Because of the bad mosquito condition there was much discussion about
the failure of the owners of the tract known as Delray-by-the-Se~o
continue with the grading and filling of the tract. Comm. Noble moved
that the matter be referred to the Town Attorney to see what steps can
be taken to force some remedial action and that Comm. Hertwig write a
letter to the owners to see if they cannot be brought to see the wisdom
of acting without compulsion. Comm. Breckenridge seconded the motion
and it was adopted by the aff irmative votes of Comm. Breckenridge, E'ypel,
Hertwig, Noble and Weber.
By general agreement it was decided that Comm. Hertwig should talk with
the owners of Delray-by-the-Sea and request removal of the improperly
located signs of BADER PROP~RTIE'S INC. from the construction shacks now
on the property.
By general agreement Comm. Hertwig was directed to lower the pressure
on the water-mains to lessen the danger of another leak being caused
like the on.e just repaired at the east end of the canal crossing. There
was discussion about .the seriousness of that recent break in the water
main and the members of the commission examined the section of the pipe
which had been taken out. By general agreement it was decided that a
committee of the Commissioners take the section of pipe to the Town
Engineer+s office and discuss the matter of the failure with him. The
cost to the Town of repairing the leakin joint is represented by a bill
from Howard Lee Cromer to the amount of 1,914.65 of which ~fi1,489.50
is the charge of Powell Brothers for the use of floating equipment,
divers and related work. Payment of the bill is temporarily withheld.
Comm. ti'Teber brought up the question of the usual misunderstandings
arising from the signs which were placed this summer at the North and
south Town limits. By General agreement it was decided that the signs
had served their purpose for the time being and that they could and
should be removed and stored for safe keeping.

Comm. Weber made critical comment about some remarks said to have
been made by Comm. Hertwig several months ago to members of the
Delray Beach City Commission during informal talks with them by
Mayor Eypel and Comm. Hertwig about the attempts to locate a new
public beach within Highland Beach Town limits. Comm. Hertwig object-
ed to the criticism on the ground that Comm. Weber was not present
and therefore had no accurate first hand knowledge of what was said
at those conversations.
There was a heated exchange of words between Comm. V'deber and Comm.
Hertwig of ter which Comm. Weber stated he was resigning then and there
and that the Commission would rec~~ve written confirmation of his resig-
nation. Comm. Weber then walked out of the meeting.
There was some discussion about the selection of a commissioner to
fill the vacancy created by Mr. Webers resignation. By general agree-
ment it was decided to defer the matter until P~?r. tiVeber~s formal con-
firmation is received and acted upon.at the next meeting.
There was discussion of the offer by the Town of Boca Raton of a large
tract of land as a proposed location for the new four year college now
being projected for South Florida. Comm. Breckenridge moved passage of
a formal resolution in favor of the Boca Raton location. Comm. Noble
seconded adoption of the resolution and it was approved by the affirm-
ative votes of Comm. Breckenridge, Fypel, Hertwig and rdoble there was
no dissent. The Resolution, ATumber 68, appears on the following page,
page 3 of these minutes.

motion of Comm. Noble, seconded by Comm. Breckenridge and the affirm-
