Minutes. Highland Beach Town Commission. May 5, 1954 A Regular. monthly meeting originally scheduled to be held Tuesday May 4, 1954, but postponed by unanimous consent of all five Commissioners until May 5, 1954 at 3:30 p,m. follo~- ing the special meeting to canvass the Election Results. The meeting was called to order by Mayor Smith at 3;30 p.m. Also pre- sent were Comm. Harmon, Noble, Skillman and Hertwig. In accordance with the Charter Act and the Town Code, each Commissioner proceeded to subscribe to the following oath, to wit; I DO SOLEMNLY SWEAR (OR AFFIRM) THAT I WILL SUPPORT, DEFEND AND PROTECT THE CONSTITUTION AND GOVERNMENT OF THE UNITED STATES AND OF THE STATE OF FLORIDA AGAINST ALL ENEMIES, DOMESTIC OR FOREIGN, AND THAT I WILL BEAR TRUE FAITH, LGYALTY AND ALLEGIANCE TO THE SAME, AND THAT I AM ENTITLED TO HOLD OFFICE UNDER THE CONSTITUTION OF THE UNTIED STATES AND THE CONSTITUTION OF THE STATE OF FLORIDA, AND THAT I WILL FA ITH- FULLY PERFORM ALL THE DUTIES OF THE ORFICE OF COMMISSIONER, ON WHICH I AM ABOUT TO ENTER, SO HELP ME GOD. •" ~~.. ~, ~ .'~%t ~ ~ ~ G `. ,/'' ?.cap. °'i ,. ` ~~~ i] ~ SUBSCRIBED AND SWORN TO BEFORE US THIS 5t~i DAY OF NIAY, A.D. 11954. ,.~ e ~ r Town Cle1r~- Mayor ,~ Each Commissioner present having taken the above and foregoing oath, they proceeded to transact the necessary business of the Town, Minutes of the meeting of April 6, 1954 were read and approved on motion of Comm. Noble, seconded by Comm. Harmon and the affirmative votes of all five commissioners present. The clerk read a letter of complaint dated May 1, 1954 from Miss M. Louise Haberman, making inquiry about and objecting to repairs being made to the buildings on the West side of AlA which have been used as an off ice by Mr. Robert Totterdale. After some discussion Comm. A~ay 5, 1954 Totterdale. The motion was seconded by Comm. Noble and approved by affirmative votes of all five commissioners prescnt. Mayor Smith appointed Comm. Skillman and himself to serve on the committee and by general agreement this committee was requested to also see what suggestions R~r. Byrd might have as to ways and means of trying to ate= secure from the County Commission one of their worked out rock pits for future use of the Town in relation to refuse disposal, as well as to check the legality of a proposed contribution to the Girl Scout's Building Fund. (See later in these minutes.) Comm, Hertwig brought up the matter of a proper file to keep the Town papers and accounts more secure from loss or fire and he requested that he be authorized to purchase a suitable file at a cost of about X225,00. Comm. Harmon moved that Comm, Hertwig be authorized and dirty ected to purchase a suitable fireproof file at a cost not to exceed X250.00. The motion was seconded by Comm. Noble and approved by affirm- ative votes of all five commissioners present. moved Comm. Hertwig that as Town Treasurer he be authorized and directed to carry out the payments due June 1, 1954 of the interest and principal due on the Town Water Bonds. Interest to be paid being X2,425.00 and principal to be paid being X2,000.00. Comm. Noble seconded the motion and it was passed by affirmative votes of all Eive comm'i~'rs present. Mayor Smith took the floor and,with Vice~Mayor Harmon presiding, moved that the Town Treasurer be authorized and directed to mare a contribu- tion of X25,00 to the Building Fund of the Delray Beach Group of the Girl Scouts, After some discussion it was generally agreed that the project under discussion would be of direct benefit to the residents and taxpayers of Highland Beach. Comm. Skillman seconded the motion and it was approved by affirmative votes of Comm, Harmon, Noble, Skillman and Smith. Comm. Hertwig voted against the motion, stating that he did not consider it an appropriate use of Town Funds. There was general discussion about the extent of the work for the Town being done by Town Clerk Hertwig ~tnn~~~ without remuneration but Comm, Haatwig stated it was his belief that for some time to come the Town Commissioners would 'nave to continue to carry on the business of the Town without expectation of receiving compensation for doing so. There was discussion about news that the State or County was engaged in naw v~rork for control of sand flies. NIr. H. F. R. Vdeber seemed to be quite well inf ormed on the subject and by general agreement he was requested to act inf ormally as a taxpayer's committee, to look into the matter and get as much inf ormation as possible so that if advis- able the Commission might give the matter firther consideration. The meeting was called to order at 2:30 p.m. by P~Zayor Smith; also present were Commissioners Harmon, Noble, Skillman ~ Hertwig as were members of the Election Board. Mr. Wm. L. Due, Clerk of the Election Board presented a certification of the results of the Election held May 4, 1954, which were as follows; A total of 31 ballots were voted in the election. Morrison Smith received...... 29 votes For Mayor-Commissioner, Robert Weber received........... 1 vote For Mayor-Commissioner, Clem Haclnnan received........... 1 vote For Vice-Mayor-Commissioner, John F. Specimen copy of the Official ballot. Upon examination, the Election Boardts certification and the attached papers were found to be in order and correct and the members of the Town Commission f ourid them to be so. Commissioner Noble thereupon moved for adoption of Resolution #42 declaring the official results of the Election. The motion was seconded by Commissioner Skillman and adopted by the affirmative votes of all five commissioners present.
