Dubendorff, Heaton, Smith ~c Hertwig. 4Nr1R4.E5 T=Ir.~ Senior, r7a.nager of Florida Power &~ Light Co. , was ~~resent to discuss the proposed franchise to that company. Immediately following calling of the roll, T4iayor Totterdale ar- rived and took theE::chair and the meeting proceeded with the full commission in attendance. COmm. Dubendorff r:~oved that Ordinance ~10J~ be brought up for fur- ther consideration. Said ordinance had been placed on first reading P:ay $, 1950. Comm. Hertwig seconded the motion which was passed by affirmative votes of all five commissioners present. Senior for the company explained . the several provisions of the franchise. Comm. Dubendorff moved that Ordinance ;;'101 just read, having 'peen passed on its first reading P~;ay $ 1950, no:~r be passed and adopted as read. Comm. IIert~~rig seconded the motion and it was passed by affirmative votes of Gomm. Dubendorff, Heaton, Smith, Totterdale and Hertt~rig. George S. Brockway presented to the commission a certificate of final acceptance on the eater Works. By unanimous agreement the commission decided to refer this and the final construction est- imate to the ToUm Attorney for his comment. P~Ir. Brocl~~ay agreed with the commission that the sum of J~,500.00 be set as his total fee for the engineering services rendered in connection with the Toti~rn Water Works. `ihe clerk reported receipt of letter from theBoard of County Com- missioners of Palm Beach County, enclosing County s^Trrant to the amount of :25$.00, representing one half of th~± General Road & Bridge District millage levy for 19~9~ and intended for repair, maintenance and upkeep of County roads. Comm. Herttrig explained tliat the major part of these funds had previously been allocated to provide an access road to and in the Town Water ~~Torks entering from U S Highway ~1. The clerk was directed to acknot~rle~ge the receipt of the warrant from the County Commissioners. The clerk advised that the notice of meeting of the commission as a Board of Equalization on Assessments, had been properly ex- ecuted and posted on the Town Bulletin Board as of June 7 1950, and as directed by the Commission at its meeting June 6, 950. Hertwig reported that,as directed at a previous r,~eetin~;, he had discussed with Attorney Byrd the aluestion of lia',~ility, at the Water Works and whether it would be advisable for the Town to be protected by insurance. FIe reported l~'tr. Byrd's opinion that as the T~Tater ~f~Torks were 100 feet in from U S Highway ~1, any per- son on the Water Works property ~dould obviously be trespassing and so would hardly be in a position to have any claim against the Town for anpthing that happened during a trespass. Comm. HertyTig reported that Attorney Byrd recommended that as an ad- ditional precaution it would be wise make a general T1postingt~ of the property .including the pressure tank. The Mayor named himself and Comm. Dubendorff a committee to carry out the posting thus recommended by Attorney Byrd. This was done with the unanimous approval of all five commmissioners present. On motion of Comm. Smith, seconded by Comm. Heaton and approved by affirmative votes of all five commissioners present, the meeting. was recessed to 10:00 A.
