`.t'he meeting was called to order at 7:4.5 P. Vii. by Mayor Totterdale.
Present were Comm. Dubendorff, Heaton, Smith, Totterdale Q~ Hertwig.
T~'inutes of the preceding meeting ti;rere read and approved on motion
of Comm. Dubendorff, seconded by Comm. Hertwig and affirmative
votes of all five Commissioners present.
The clerk presented copy of letter sent by ~~;r. C. Y. Byrd to~the
State Land Bureau, in effect supporting the Toznrn Resolution t~14.
about establishing title to the submerged lands. The expressions
contained in the letter were approved by the Commission and the
opinion was expressed that the letter might be very helpful.
Comm. Dubendorff presented Town Ordinance X105 which had been
dratrn by ri'o`5m Attorney Byrd in accordance with previous d5_scussions.

Comm. Hertti~rig moved that Ordinance X105 be placed on its first
• reading and read in full; Comm. Heaton seconded the motion and it
~,~ras passed by affirmative votes of Comm. Dubendorff, Heaton, Smith,
`iotterdale and ~?ertt~rig, v~rith no dissent. There upon said Ordin-
ance ;'105 was read in full.
The Treasurer advised. that in checking over the budget figures
he concluded that cash balances in the Toti°mts general fund .could
not possibly amount to more than ~1~000.00 earlier than T°Tovember
or December of this pear and that it would be unneccessary expense
to take out a;;5,000.00 bond this early. After considering the mat-
ter Comm. Dubendorff moved that the pending bond application be re-
duced to .?,000:00 at this time and increased to ~~5,000.'00 on Nov-
ember lst. The RZotion t~ras seconded by Comm.' Smith and passed by
affirmative votes of all five commissioners present.
Mayor Totterdale reporting for the committee on zoning stated that
after a great deal of time and effort the committee ~~.rished to in-
troduce Zoning Ordinance #106 and have it considered .

After the complete reading of Ordinance x;106 its provisions
were discussed in detail. Comm. Hertwig stated his opinion that
the ~ areas of floor space rea_uired for single family dti~rellings
Urere excessive and that several homes in the Torn could not be
erected under the new Ordinance proposed. Comm. Dubendorff said
that the committee had given. much thought to this matter and that
the areas mentioned in the proposed lati~r t~rere very conservative
compared t^rith the requirements of other towns. Comm. Hertwig
stated that further study should be given to the matter of set
banks in the event of buildings of three stories or more.
After much discussion Comm. Hertwig moved that because of the
importance of the zoning question, Ordinance X106 be passed on
its first reading. The motion was seconded by Comm. Smith and
was passed by affirmative votes of Comm:' Dubendorff, Heaton,
Smith, Totterdale and Hertwig. There was no dissent.
There tjras general discussion concerning the schedule of estimated
revenues and disbursements for the coming fiscal year but the
matter eras tabled, by unanimous consent, for consideration at a
later meeting.
On motion of Comm.Heaton, seconded by Comm.Dubendorff and passed
by affirmative votes of all five commissioners present the meet-
ing was recessed until 7:30 P. IvI. on July 17, 1950.
