- 1 Minutes. Highland Beach Town Commission. May 7, 1963. The regular monthly meeting was called to order by Mayor Eypel at 7:30 p.m. on May ~, 1963. Also present were Comm~rs Jones, Noble and Turner and Town Manager Hartwig. Among those present in the audience were Dr. & Mrs. H. T. Dailey, Mrs& Mrs. D. F. Ross, Mr. and Mrs. H. G. Slagle, Mrs. Marguerite Staley, Mr. Marvin Kemeny and Attorney Paul E. Gringle. Comm. Bertash was absent. Minutes of the meetings of April 2, 1963 and April 9, 1963 were read and approved om motion of Comm. Turner, seconded by Coimn. Jones and the affirmative votes of Commt rs E"y~pel, Jones, Noble & Turner. The following letter from Town Clerk Commissioner Bertash was read; THE HIGHIANDS "O2901 So. Ocean Blvd May 5, 1963 Mayor Eypel & Commissioners Town of Highland Beach, Florida. Dear Sirs; A visit to Europe in the near future will necessitate my being away from the Highland Beach area for a three month period. Therefore, I am writing to offer my resignation from the City Clerk position and from the Board of Commissioners. I feel that this would be best since very important items are on Highland Beachts business agenda in the near future. I have enjoyed working with the officials and commissioners and am sure that they will continue to do an efficient fob. Sincerely yours, S/ Matthe~r. Bertash Comm. Noble moved that the resignation of Comm. Bertash be accepted with deep regret effective as of 7:30 p.m. this day, May 7, 1963... Comm. Jones seconded the motion which was then adopted by the af- firmative votes of Commtrs Eypel, Jones, Noble and Turner. To fill the vacancy created by the resignation of Comm. Bertash, Comm. Mayor Eypel then administered the oath of office to Comm. Beeman as follows; - I DO SOLEMNLY SWFAR (OR AFFIRM) THAT I WILL SUPPORT, DEFEND AND PROTECT THE CONSTITUTION AND GOVERNMEIT'I' OF THE UNITID STATES AND OF THE STATE OF FLORIDA AGAINST ALL ENEMIES, DOMESTIC OR FOREIGN, AND THAT I WILL BEAR TRUE FAITH, LOYALTY AND ALLEGIANCE TO THE SAME, AND THAT I AM ENTITLED TO HOLD OFFICE UNDER THE CONSTITUTION OF THE STATE OF FLORIDA AND THE CONSTITUTION OF THE UNITED STATES, AND THAT I WILL FAITHFULLY PERFORM ALL THE DUTIES OF THE OFFICE OF TOWN CLERK COMMISSIONER, ON WHICH I AM ABOUT TO ENTER, SO HELP ME GOD. Beeman then took his seat with the other commissioners and the business of the meeting was continued. ~~~~~ ~5 ~~.~, ~-~~,.~~.:. ;~.~.~ The Town Manager read a letter dated April 23, 1963 from the law firm of Dormer, Rosen & Mmfsky, on behalf of Patrick E, Inclema the owner of lots ~. to 8 inclusive in Highland Beach Isles. The letter requests an indefinite variance froffi the Zoning laws which would remove any limitation on height of buildings. After ae dis- cussion ©f the request, Comm. Noble moved that it be denied. The motion was seconded by Comm. Jones and adopted by the affirmative votes of Commis Beekman, E`ypel, Jones, Noble and Turner. The Town Manager read a letter dated May 3, 1963 from Frank Lawler City Manager for West Palm Beach, requesting attendance at a meet- ing to discuss participation at the coming Worlds Fair. By general agreement the Town commissioners r~~~ested the Town Manager to send their regrets and to state that this town would be willing to share participation cost at the Worldts Fair in proportion to population. The Town Manager read letter from Mr. Wm. Lamb, City Manager of Boca Raton, requesting support. of their efforts to establish a beach and park at Sabal Point on State Road AlA. For this purpose Resolution #120 was read and discussed and Comm. Turner moved its approval. Resolution X120 appears in full on the following page, page ~,, of these minutes. Beekman as a member of the Town Commission, a letter was presented and read by Attorney Paul Gringle relating to the pro- jected new Delray Beach White House Apartments. On behalf of a group$ of residents and taxpayers, Attorney Gringle read a copy of a letters dated April 29, 1963, addressed to Arnolt F. gurzinger as attorney For the said Delray Beach White House Apartments and Milton F. Steinhardt. Attorney Gringle. addressed the Commission at some length concern.. ing the question of whether the above mentioned apartment project could properly have access to the beach. ~- ~-- `' The letter above mentioned concerned a matter of deed restrictions but apparently no question of Town law or regulation was involved and no formal action was taken by the Commission.
