Minutes. Highland Beach ?own Commission. ~(ovember 7, 1961.
(a regular monthly meeting}
The meeting was called to order by Mayor Eypel at 7:30 p.m. on Novw
ember 7, 161. Also present were Commis Bertash, Jones, Noble and
Turner and Town Manager Hartwig.
In the audience were Mr. & Mrs. D. Tjart, Mr. Hm Mackie, Mr. Baker &
Mr. & Mrs. Frey and Mr. J. Bond Kinston.
Eleading of the minutes of the preceding meeting was deferred to a
later meeting by general agreement of all the commissionerst in order
that full consideration could be given to a projected new building
at Bellefonte apartments.
Thera was discussion about the application of Rm. T. Mackie for a
building permit for a four story apartment hotel at 3415 South tJcean
Blvd. ~[r. Mackie presented signed consent of most of the property
owners residing within 50D feet of the projected building, in an of
fort to overcome the Ordinance #1(~i6 ban against construction between
the dates of December 15 and April i5, as it was generally understood
by all parties that the proposed building could not be finished by
December 15th. Mr• J. Bond Kinston had withheld hismconsent and he
spoke in opposition to the granting of the permit. The matter was ar»
gued from all angles.
Mr. Mackie and his contractor associates left the meeting and the dis+»
cussion continued. Finally Mr. Nfinston stated that ha would withdraw
his objections if he could be .assured that the building would be comma
pletely enclosed and the disturbing part of the work completed by Jam-
uary 5th or 15th at the latest. On that basis the commission decided
to iA~rove is~a.ance of the permit under the following conditions;
(A) Construction of the building to be e~rpedited in every poss«
ible way so that the building shall be completely enclosed
by January 5th or 15th at the latest.
(B) Plans shall show a side yard, or setback, of 15 feat from the
south property line and the balconies shall not encroach on same.
(C) Plans shall show a 14 foot setback from the west property line..
(D) Parking spaces are to be nine feet wide.
(E) The permit will apply only to construction of the new building
west of the existing building.
(F) The foregoing conditions are to be considered part of the per«~
mit just as if they ware written into same.
Comm. Jones moved that, provided Mr. Mackie agreed to the above condi~-
tions, a building permit be issued for the new building in question.
The motion was seconded by Comm, Bartash and approved by the affirms
Live votes of Commis Bertash, Eypel, Jones, Moble and Turner. There

On motion of Comm. Noble, seconded by Co~mn. Jones and the affirmative
votes of Commfrs Bertash, Eypel, Jones, Koble and Turner, the Town
Manager was authorized and directed to pay the Rater Bonds interest
whi.-ch will be due December 1, 1961 and the quarterly payment of
X960.04 which will be due on December 15th on the contract for Defuse
removal.
The meeting was adjourned on motion of Comm. Jones, seconded by Comm.
Bertash and the affirmative votes of Comm~rs Bertash, Eypel, Jones,
Moble and Turner.
