1960.07.28_TC_Minutes(Minutes) Highland Beach Town Commission. June 7, 1960&June 28, 1960. on Jurc a h, ~q~o, The meeting was called to order~at 7:30 p,m. by Comm. Turner. In view of the fact that an earlier meeting had just been completed on June 6, 1960, it had bean agreed to recess this meeting for several weeks. No persens ware present other than Town l~ianager Hertwig so for lack of a quorum, Comm, Turner declared the meeting recessed until 7:30 p.m. on June 28 at which time it was believed all of the members of the Commission would be back in town. The recessed meeting of June ?, 1960 was called to order by Mayor Eypel at '7:30 p.m, on June 28, 1960. Also present were Comm~rs Jones, Noble and Turner and Town Manager Hertwig. Comm. Bertash was absent being out of t own. Minutes of the meeting of June 6, 1960 were read and approved on motion of Comm. Jones, seconded b9 Comm. Noble and the affirmative votes of Commtrs Jones, Eypel, Noble and Turner, There was no dissent. The Town Manager submitted a report dated June 23, 1960 relative to the projected revision of the Town zoning laws, and read a proposal from Mr. George F. Emery for making such revision. After discussion of the questions involved, Gomm. Turner moved that the Town Manager be authorized to arrange for the zoning revision to be done by Mr Emery in accordance with his proposal of June 22, 1960. The motion was se- conded by Comm. Jones and approved by the aff irmative votes of Comm~rs Eypel, Jones, Noble and Turner. There was no dissent. There was discussion-about the sketches for the proposed addition to Bellef ont Apartments, which had been tabled at an earlier meeting. Letters of objection to the project, dated June 24, 1960, from proper- ty owners M. S. Hamilton and J. Bond 1Vinston were read. The commissioners discussed said letters and examined the aerial survey of the Town which had been secured on the recommendation of Town Engineer George Brockway that it was the beat and only practical way to establish a safe and reasonable building line along the beach. The commissioners generally agreed that the wall around the swimming pool at Bellef onto was an improper and unauthorized obstruction on the beach and that itts removal or alteration should be required. It was generally agreed that na obstruction should be permitted beyond the vegetation line tivhich is generally accepted as the high tide line and that there should be some reasonable setback from that line for actual building construction. Comm. Noble moved that the matter of the proposed addition to Bellef onte Apartments remain tabled until the several matters under ctf~ =°~f~c con- sideration can be discussed with the owner, Mir. V~lm. P~Tackis, who is understood to be out of Town.The motion was second d by Comm. Turner and approved by affirmative votes of all four commissioners present. Comm. Noble requested passage of an ordinance which would establish a definite setback line for buildings on the ocean. June 28, 1960. FLORIDA . TOWN OF HIGHLAND BEACH, ORDINANCE 1,21 AN ORDINANCE ESTABLISHING MINIMUM FRONT AND REAR YARDS 8N LAND BETWEEN STATE ROAD AlA AND THE ATLANTIC OCEAN. The proposed ordinance was read in full. There was much dise~ssion as to the size of the Rear yard which should be required from the vege- tation line, some of the commissioners being of the opinion that it would be dangerous to all interests to get closed than fifty feet to it. However it was agreed that the fifty foot distance might be con- sidered excessive by some whereas the more conservative distance of thirty feet could hardly be questioned and should be established. The commissioners agreed that the thirty foot distance should be read into ordinance #121 for ~.a, rear yard 5 ,, After the reading of the above mentioned Ordinance ~-`121, Comm. Noble moved that- it be approved and adopted on its first reading. Comm. Jones seconded the motion which was approved by the affirmative votes of Commtrs Eyp el, Jones, Noble and Turner without dissent. The Town Manager submitted a report dated June 15, 1960 giving the final figures and details of the proposal to make the matter of garbage collection an official Town agreement instead of itTs present dubious status with individual property owners. Comm. Turner moved that the Town Manager be directed to have a suitable agreement drawn up and sub- matted for final approval of the Commission. The motion was seconded by Comm. Noble and approved by the affirmative votes of Commis Eypel, Jones, Noble and Turner. There was no dissent. Comm. Jones moved that the Town Manager be authorized to pay Vdilliam ' Bosworth, the sum of X250.00 for the aerial survey of the ocean front. The motion was seconded by Comm. Turner and approved by the affirmative votes of Comm~rs Eypel, Jones, Noble and Turner, without dissent. -The meeting was adjourned on motion of Comm. Turner, seconded by Comm.
