CALL TO ORDER Mayor Hillman called the meeting to order at 1:30 P.M. 2. PLEDGE OF ALLEGIANCE The Town Commission led the Pledge of Allegiance. 4. APPROVAL OF THE AGENDA MOTION: David/Moore - To approve the agenda as presented. The motion passed unanimously on a 4 to 0 vote. 5. PRESENTATIONS / PROCLAMATIONS A. Coastal Resilience Partnership: Climate Change Vulnerability Assessment Presentation (Collective Water Resources, LLC) Presentation Town Planner Allen introduced this item. She explained that Collective Water Resources, LLC were selected to complete the Climate Change Vulnerability Assessment. The goal of the assessment was and is to explore threats, assess vulnerabilities and risks. The results of the vulnerability assessment would be used to implement adaptation strategies to develop a region resilient to the impact of climate change. Ms. Allen spoke about a link on the Town's webpage related to the Coastal Resilience Partnership webpage which is part of Palm Beach County's website. She also spoke about the Town's public outreach Town Commission Meeting Minutes Date: June 15, 2021 Page 2 of 8 efforts advising the public about the climate change initiative as well as other educational components on this topic. Present was Ms. Elizabeth Perez, Professional Engineer with Collective Water Resources, LLC, and Dr. Alec Bogdanoff with Brizaga, Inc. Dr. Bogdanoff and Ms. Perez presented a PowerPoint presentation and overview of the Southeast Palm Beach County Climate Change Vulnerability Assessment. Dr. Bogdanoff offered to come up with a list of more tangible examples related to climate change impact as well as collaborate with Town staff on this matter. 6. PUBLIC COMMENTS Town Clerk Gaskins stated that no one preregistered for public comments. Ms. Diane Matthewman thanked the Town Commission for the bucket trees. 7. Ordinance No. 2021-008 (Second Reading) An Ordinance of the Town of Highland Beach, Florida, amending Chapter 2, "Administration," Article V, "Boards and Committees," Division 1, "Generally," of the Town Code of Ordinances by amending Section 2-99, "Procedure for Appointment and Filling of Vacancies; Qualification for Membership of Boards and Committees; Terms," to strike the language requiring a conditional resignation to serve on a second advisory board; providing for the repeal of all ordinances in conflict; providing for severability and codification; and providing an effective date. (First Reading was June 01, 2021). Mayor Hillman read Ordinance No. 2021-008 title into the record. Town Clerk Gaskins stated that this was a Public Hearing and there were no public comments for this item. MOTION: David/Moore - To adopt Ordinance No. 2021-008. Upon roll call, Ordinance No. 2021-008 passed unanimously on a 5 to 0 vote. B. Ordinance No. 2021-009 / Amending the Town Code of Ordinances to Adopt a New Chapter 34, "Fire Rescue (Second Reading) An Ordinance of the Town of Highland Beach, Florida, amending the Town Code of Ordinances to adopt a New Chapter 34, "Fire Rescue;" providing for the creation of a Fire Rescue Department and the department's function and composition; providing for the appointment of a Fire Chief; providing for severability and codification; and providing an effective date. (First Reading was June 01, 2021) Mayor Hillman read Ordinance No. 2021-009 title into the record. Mayor Hillman called for public comments. Town Clerk Gaskins stated that there were no public comments for this item. MOTION: David/Moore - To adopt Ordinance No. 2021-009. None. 11. NEW BUSINESS A. Consideration and discussion on the Annual Budget Projection for Fire Rescue Services and the First Amendment to the Interlocal Service Agreement between the Town of Highland Beach and the City of Delray Beach. Mayor Hillman read Item 11.A. title into the record. Town Manager Labadie presented this item. His recommendation to the Town Commission was to deny this matter consistent with their last action and request that the City of Delray Beach recalculate their budget pursuant to the contract. He has confirmed with Town Attorney Torcivia that the City of Delray Beach cannot unilaterally change the contract provision. MOTION: David/Gossett-Seidman — To respond to the City of Delray Beach that the Town of Highland Beach does not accept the addition of more new firefighters and that the Town of Highland Beach would ask to have the City of Delray Beach proposed budget changed to reflect that. Upon roll call, Item 11.A. passed unanimously on a 5 to 0 vote. Town Attorney Torcivia explained in case either side decides to declare a breach, there is a procedure for a breach which is a one-year notice as of October 1, 2021. B. Resolution No. 2021-013 A Resolution of the Town Commission of the Town of Highland Beach, Florida, ratifying the selection, appointments, and term of office of members of the Natural Resources Preservation Advisory Board; and providing for an effective date. Mayor Hillman read Resolution No. 2021-013 title into the record. There was discussion about how to move forward with appointing an applicant that had not been vetted by the chairperson of a different town board, and applicant Joshua Davison not being eligible for appointment at the moment. Town Commission discussed reappointing Ms. Diane Matthewman and Ms. Nievecita Maraj. Town Attorney Torcivia explained that two members cannot serve on quasi-judicial boards such as the Board of Adjustment of Appeals Board, Code Enforcement Board, or the Planning Board. Ms. Chappelear voiced her interest to serve on the Natural Resources Preservation Advisory Board and spoke about her educational and professional experiences. MOTION: David/Shoemaker - To approve Resolution No. 2021-013 appointing Nievecita Maraj, Diane Matthewman, Margarita Chappelear, Virginia Eastwood-Egan, and Leonard Brenner to Natural Resources Preservation Advisory Board. Resolution No. 2021-013 passed unanimously on a 5 to 0 vote. C. Resolution No. 2021-014 A Resolution of the Town Commission of the Town of Highland Beach, Florida, ratifying the selection, appointments, and term of office of members of the Financial Advisory Board; and providing for an effective date. Mayor Hillman introduced Item 11 .C. The Town Commission interviewed applicants Mr. David Goldberg, Mr. Peter Weiner (virtually) and Mr. Mitchell Pakler (virtually). Mr. Goldberg, Mr. Weiner, and Mr. Pakler voiced their interest to serve on the Financial Advisory Board and spoke about their professional experiences. MOTION: David/Moore - To approve Resolution No. 2021-014 appointing Richard Greenwald, Ronald Reame, David Goldberg, Peter Weiner, and Mitchell Pakler to the Financial Advisory Board. Resolution No. 2021-014 passed unanimously on a 5 to 0 vote. D. Resolution No. 2021-015 A Resolution of the Town Commission of the Town of Highland Beach, Florida, ratifying the selection, appointments, and term of office of members of the Board of Adjustment and Appeals Board; and providing for an effective date. MOTION: David/Shoemaker - To approve Resolution No. 2021-015 reappointing Bonnie Pikkel and Eve Rosen to the Board of Adjustment and Appeals Board. Resolution No. 2021-017 A Resolution of the Town Commission of the Town of Highland Beach, Florida, ratifying the selection, appointments, and term of office of members of the Planning Board; and providing for an effective date. Resolution No. 2021-018 A Resolution of the Town Commission of the Town of Highland Beach, Florida, terminating a State of Local Emergency within the Town of Highland Beach; providing an effective date and for other purposes. Approval of Commission Meeting Minutes March 16, 2021, Town Commission Minutes March 22, 2021, Town Commission Special Minutes Mayor Hillman read Item 11.H. title into the record. MOTION: David/Shoemaker — To approve the March 16, 2021, and March 22, 2021 , Town Commission Minutes with the corrections as noted. The Meeting Minutes passed unanimously on a 5 to 0 vote. TOWN COMMISSION COMMENTS Commissioner John Shoemaker spoke about enhancing the Town's website as it relates to the Veterans webpage. He asked Town Manager Labadie about obtaining input some from the Marketing Consultant about this matter. Commissioner Evalyn David had no comments. Commissioner Peggy Gossett-Seidman commented about the following: • Attended the Florida League of Cities meeting for Transportation Intergovernmental Relations in Orlando last week and matters discussed were the roads, infrastructure, and future possible issues with sea-level rise and the environments. • Spoke about the League pushing more beyond the $600 million that is available in grants. U.S. Senator Rick Scott's office contacted her and provided information related to state and federal funding and she is looking into this matter. • New building codes that need to be tweaked and House Bill 401 concerning implementing design standards. • There is a push by Environmental Groups on electronic vehicles and seaside communities without infrastructure to install electronic vehicle charging stations. • Drones are not lawful within five miles or under 400 feet of airports. Vice Mayor Natasha Moore mentioned that she heard from two concerned residents about the water bills. Both residents had significant water usages which caused an increase in their water bills. She mentioned that the message to residents should include an estimate of how their tax bill will be reduced next year. She also spoke about an accident that she witnessed involving a bicyclist and a vehicle on A1A across the street from Highland Beach Fire Station. She commented about her efforts to get assistance from the Delray Beach Fire Rescue by ringing the bell at the station and it took about ten minutes for the firefighters to respond. She expressed her concerns about the unacceptable response time for the firefighters in the Highland Beach Fire Station. Chief Hartmann is looking into this matter. Lastly, she commended the police officers for their responsiveness regarding this incident. Mayor Douglas Hillman spoke about the crosswalk lighting related to the down lights. He suggested Town Manager Labadie to move forward with the down lights. 13. TOWN ATTORNEY'S REPORT Town Attorney Torcivia had no comments. 14. TOWN MANAGER'S REPORT Town Manager Labadie reported the following: • He recently met with Florida Power & Light (FP&L). They have made a commitment to prioritize and pay attention to Highland Beach as well as acknowledged that there Town Commission Meeting Minutes Date: June 15, 2021 Page 8 of 8 are some lights out in the community. Florida Power & Light will be replacing the burned-out lights. Also, electric bills will be increasing in the near future. • Code Enforcement has mailed letters to those residents with obstructed streetlights giving them the opportunity to trim the trees. • Reminder about the upcoming Florida League of Cities Annual Conference and open registration. • There will be an item on the July 13 Town Commission agenda to appoint a voting delegate for Florida League of Cities. • PACE Advertising is helping with the educational campaign to educate the voters about the Fire and Rescue project. Town Manager Labadie is working on updating the implementation plan, updating the colors and additional progresses. • Will be meeting with the Forensic Accountant on Thursday. • Mr. Glen Joseph will be coming aboard as an advisor to help the Town recruit a fire chief and provide technical assist with implementing the Fire and Rescue Department. • He will work with Town Attorney Torcivia to draft a contract for Mr. Joseph. Thereafter, he will setup one on one meetings with each Commissioner to meet with Mr. Joseph. • Working to obtain the COCPN process and observing the County's EMS ordinance. • Preliminary Budget process in progress. Highland Beach is in great shape to take the Fire and Rescue services. Highland Beach is financially strong and there is no impact to our net position. Town Attorney Torcivia spoke about the Palm Beach County Commissioners approving a COCPN application today for Health Department after the ordinance was changed. 15.
