Highland Beach, Florida 33487 1. CALL TO ORDER Mayor Hillman called the meeting to order at 1:30 P.M. 2. PLEDGE OF ALLEGIANCE The Town Commission led the Pledge of Allegiance. 4. APPROVAL OF THE AGENDA Commissioner Gossett-Seidman added a "Discussion regarding recognizing Graduates of all levels" to the agenda as Item 11J. under New Business. MOTION: David/Moore - To approve the agenda as amended. The motion passed unanimously on a 5 to 0 vote. 5. PRESENTATIONS / PROCLAMATIONS A. Hurricane Season Presentation - Chief Hartmann Chief of Police Craig Hartmann spoke about the 2021 Hurricane Season and encouraged the residents to sign up for the CodeRED notifications. Ordinance No. 2021-006 / Amending Section 30-66 "Other requirements" and Section 30-68 "Supplemental district regulations" of the Zoning Code (Chapter 30) (Second Reading) An Ordinance of the Town of Highland Beach, Florida, amending Section 30-66 "Other Requirements" and Section 30-68 "Supplemental District Regulations" of the Town Code of Ordinances to modify certain encroachments into setbacks for properties abutting a waterway, canal, or lake; providing for the repeal of all ordinances in conflict; providing for severability and codification; and providing an effective date. Upon roll call, Ordinance No. 2021-006 passed unanimously on a 5 to 0 vote. B. Ordinance No. 2021-007 / Amendment to the Zoning Code (Chapter 30) (Second Reading) An Ordinance of the Town of Highland Beach, Florida, amending Chapter 30 "Zoning Code" of the Town Code of Ordinances in order to correct several scrivener's errors and to eliminate obsolete provisions pertaining to Public Notice and Vertical Datum; providing for severability and codification; and providing an effective date. (First Reading was May 18, 2021). Mayor Hillman read Ordinance No. 2021-007 title into the record. MOTION: David/Moore - To approve (adopt) Ordinance No. 2021-007 as presented. Upon roll call, Ordinance No. 2021-007 passed unanimously on a 5 to 0 vote. C. Proposed Ordinance / Amending Chapter 2, Section 2-99 of the Town Code of Ordinances An Ordinance of the Town of Highland Beach, Florida, amending Chapter 2, "Administration," Article V, "Boards and Committees," Division 1, "Generally," of the Town Code of Ordinances by amending Section 2-99, "Procedure for Appointment and Filling of Vacancies; Qualification for Membership of Boards and Committees; Terms," to strike the language requiring a conditional resignation to serve on a second advisory board; providing for the repeal of all ordinances in conflict; providing for severability and codification; and providing an effective date. Mayor Hillman read the Proposed Ordinance title into the record. MOTION: David/Hillman - To approve the Proposed Ordinance as presented. The Proposed Ordinance passed unanimously on a 5 to 0 vote. D. Proposed Ordinance / Amending the Town Code of Ordinances to Adopt a New Chapter 34, "Fire Rescue An Ordinance of the Town of Highland Beach, Florida, amending the Town Code of Ordinances to adopt a New Chapter 34, "Fire Rescue;" providing for the creation of a Fire Rescue Department and the department's function and composition; providing for the appointment of a Fire Chief; providing for severability and codification; and providing an effective date. Resolution No. 2021-010 / Budget Amendment A Resolution of the Town Commission of the Town of Highland Beach, Florida, amending Resolution No. 20-017, which appropriated funds for the 2020-2021 Fiscal Year Budget, and providing an effective date. Mayor Hillman read Resolution No. 2021-010 title into the record. MOTION: David/Moore - To approve Resolution No. 2021-010. Resolution No. 2021-010 passed unanimously on a 5 to 0 vote. B. Resolution No. 2021-011 / Budget Amendment A Resolution of the Town Commission of the Town of Highland Beach, Florida, amending Resolution No. 20-017, which appropriated funds for the 2020-2021 Fiscal Year Budget, and providing an effective date. Mayor Hillman read Resolution No. 2021-011 title into the record. MOTION: David/Moore - To approve Resolution No. 2021-011. Resolution No. 2021-011 passed unanimously on a 5 to 0 vote. C. Approve and authorize the Mayor to execute a five-year contract agreement with AXON Enterprise, Inc. in the amount of $197,000.00 for the purchase of body cameras, in-car cameras, LPR cameras, docking stations, mounts, redaction assistant, battery packs, automated activation feature, licensing, and warranty for the Police Department. Approval to cancel the July 06, 2021, Town Commission Meeting. Mayor Hillman read Item 11.E. title into the record. Town Manager Labadie presented this item. MOTION: Shoemaker/David - To cancel the July 6, 2021 , (Town Commission) meeting and instead move it to July 13, 2021 , (Town Commission Special meeting). Item 11.E. passed unanimously on a 5 to 0 vote. F. Construction Codes/Property Line Runoff and Code Issues. Commissioner Gossett-Seidman Mayor Hillman read Item 11.F. title into the record. Commissioner Gossett-Seidman presented this item. She displayed a photograph of a property elevation line and a video of water streaming onto a property next door to a newly elevated home. She expressed concerns with regards to water from gutters and roof lines draining onto side property lines causing a flow of materials to affect neighboring properties. Town Manager Labadie explained that the Town requires a structural as well as a site engineer review by the Town's Plan Reviewers to make sure that the site drainage and grades are appropriately incorporated in the plans. Building Official Jeffrey Remas explained for the past two years the Town has required site engineering plans from a civil engineer that draws in and maintains all of the drainage from the roof and nonpermeable surfaces on a lot/site. He also mentioned that the Building Department and/or Code Enforcement have not received any formal complaints about cross contamination or runoffs. Approve and authorize the Town Manager to execute Task Order No. 21 with Baxter and Woodman, Inc. for construction management services for the three- year gravity sewer main rehabilitation and repair project. Approve and authorize the Mayor to execute a Proposal with Shenandoah Construction, Inc., using the cooperative bid contract of Broward College, in the amount of $55,840.00, to complete Phase II of the sewer cleaning, inspecting, and televising of all gravity sewer lines on the side streets for any deficiencies of the Town's Sewer System. Approval of Commission Meeting Minutes March 02, 2021, Town Commission Minutes March 11 , 2021, Town Commission Special Meeting/Swearing in Ceremony of Newly Elected Officials MOTION: David/Moore - To approve the March 02, 2021 , Town Commission Minutes and March 11, 2021 , Town Commission Special Meeting Minutes as presented. Discussion to recognize graduates of all levels in the Highland Beach Commissioner Gossett-Seidman. Mayor Hillman read Item 11.J. title into the record. Commissioner Gossett-Seidman presented this item and proposed continuation of congratulatory letters to Highland Beach graduates. It was the recommendation of the Town Commission for the Town Manager's Office to send congratulatory letters to graduates in the community. 12. TOWN COMMISSION COMMENTS Commissioner Shoemaker spoke about an article in the Committee to Save Highland Beach Newsletter written by Mr. John Ross, highlighting the Veteran Heroes of Highland Beach project and the Town Commission's initiatives. Commissioner David spoke about the Town's opportunity to do feel-good projects such as recognizing graduates and talking to veterans in the community. It makes the community a more cohesive environment and promotes better neighbors. She also spoke about the positive feedback she received from residents in her building who are 100% supportive of the Town Commission creating its own Fire-Rescue Department. Vice Mayor Natasha Moore stated she would like to volunteer to spearhead and start the "Create Fund Balance Guidelines & Financial Benchmarking Process" project. Commissioner Gossett-Seidman mentioned that last week, she was inducted as a board member for the Palm Beach League of Cities. She spoke about many kudos and support that she received from various Commissioner/Council members throughout Palm Beach County for the Town's courage to establish its own Fire-Rescue Department. She mentioned Florida State Representative Michael Caruso (District 89) contacted the Vice President of Florida Power & Light (FPL) about the issues with the power lines, lights, and trees. A local representative will be meeting with Public Works Director Pasquale Roman and Town Manager Marshall Labadie in the near future to step up the attention to the Town. Also, she learned that Chief of Police has data related to the street lighting in town. Mayor Douglas Hillman had no comments. 13. TOWN ATTORNEY'S REPORT Town Attorney Torcivia had nothing to report. TOWN MANAGER'S REPORT Town Manager Labadie reported the following: • That he emailed the Town Commission information about the preliminary estimate on the tax value. He also asked the Palm Beach County Property Appraiser's Office for more information about the 2.81% property tax increase related to the matter. He said that in 2020, the Town did not issue any certificate of occupancy and that in 2021, the Town will see a significant number of new construction projects on the tax roll. • This budget year maybe a little more challenging. There is not much revenue coming in this year and that because of the water rate adjustments, some of the debt millage is dropping off. • Charter Review Board: Residents are encouraged to provide comments and feedback. He inserted two items on the list of recommendations for review. • The Fire-Rescue Implementation process is moving forward. 15. ADJOURNMENT The meeting was adjourned at 3:35 P.M.
