The recessed meeting of June 16 1959 was called to order at 9:f}4 p.m. by Mayor Eypel,.following an ixit'oraal discussion between members of the eommissi0n and Mr. Charley ~. Thrner ~oneerning the question of selling part of the Town ~iraterworks tract. A].ao present were Comxtrs Bertaah and Hob1e and Town Mgr. Hartwig. Commtra Breekinridge and ~3astoa were absent, being out of town. B~ general agreement it was decided to defer reading cad, approval of ninutea of the meeting of dune 2, 1959 and June 9, 1959. This ffieeting wan a continuation of the regular monthly meeting of dyes 2, 1959, which was recessed from tre®k to week so that appropriate ac- tion could be taken,when proper, oa natters concerning the Bel Lido aubdivisioa. June 18, 1959 The Town Commission in meeting 5/5/59 passed a motion that ~sub3eet to inspection by the Town ~sgineer, permission be granted to the Highland Beach Development Corporation, to proceed Kith the placing of the asphaltic surface on the roads in Bel Lido. The inspection was made on 5/7/59 and wherever tes~ld the rock base was found to be thicker than regvared but when a check was made of grades, come discrepancies were apparent. This made it necessary to have a survey crew check the grades. This was done on 5/8/59 and many discrepancies were found. Also it was disclosed that the devel- opment company was working to a revised set of grades which were lower than those agreed upon. The developerts engineers claim that the revised grades were approved by the Town engineer bnt there is no record of such approval and the Town Tngineerfaso stated in a letter dated 5/14/59. The Town Manager had no knowledge of-the prop®sed change until the condition was dis- closed by the-survey party on 5/8/59. T Concern3,ng the disputed matter of approval, reference is made to sev- eral letters between engineers for the Town and those for the devel- oper. And settlement of the disputed question has been delayed part- ly because the involved ersoaell of"the Town ~agineers have been away from town. On 6/29 Mr. Willie of Ziake-Smith and the writer met with qtr. Demery at the Brce]cway office, but after reviewing the several letters decided that the questions in dispute could-only be settled by Mr. Qeorge S. Brockway who was still out of town.. On June 15, 1959 the writer met with Mr. George S Brockway and Mr. emery and Mr. Brockway reiterated that there is no evidence to 3us- tify any change from Mr. Oemeryts letter of 5/14/59. The Town Commission must now decide what is to be done about the grades in Bel Lido. Reference is made to several drawings which show the grades as approved, the developers revisions; and the grades now ex- isting as found by the survey party on 5/8/59. The lower grades may permit more frequentl flooding and may affect septic tank efficiency. The Commissioners reviewed the letters and drawings which are referred to in the Town ~danager*e report preceding this page and they discussed all phases of the natter of the Bel Lid© grades, Mayor Eypel stated that before leaping town, 9iceml~ayor Brecginrldge had discussed the aub~ect with him and gave as his opinion that-the Town should be very cautious about accepting Tower grades than those agreed upon. It was the consensus of the commissioners that the lower grades could cause much trouble. Accordingly Comffi, l~oble roved that-the Town Attorney be directed to advise the developers of Bel Lido that the Town will not give its consent or approval fer the placing of the asphaltic concrete surface until the grades are corrected. The motion was seconded by Comm. Bertash and approved by the Affirmative votes of Commtrs Bertash, Eypel and Noble without dissent. There was general discussion of operational problems at the water works but no formal action was needed at this time.. Comae.
