Minutes. Highland Beach Town Commission. November 3, 1959. Recessed by agreement to November 10, 1959. On November 3, 1959 the meeting was called to order by Mayor Eypel at 7:30 p.m.. Except for Town Mgr Hertwig no one was present as it had been agreed to postpone the meeting for one week. Lacking a quorum, Mayor Eypel declared the meeting recessed until November 10, 1959 at 7:30 p.m. On November 10, 1959, Mayor Eypel called the meeting to order at 7;30 p.m.. Also present were Gomm'rs Breckenridge, and Noble and Town Mgr. Hertwig. Commfrs Bertash and Winston were absent. Town Mgr. Hertwig read a summary of actions taken at the preceding meeting held October 20, 1959 but as the detailed minutes were not completed their approval was necessarily deferred by agreement. Town of Highland Beach, Florida Dear Arthur, It has become increasingly evident that my other inter ests have made it impossible for me to give Town matters the time and attention they should haee. Therefore it is with regret that I have come to the conclusion that I should resign from the Town Commission. Please consider this as my formal resignation as an official of the Town and as a member of the Town Commission, effective immediately. It was always a pleasure to work with the members of the Town Com- mission and I shall always be glad to be of any possible service in the future. Sincerely yours, Signed J. Winston found it necessary to resign but that 3~ apparently there was nothing to be done about it. Comm. Breckenridge then moved that the resignation of J. Bond Winston be accepted, effective s of November 1, 1959. The motion was seconded by Comm. Noble anc~pproved by the affirma- tive votes of Commis Breckenridge, Eypel & Noble, without dissent. Comm. Breckenridge then moved passage of Resolution #87 designating and naming G. Arthur Jones to be a member of the Town Commission to fill the vacancy caused by the resignation of J. Bond Winston. Comm. Noble seconded the motion which was then approved by the affirmative notes of Comm~rs Breckenridge, Eypel and Noble, without dissent. ARTHIIR JONES as Town Commissioner to fill the vacancy caused by the resignation of J. Bond Winston. Whereas, owing to the resignation of J. Bond Winston, there is a vacancy on the Town Commission; And whereas it is the duty of the remaining members. of the Town Commission to fill such vacancy; Now therefore be it resolved by the Town Commission of the Town of Highland Beach, Florida, that G. Arthur Jones be, and he hereby is, named, designated and elected to .the office of Town Commissioner, to serve until the next General Election in the said Town of Highland Beach. The Title reads; TOWN OF HIGHLAND BEACH, FLORIDA. ORDINANCE N0. 120 AN ORDINANCE AMENDING TOWN ORDINANCE #101 BY REPEALING SECTION 6 OF THE CHAPTER ON TAXATION AND FINANCE. Ordinance # 120 was then read in full and discussed. Comm. Brecken- ridge moved that it be passed on its first reading. Comm. Noble seconded the motion and it was approved by the affirmative votes of Commis Breckenridge, Eypel, Jones and Noble. Ther~was no dissent. The Mayor Presented and read letter Prom Carter-Jebb, Inc. dated October 28, 1959,making an appraisal of X7,000.00 per acre for that part of the Water Works Tract which the Town is selling to the devel- opers of Boca Harbor at a price of approximately X8,000.00 per acre. An application was read from Wm. Mackie for a permit to construct a patio and swimmiing pool at Bellefont Apartments 3415 So. Ocean Blvd. The situation is unusual as it might seem the location is part of the regular beach. Mr. Mackey states that both the reef outcrop and the connecting beach are above mean high tide and properly usable by him as his property and in his application he accepts full responsi» bility for the correctness that such is the-case. The matter is fur- ther complicated by the fact that Mr. Mackie wishes to use as a fil- ter house a concrete shelter erected by the former owner of the pro- perty. Said shelter is not only poorly constru ted but was built without knowledge or permission of any Town off3~~.als. Furthermore it is almost on the property line and thus infringes on the ten foot side yard requirement of Zoning Ordinance #106. By general agreement the Commission instructed the Town Manager to issue the permit pro- vided the filter shelter was made to comply with the proper setback provisions concerning the north property line. On motion of Comm. Breckenridge, seconded by Comm. Noble and the. affirmative votes of Commis Breckenridge, Eypel, Jones and Noble, the Town Manager was authorized and directed to arrange payment through the Chase lianhattan Bank of the interest due December 1, on the Town dater Bonds. There was no dissent. The Town Manager advised that an audit was in process which would complete the checkup of Town accounts for the last two years right uP to the close of the recent fiscal year which ended on October 31, 1959. The meeting was ad3ourned on motion of Comm. Noble,~~seconded by Comm.
