Minutes. Highland Beach Town Commission. (A regular monthly meeting) The meeting was called to order by Mayor E~ December 1, 1959. No other. members of the so for lack of a quorum the Mayor declared 7:30 p.m. on December 15, 1959. Also present were Comm~rs Bertash, Jones and Noble and Town Mgr Hertwig. Comm. Breckenridge was absent. Minutes of the meeting of October 20, 1959 were read and approved on motion of Comm. Noble, seconded by Comm. Bertash and the affirm- ative votes of Comm~rs Bertash, Eypel, Jones and Noble without dissent. Minutes of the meeting of November 10, 1959 were read and approved on motion of Comm. Noble, seconded by Comm. Jones and the affirmative votes of Commis Bertash, Eypel, Jones and Noble. There was no dissent. Town Mgr. Hartwig reported a request from Mr. dim. Mackie for a devia- tion of one foot from the ten foot side yard requirement in rebuild- ing the filter shelter at Bellefont Apartments. The matter was dis- cussed and Comm.. Jones moved the the deviation be allowed. Comm. Ber- task seconded the motion and it was approved by the affirmative votes of Commtrs Bertash, Eypal, Jones and Noble without dissent. The Town Manager read prepared Resolution #88 which authorizes the waiving of a bond in connection with sale of land to Morris H. Laz- arus. Comm. Bertash moved that Resolution #88 be approved. Comm. Noble seconded the motion and it was approved by the affirmative votes of Comm~rs Bertash, Eypel, Jones and Noble, without dissent. The Res- olution #88 appears in full on page 2 of these minutes. The Town Manager proceeded to read Ordinance #119 the title of vahich is as follows; TOtrtIN OF HIGHLAND BEACH, FLORIDA. ORDINANCE I19 AN ORDINANCE GRANTING A FRANCHISE FOR THE COLLECTION, REMOVAL, & DISPOSAL OF GARBAGE, TRASH & WASTE WITHIN THE TOWN LIMITS OF THE TOWN OF HIGHLAND BEACH, FLORIDA. Ordinance #119 had itts first reading on October 20, 1959 and was posted on the Town Bulletin Board on that same date, at which time it was approved by vote of the Town Commission. After some further consideration and discussion, Comm. Noble moved that Ordinance #119, without change, be approved and adop- ted on its second reading. The motion was seconded by Comm. Ber- tash and approved by the affirmative votes of Commtrs Bertash, Eypel, Jones and Noble. There was no dissent. The Town Manager proceeded to read Ordinance X120, the title of which is as follows; TOWN OF HIGHLAND BEACH, FLORIDA. ORDINANCE 120 AN ORDINANCE AMENDING TOWN ORDINANCE QE #101 BY REPEALING SECTION 6 OF THE CHAPTER ON TAXATION AND FINANCE. Ordinance #120 had its first reading on November 10, 1959, at which time it was approved by vote of the Town Commission and it was posted on the Town Bulletin Board on that same date. Comm. Noble moved that Ordinance #120 be passed and adopted on this it's second reading,without amendment. The motion for passage was seconded by Comm. Bertash and it was approved by the affirmative votes of Comm~rs Bertash, Eypel, Jones and Noble, without dissent. The Town Manager requested approval of payment of the following non-routine expenditures; to Howard Lee Cromer, Inc. X251.12 for repairs and maintenance of the water system; to B. B. Boldt,~10.00 for work around water valve in Steinbach driveway; to Gedney, Johnston & Lilienthal, X433.50 for legal services and costs in sale of land to Morris H. Lazarus; to J. P. Carroll, Inc., 195.19 for repairs to right-angle drive at Water Works. Comm. Jones moved that the items as read be approved for payment, after the Town Manager had explained the details of the several invoices. Comm. Highland Beach Town Commission. 12/15/59. There was discussion about the need of a third person to repre- sent the Town as a director of the Resources Development Board of Palm Beach County, the Town at present being represented by Comm, Mildred S. Noble and Comm. G. Arthur Jones. Comm. Jones stated that he had discussed the matter with b'Ir. VVm i~ackey of the Bellefonte Apartments and Mr. Mackey said he was willing to serve the Town in this capacity. Town iUlanager Hertwig stated that he also had discussed the subject with Mr. Mackey and felt that Mr. Mackey would attend the meetings of the Resources Board and would do the Town credit. Comm. Bertash moved that dim. Mackey be appointed to represent the Town as its third director. Comm. Jones seconded the motion and it was approved by the affirmative votes of Commtrs Bertash, Eypel, Jones and Noble. There was no dissent. The meeting was adjourned on motion of Comm.
