Minutes. Highland Beach Town Cc+mndissioa. February 4, 1958 Recessed to February 18, 1958. ~~ The meet waa called to order at 7;30 ing p.m. on February 4, 1958 by B~ayor Eypel. No other members of the Commiaaian were present as it been agreed to postpone the seating for tw© weeks, and ao for lack of a quorum Mayor Eypel declared the meeting receaeed to 7;30 p.m. on February 18, 1958. The receaaed meeting was called to order at 7:30 p.m. on February 18, 1958 by Mayor Lypel. Also present were Comm~rs Breckinridge, Eypel, Noble do Xinstos. Coma. Bertaah waa absent. The first two pages of the ainutes of 1/14/58 were read and approved on aotion of Comm. Breckinridge, seconded by Comm. Noble sad the af- firmative v®tea of Commas Breckinridge, Eppel, Noble de Winston. There was diacuaaion about the development of the S/D called Highland Beach Isles, the owners ha®img presented a revised plat and improve- ment plena, which have been approved by the Town Engineer, and an a- greement to complete the improvements, which has been approved by the Town Attorney. In lieu of a perfarmance bond the owners presented a check for $12,000.00 with the pledge of an additional X5,000.00 to be put up within 60 days after approvel and recording of the plat said awma to beheld by the Tows as a guarantee for completion of the improvements. After thorough diacnsaion it was generally believed that theca arrangemsnta were satisfactory and Comm. Breckinridge moved that the Ysyor be authorised to approve the Plat of Highland Beach Islas. The motion was aecaonded by Comm. Noble and approved by the affirmative votes of Coma. Breckinridge, Eypel, Noble and Winston, with no dissent. The Town Manager presented and read proposed Ordinance #ll6 the title of which is as follows: TOWN OF HIGHLAND BEACH. ORDINANCE N0. 116. AN ORDINANCE AMENDING ZONING ORDINANCE #106 BY RESCINDING THE PARTS OF THAT ORDINANCE WHICH PROHIBITED ANY ALTERATION. OR AMENDIi~ENT OF .SAID ORDINANCE _EXCEPT DURING THE ~[ONTH:~ OF DECE~R, JANQARY, FEBRUARY OR MARCH. THB merit of the ordinance had been decided at an earlier meeting and after it waa read Coma. Noble coved that it be passed on its first reading. The motion was seconded by Comm. Breckinridge and approved by the affirmative votes`®Y Coam~ra Breckinridge, E'pel, Noble and Winstemt with no dissent. The Town Manager presented and read Reaoln.tion #79 authorizing the iaanance of a building permit for Highland Towers Cooperative Apart- menta as decided at an earlier meeting. Coma. Breakinridge moved that the res®ltitti®n be approved. Coma. Winston seconded the motion sad it waa approved by the affirmative votes of Conm~~ra Breckinridge, Eypsl, Noble and Winston, with no dissent. Highland Beach Town Commission. 2/18/58. A request was presented from Rmth C©nstruction Cespany for a permit t© finish the inside of a 2nd storW addition on the residence of T. Sendzimir. Mr Roth assured the Commissioners that the work would be done with a minimum of noise and would not cause annoyance to the guests of Dream House adjoining on the Ndrth. Mr. R. S. Carter, of Dream House was present and said he had no ob3ection to the work being done if reasonable quiet was maintained. Comm. Breck- ir~ridge moved that the Town Manager be authorised to issue a permit qualified along the lines as mentioned above. The motion wan second- ed by Caam<. Noble and adopted by the affirmative votes. Qf Ccamm+rs Breckinridge,~ Eypel, Noble & Winston, with no dissent. There was a request f®r a building permit for Jamaica Manor, a siu- teen unit cooperative apartment. Owner ~c builder, Warren D. Reiff presented the written consent of A. Bethmann that the work be allow- ed to proceed at this time. After some discussion Comm. Breekinridge mmoved that the Town Manager be authorized to issue the permit if the plans were in order. The Moti©n was seconded by Cosnn. Winston and passed by the affirmative votes of Comm+rs Brecakinridge, Eypel, Noble and Winston, with no dissent.(Cost of Sob approx. X132,000.00. The Town Manager was requested to call omm Mr. Rarl Sost and sea that he applied for permits. and licenses when doing work on the small units on his plot. These units are non-conforming to the Tows Zon- ing laws and their life should not be extended, but from time to time Mr. Rost has taken advantage of our lack of enforcement and carried out extensive repairs and improvements by the siffiple expedient of failing to ask for a permit and getting the work done before it is noticed. ~+Ir. Robert K. Carter requested consideration o$ the question of fire insurance rates which he said. are being raised. There •as a long dis- cussion including the question of whether we could make some arrange- with Delray or Boca Raton to come into our Town if an emergency should arise. The consensus was that a recent law in Delray would prevent any cooperation with that city but that an arrangement with Boca Raton might be a possibility if the cost could be met. Mr. Garter said that he was trying to get a statement from the Insurance rating bureau as to what they would require in order to reduce rates. There was no formal action in the matter. Mr. Carter also reported that he was suffering much annoyance from dogs running at large and committing offensive nuisances on his pro- perty. After a general discussion the Town Manager was requested to prepare an ordinance to control the licensing of dogs and to make it illegal for dogs to be permitted to run at large in the Town. The Town Manager was requested t® write and inquire how this could be done with the present b®ttlenecks in Gulf ;3trea~n eta. The meeting was adjourned on motion of Ccu~m.
