Minutes. Highland Beach Town Commission. March 25, 1958. Recessed Fromm March 4= 1958. The meeting was called to order at 9;45~by~layor Eypel, Also pre- sent were Commm~rs Breckinridge and Winston and the Town Manager. Commtrs Bertash and Hoble were absent. By special request Towm Attorney Lilienthal was present as were leasers Wmm. Ziske, Donald Smith, 8usss1l Thompson, Carl Warner and others, being mostly persons interested in the development and imm- provement ®f the subdivision tne~-n as Highland Beach Isles. linutes of the meeting ®t January 14, 1958 were read and appr®ved on motion ®f Comm. Ainston, seconded by Commm, Breckinridge and the affirmative votes of Commm~rs Breckinridge, Typal and Winston, without dissent. Then by general agreement the usual order of business waa deferred in order to take up pressing matters about the Highland Beach Isles subdivision. Zinke-Smith Inc, presented a lettes~rlated larch 25, 1958 requesting that the Town accept an attached subdivision bond in place of the sum mP Twelve Thousand Dollars in cash which the Town holds as a guaranty for aompletion of the improvements in the subdivision o2' Highland Beach Isles. With the letter was the Bond which was offered as a substitution, and a number of related papers. It was conceded by all that the Town waa under no obligation to make the proposed arrangements butt was simply being asked to do so in orddr to ease a series of finansial problems encountered by the several parties interested in the devel®pmment of the subdiv iai0n referred te. Zinke-Smith Inc. agreed to waive their lien rights, if the mortgage holder agreed not to fore•~ close, and also agreed to proceed and complete imiprovementa to the development and to put such commmittmments in writing. The Commission directed the Town lanager,to request the Town Bngineer for ~n inspec- tion and report on the condition of the development, and to present the information to the ~[ayor as soon as possible. {minutes continued on page 2) ~~ ~~~ ~ ,~M ~ • ~~~- (Page 2) Minutes. The matter of whether we should make financial reports to some higher - state agency was referred to the Town Attorney and he said he would make inquiry and advise the Town ~[anager what he learned. AA ORDINANCE AMEI~DINt3 ZONING ORDINANCE X146 BY RESCINDING THE PARTS OF THAT ORDINANCE WHICH PROHIBITBD ANY AL~ERATiON OR AMENDMENT OF SAID ORDINANCE EXCEPT DTTI~ING THE MONTHS OF DECEMBER, JANIIARY, FEBRIIARY OR MARCH. The-Town Manager then read Ordinance #116 in full on its second read- ing. After the reading Comm. Breckinridge moved that Ordinance X116 be approved as read without change. Comm. Winston seconded the motion and it was adopted by the affirmative votes of Commtrs Breckinridge, Eypel and Winston, without dissent. There was a possibility that a quick report might be obtainable,from the Town Engineer, concerning the Conditions at the Highland Beach Isles subdivision and so it was agreed to recess the. meeting two days until Thursday, March 27. Accordingly Comm. Winston moved that the meeting be recessed until ~:30 A.ffi. on Marsh 27, 1958. The motion was seconded by Cow. Breckinridge and approved by the affirmative votes of Commtrs Breakinridge, Eypel and Winston, with no dissent. The rep©rt of the Town Engineer could not be readied in time for the appointed reseas on Larch 27, 1958, Accord3.agly the meeting was not held, automatically ad~ournina the meeting sine die.
