Zwick called the meeting to order at 9:30 a.m. Deputy Town Clerk Jane Dillon called the roll. In attendance were Chair Miriam S. Zwick, Vice-Chair John L. Papera, John J. Pagliaro, Dean H. Luce, Sydel Frohlich, Martin Sahn and Anderew M. Guglielmo. Town Attorney Larry Corman, Building Official Bob Dawson and members of the general public were also present. APPROVAL OF MINUTES Upon MOTION by MR. PAPERA/MR. PAGLIARO, the Minutes of the July 16, 2003 Quarterly Meeting and the September 4, 2003 Special Meeting. OLD BUSINESS Luxury Development Corp. • 3200 S. Ocean Blvd. Citation No. 03-14 Deputy Town Clerk swore in all who would be testifying at today's meeting. Building Official Bob Dawson stated that as of last friday, a crew was beginning to dismantle the sales trailer which is now in two halves. Tom Weaver, site superintendent stated that OSHA approved caps have been placed on all the rebars on site. Attorney Alex Heckler noted the following: all rebars capped; garbage removed from site; lawn has been mowed; sales flag removed; and the trailer is in the process of being removed. Photographs were presented to the Board that show plastic caps had been placed on rebars. Mr. Papera stated that he was not satisfied that the rebars were just capped, and not somehow enclosed. Mr. Sahn suggested a type of wood box could enclose the pilings. Mr. Dawson noted that the pilings are higher now then they will eventually need to be, and could be brought down to grade which would leave enough extra height for building purposes. He also noted that where the rebar enters the cement piling, water could run down into the piling and rust the rebar, possibly weakening it. Upon MOTION by MR. PAPERA/MR. PAGLIARO, no such proposal was made and a fine should be imposed. Attorney Corman asked the Board to be fair to the developer, • in that they did in fact come in with a proposal (capping) and already made the correction. Mr. Papera withdrew his motion. • Code Enforcement Quarterly Meeting October 15. 2002 Page 2 of 2 After further discussion, the following MOTION was made by MR. PAPERA/MR. PAGLIARO: Owner of property shall within 35 days, make a proposal to the Code Enforcement Board as to the cause of action they propose to take to insure rebars and pilings are rendered safe to the public. If they don't come before the Board with a proposal acceptable to the Board, a fine of $250 per day will be attached. Capping of rebars/pilings pursuant to OSHA standards is not acceptable to the Code Enforcement Board in terms of their compliance with code. The Code Enforcement Board wants an engineers report as to the viability of the existing rebar to evaluate whether or not ordering its removal will in fact harm the owners of the property. If owner can't obtain a report on time, they may come back to the Board and ask for an extension. MOTION met with unanimous approval. After further discussion, the following MOTION was made by MR. PAPERA/SAHN: • A fine of $250/day shall be imposed as of the date property was to have been cleared of the sales trailer (Sept. 20, 2003). MOTION met with unanimous vote. A Special Meeting was scheduled for December 3 at 9:30 a.m. to address the piling/rebar proposal. ADJOURNMENT With no further business to come before the Board, MOTION to adjourn was made by MRS.
