CODE ENFORCEMENT BOARD
SPECIAL MEETING
December 3 2003 9:30 a.m.
Chair Miriam Zwick called the meeting to order in Commission Chambers at 9:30
a.m. Also in attendance were John Papera, Dean Luce, John Pagliaro, Sydel
Frohlich, Martin Sahn and Andrew Guglielmo. Attorney Larry Corman and
Building Official Bob Dawson were present as well a members of the general
public.
This meeting was called to hear the following code enforcement violation:

Re: Violation of Chapter 30-68(m), Temporary Structures and Chapter 17-3,
Nuisances, of the Code of Ordinances of the Town of Highland Beach, FL for
property located at 3200 South Ocean Blvd.
Deputy Town Clerk swore in any member of the public who would be testifying.
On October 15, 2003 the Cade Enforcement Board entered an Order requiring
that Paul G. Roiff shall be fined $250 per calendar day commencing September
21, 2003 through the date trailer is removed from site, and shall within thirty-Five
(35) business days of October 15, 2003 bring a proposal to the Board to ensure
that the pilings and rebar are rendered safe to the public with an engineers report
as to the viability of the existing pilings and rebar. A fine of $250 would be
imposed if this was not received by December 3, 2003.
Attorney Alex Heckler spoke before the Board, noting that the sales trailer had
been removed from the site October 25, 2003, infom~ing the Board Clerk in
writing. A proposal pertaining to rebars was presented to the Board including an
engineers report (attached hereto and made a part of these minutes.)
After lengthy discussion, the Board made MOTION by Mrs. ZWICK -
MR.PAPERA to accept the following conditions:

1. Lock pedestrian gate on central portion of west fence line to further control
site access.
2. Place plastic caps on all rebars. Langan Engineering will provide a report
to establish height to which rebars can be cut while retaining utility for
development of the project. The rebars will be cut to the height
recommended by Langan Engineering.
3. Remove the surficial loose impediments to limit tripping hazard.
4. Remove the railing on the wood walkway leading to the pedestrian gate
(between the gate and to about 5 feet west of the west fence line) -railing
could be used to jump over the fence with more ease.
5. Change blue tarp covering to green tarp covering. Add green #arp
covering along the small portion of the east fence line which is not
presently covered (at northernmost eastern corner of the fence), as well
as to the north and south fence lines to limit visibility from the street,
sidewalk and adjoining properties.
6. Add "Private PropertylNo Trespassing" signs along the perimeter chain-
linkfence.
7. The property shalt be maintained and kept in a clean condition as required
by Town Code.
• Luxury Development shall notify the Code Enforcement Board in writing by
January 1, 2004 that all the above conditions have been met.
Upon Motion by MR. PAPERA/MR. PAGLIARO, the Code Enforcement Board
waives all fines incurred as of September 21, 2003 when the sales trailer was to
have been removed, through October 25, 2003 when the trailer was officially off
the site.
The Code Enforcement Board recommended and requested that Paul G. Roiff
plant landscaping in front of fence fronting A1A in order to soften the look of the
fence.
With no further business to come before the Board, MOTION to adjourn was
made by MRS. ZWICK/MR. LUCE AT 11:00 a.m.

• Introduction
At the request of Luxury. Developers ("Client"}, Langan Engineering and Environmental Services, Inc.
(Langan) pertormed a site visit to make observations regarding the site safety of the existing site
conditions and to evaluate potentiaE improvements to site safety. The site is located at 3200 South Ocean
Boulevard in the Town of Highland Beach, Palm Beach County, Florida. The proposed construction covers
most of the site and the structure has a footprint of approximately 175 ft x tb3 ft. The site is bounded to
the east by South Ocean Boulevard, to the west by an overgrown mangrove, and to the north and south by
mid-rise apartment buildings. The Intracoastal Waterway is located west of the overgrown mangrove.
Site Visit Observations
A site visit was performed by Langan on 25 November 2003. The site was observed to include two main
areas. The first area was a grass covered area with the reinforcement of the previously constructed
augercast piles extending above the- existing ground surface. The second area was located at the
northeast corner of the site and was unfenced. No augercast piles were observed within the second area_
A 6 ft high chain-link fence was observed around the perimeter of the first area. The fence along the
South Ocean Boulevard side of the site was observed to be almost cornpletety covered by a blue tarp which
obstructs the view into the property. The south, north and west chain link fence lines were not covered.
Two gates were observed on the chain-link fence. The main vehicular gate was observed near the south
east corner, and was locked. The second gate was a pedestrian gate near the center of the west fence
Line_ This gate was observed to be unlocked (this gate was reportedly unlocked to provide us access to the
site).
The augercast pile reinforcing steel rebars observed throughout the first area were almost completely
covered by plastic rebar caps. Most of the rebars were observed to extend between 'fi ft and 5 ft a!>ove

• the ground surface. In addition, some surficiat loose impediments and objects were observed throughout
the site, which included groutlconcrete fragments, PYC pipes, extra plastic rebar caps, wood panels
(among others).
Comments on Existing Site Conditions
After the pedestrian gate is re-locked, the site conditions are considered to be reasonably safe. Access to
the site is difficult, with the only means of access to the augercast pile reinforcement area being by
force/trespassing. The fence surrounding the pile reinforcement area does not have the bar across the top
of the fence, The absence of the top bar decreases the rigidity of the fence and makes the fence harder
to climb. in addition, the absence of the top bar limits the amount of push aclimber/trespasser can get
off of the fence.
Even though the pedestrian gate was not locked at the time of the site visit, access to this gate was very
difficult. The wood walkway leading to the gate was accessible by boat from the Intracoastal Waterway,
and from the south fence line by walking along a narrow strip {1 to 2 ft wide) between the fence and the
overgrown mangrove swamp.
Although the existing site conditions are considered to be reasonably safe, Luxury Developers, LLC
requested that we provide recommendations to make the site even safer. The following summarizes the
additional recommended safety measures.
Additional Site Safety Recommendations
The following is a list of recommendations on how to further improve the safety of the site:
1. Lock pedestrian gate on central portion of west fence tine to further contra[ site access;

3. Remove the surficial loose impediments to limit tripping hazard;
4. Remove the railing on the wood walkway leading to the pedestrian gate (between the gate
and to about 5 feet west of the west fence tine) -railing could be used to jump over the
fence with more ease;

within a distance of 10 feet from the perimeter cyclone fence line to eliminate rebar
puncture threat should someone jump over the fence -the tabors at these locations should
be burnt off to a height of about 24 inches above the existing ground surface to Limit the
height of the wood boxes.

Reference: Engineering Report Concerning the Viability of the Existing Piling and Reber
Azure Hlghland Beach

Dear Members of the Code Enforcement Board,
As requested, Intercounty Laboratories lnc. (1L) has completed testing and observations of the exposed reinforcing
steel for the augercast piles of the about referenced project. The propose of these testing and observations was to
evaluate the existing condition with respect to loss of cross sectional area due to corrosion and determine the viability
of the existing piles. The testing and observations were performed on Novcmbrrr 26, 2003 and the findings are as
follows:
The reinforcing steel had bcrn exposed to the environment for approzimatcly 2 years and some rust is visible on the
exposed surfaces.
The exposed reinforcing steel consisted of #6 and #9 bars. Diameter measurements were performed at random
locations on raprascnta[ive steel bars, In addition, five representative samples of each baa size were obtained for unit
weight verification,
Based on the results of the f-eld observations and laboratory unit weight verification, [[. found no significant loss in
diameter or unit weight of the reinforcing steel. These results comply with the requirements of the American Soeiery
of Testing Materials (ASTM A-615), which states, "the permissible variation shall not exceed 6% under nominal
weight". Therefore, the existing piling and rcbar at the property can be used for the development of the project.
However, prior to placing the pile caps and grade beams the steel should be pressure washed under the supervision of
an 1L's representative. AdditionaE treatment to the steel such as sand blasting and/or acid wash should also be
performed if required by the engineer of record.
