1. CALL TO ORDER
Mayor Hillman called the meeting to order at 1.30 P.M

The Town Commission lead the Pledge of Allegiance.
4. APPROVAL OF THE AGENDA
MOTION: David/Gossett-Seidman - To accept the agenda as presented.
The motion passed unanimously 5 to 0.
5. PRESENTATIONS / PROCLAMATIONS
A. None.
6. PUBLIC COMMENTS
Mayor Hillman called for public comments. Town Clerk Gaskins mentioned that Joshua
Davison is participating on Zoom, and he has five minutes to speak.
Mr. Joshua Davison joined virtually. He spoke about the lack of progress over the past
five months as it relates to his condominium's built-out/expansion of the pool deck that
abuts up against the seawall on Russell Drive and his conversation with Town Planner

Allen regarding this matter. He wanted to know if there was a process to expedite this
matter.
Town Manager Labadie explained that this matter was part of the marine accessory
structures component that Mr. Greg Babij, along with Town Planner Allen, and the Town's
Marine Consultant are currently reviewing. They are also reviewing a number of
ordinance components as it relates to rear yard setback and the other associated
ordinance elements concerning marine accessory structures. He also explained that
there is no expedited process to move Mr. Davison's project.
Mayor Hillman asked that Mr. Greg Babij's presentation be on the next Town Commission
agenda. He also asked if there was anything that could be done specifically for Mr.
Davison's situation. Town Manager Labadie explained that there was nothing that could
be done in the interim.
There were no more public comments.
7. ANNOUNCEMENTS
Mayor Hillman read the announcements as follows:
A. Board Vacancies
1. Board of Adjustment & Appeals Board - Two vacancies, and one upcoming
reappointment: all for three-year terms
Code Enforcement Board - One vacancy for a three-year term
Financial Advisory Board - Two vacancies, one upcoming vacancy, and one
reappointment; all for three-year terms
Planning Board - One vacancy for an unexpired term ending April 30, 2022, and one
upcoming reappointment for a three-year term
Natural Resources Preservation Advisory Board — One vacancy, three upcoming
vacancies, and one upcoming reappointment; all are for three-year terms
Mayor Hillman asked why are the upcoming board "reappointments" announced on the
agenda? Town Clerk Gaskins explained the reason for announcing board
reappointments. Mayor Hillman recommended to announce a board reappointment only
when it becomes a vacancy. The Town Commission agreed with the recommendation.

A. Continued discussion of the Highland Beach Fire Feasibility Study
Mayor Hillman provided an update related to the below:
Town's 30-year history with the City of Delray Beach Fire and Rescue,
the increasing contract costs impacting the Town's operating budget includes the cost
to send a rescue truck to a 911 call in Delray Beach,
acceleration of the costs due to Delray's unfunded or low funded pension program,
there newly approved union contract, and additional personnel on each truck.
He explained the Town hired a consulting firm to evaluate the fire and rescue operations.
The consultant was asked to review the following: compare the performance of Delray
Beach Fire and Rescue against the contract with our, compare the financials that have
been invoiced to Highland Beach against the existing contract, and look at alternatives
for the Town of Highland Beach. Mayor Hillman discussed the subsequent findings
identified in the Fire Feasibility Study 1) the number of trips made from the Highland
Beach Fire Stations to Delray Beach over the last three years, and 2) less costly
alternatives the town could do on its own from the Highland Beach Fire Station for an
annual saving of better than two million dollars a year. He mentioned that he provided
the report to Delray Beach Fire Chief Tomey, his two assistants and also invited them to
sit in on Highland Beach presentation at a commission meeting. Mayor Hillman than
spoke about his meeting with Mayor Shelly Petrolia of the City of Delray Beach regarding
the fire and rescue performance and service.
Additionally, Mayor Hillman talked about the Town receiving confirmation that it would
have mutual aid and the Town had confirmed that it will be able to get licensing from both
Palm Beach County and the state.
There were discussions about sending a cancellation notice to the City of Delray Beach
immediately, the inconsistencies in the financial information from the City of Delray Beach
that would require a forensic auditor to evaluate the information, as well as the two primary

ways to terminate the interlocal agreement with the City of Delray Beach and grounds to
terminate based on a breach.
MOTION: David/Gossett-Seidman - To direct Town Manager Labadie to send a letter
of termination.
Upon roll call, the motion passed on a 5 to 0.
Mayor Hillman called for a ten-minute recess at 2:13 P.M. The meeting reconvened at
2:25 P.M.
B. Continued discussion on Commission Salary - Commissioner Peggy Gossett -
Seidman
Commissioner Gossett -Seidman provided the Town Commission with a handout on the
salaries of the elected officials in Miami -Dade, Broward, and Palm Beach counties and
spoke about the data related to the various salaries. Discussion followed about the
various salaries, and the proposed 20% increase for Highland Beach Mayor and
Commissioners.
11. NEW BUSINESS
A. Consideration of ordinance modification for residency requirements for serving
on quasi-judicial and advisory boards.
Town Manager Labadie presented this item. He explained the ordinance modification will
allow the Town Commission the ability to appoint up to two individuals who are tax paying
property owners in Highland Beach who are not domiciled or registered voters of Highland
Beach to serve on advisory boards that has no quasi-judicial authority.
It was the consensus of the Town Commission to proceed with the proposed ordinance
as a first reading for the May 4 agenda.
B. Resolution No. 2021-04 / Establishing a Charter Review Board
A Resolution of the Town Commission of the Town of Highland Beach, Florida,
establishing a Charter Review Board to review, recommend, and submit proposed
amendments to the Town charter; providing for the composition, objective,
meetings, and assistance; appointing five board members; and providing for an
effective date.
Mayor Hillman read Resolution No. 2021-004 title into the record.
Town Manager Labadie introduced this item. The Town Commission nominated the
following residents to serve as a member on the Charter Review Board.

MOTION: David/Gossett-Seidman - To approve Resolution No. 2021-004 appointing
the five members to the Charter Review Board.
Upon roll call, the Resolution No. 2021-004 passed on a 5 to 0 vote.
C. Approval to Purchase One 2021 Ford Police Explore Hybrid Vehicle from Bartow
Ford in an amount of $38,471.94 and approval for the installation of the
emergency police equipment in the amount of $12,444.00 for the Police
Department.
Mayor Hillman read Item 11 C into the record.
Town Manager Labadie presented this item and explained budgeted in discretionary
sales tax (penny surplus sales tax fund) was the roof which came in less than expected
so there are extra dollars. He mentioned that he would be recommending a budget
amendment at the next Town Commission meeting.
MOTION: Shoemaker/David - To approve Item 11 C.
The motion passed unanimously 5 to 0.
D. Approval of Commission Meeting Minutes
February 16, 2021 - Commission Meeting Minutes
Mayor Hillman read Item 11 D title into the record.
Mayor Hillman asked Town Manager Labadie to send the Town Commission an update
on the bucket trees and to list the condominiums participating with the bucket trees.
MOTION: David/Gossett-Seidman - To accept the February 16, 2021, Commission
Meeting minutes, as corrected.

12. TOWN COMMISSION COMMENTS
Commissioner John Shoemaker commented about the following:
• Completion of seven interviews and are finishing up a few more interviews with several
Highland Beach veterans.
• Town's webpage for Veteran Heroes of Highland Beach is in progress.
• Town's Shredding event and the turnout
• The quality, excellence, and performance of the Delray Beach fire-fighters, EMS, and
paramedics. His respect and appreciation for the first responders. He saluted the
fire-fighters and paramedics of the Delray Beach and thanked them for their efforts.
Commissioner Peggy Gossett -Seidman echoed Commissioner Shoemaker's comments
about saluting the fire-fighters. She also presented a report on the following:
B. Update on the Legislative Actions/League of Cities
Received a text from Florida State Senator Tina Polsky (District 29) about a discussion
with Secretary of the Florida Department of Transportation Kevin Thibault, and three
staff members, Florida State Senator Tina Polsky (District 29) and her assistant
concerning the accidents along A1A. She spoke about their 25-minute Zoom meeting
related to the failed referendum, the failed streetscape, the dangers the Town faces
with flooding, lack of proper crossing throughout Town, and shallow puddle ponding.
Mr. Thibault is committed to getting the Southeast Florida office step up to see if they
can address this. In the event the appropriations not going through and getting this
done sooner than the RRR project.
Met a Vice President of Florida Power & Light who has leeway the Legislators and
they spoke about internet service in Highland Beach, streetlights, and invasive
species.
Legislative Session: Spoke about bills related to Vacation Rentals, Home -Based
Business, and Wastewater Discharges.
Commissioner Evalyn David echoed Commissioner Shoemaker's comments about the
fire-fighters. She thanked Commissioner Shoemaker for following up with the Highland
Beach veterans. She inquired about registrations for Airbnb's. Town Manager Labadie
will follow up with Building Official Jeffery Remas about the registrations for Airbnb's.
Lastly, she thanked her colleague for their hard work.
Vice Mayor Natasha Moore had no comments.
Mayor Douglas Hillman talked about the contract with City of Delray Beach Fire -Rescue.
He thanked his colleagues for their hard work. He mentioned that he received a letter
from Mr. John Bury and asked Commissioner Shoemaker to read the letter.
Commissioner Gossett -Seidman asked for an update on the entry signs. Mayor Hillman
explained that there was nothing at this point.

13. TOWN ATTORNEY'S REPORT
Town Attorney Torcivia had nothing to report.
14. TOWN MANAGER'S REPORT
Town Manager provided a report as follows:
• The Freedom of Religion Foundation's sent another letter to the Town concerning the
nativity scene and he will discuss this matter with Town Attorney Torcivia.
Town Clerk Gaskins thanked Deputy Town Clerk Beverly Wright and Administrative
Support Special Ganelle Thompson for spear -heading the Shredding Event on Saturday,
April 17. She stated that there was a great turnout, and the residents appreciated the
shredding event.
