Highland Beach, Florida 33487 1. CALL TO ORDER Mayor Hillman called the meeting to order at 1:35 P.M 2. APPROVAL OF THE AGENDA MOTION: David/Shoemaker - To approve the agenda as presented. The motion passed unanimously 5 to 0. 5. PRESENTATIONS / PROCLAMATIONS A. Randy Elliott Proclamation Mayor Hillman read the proclamation into the record and presented it to Mr. Randy Elliott. Town Commission Meeting Minutes Date: April 06, 2021 e2of8 6. PUBLIC COMMENTS Mayor Hillman called for public comments. Town Clerk Gaskins stated that there were no public comments. 7. ANNOUNCEMENTS Mayor Hillman read the announcements as follows: A. Board Vacancies Charter Review Board — Five vacancies for 120 days duration (May to August 2021) Board of Adjustment & Appeals Board - Two vacancies, and one upcoming reappointment: all for three-year terms. Code Enforcement Board - One vacancy for a three-year term Financial Advisory Board - Two vacancies, one upcoming vacancy, and one reappointment; all for three-year terms Planning Board - One vacancy for an unexpired term ending April 30, 2022, and one upcoming reappointment for a three-year term. Natural Resources Preservation Advisory Board — One vacancy, three upcoming vacancies, and one upcoming reappointment; all are for three-year terms. B. Meetings and Events 1. Ordinance No. 2021-004 / 10-Year Water Supply Work Plan (Second Reading) An Ordinance of the Town Commission of the Town of Highland Beach, Florida, adopting a 10-Year Water Supply Work Plan pursuant to Section 163.3177, Florida Statutes and amending the infrastructure (portable Water Sub element), Coastal Management Conservation and Capital Improvements Elements of the Town comprehensive plan as they relate to the 10-Year Water Supply Work Plan; providing for severability; providing for conflicts; and providing an effective date. (First Reading was January 19, 2021) Mayor Hillman read Item 8A into the record. Town Manager Labadie introduced the item. Town Planner Ingrid Allen provided comments about this item and explained that the Town received no comments from the South Florida Water Management District, the State Land Planning Agency, or the Department of Economic Opportunity on the proposed amendment. Ms. Julia Backlund of Global Tech explained the next modification to the water supply work plan would be ten years. However, if the South Florida Water Management District were to make any changes to their current water supply plan, then the Town will have to update its plan within 18 months of the South Florida Water Management District's modification. MOTION: David/Shoemaker - To approve (adopt) Ordinance No. 2021-004 on second read. Upon roll call, Ordinance No. 2021-004 passed on a 5 to 0 vote. Town Clerk Gaskins stated that there were no public comments for this item. 9. CONSENT AGENDA A. None. 10. UNFINISHED BUSINESS A. Continued discussion of the revised Ordinance regarding right-of-way (ROW) Mayor Hillman read Item 10A title into the record. There was discussion about the language in the revised ordinance related to newsracks and adding a reference to the ordinance on how to construct swales. Town Manager Labadie explained there are sections within the current revised ordinance that include language about newsracks. However, that language will be addressed on a secondary matter. As for adding language on how to construct swales, Town Manager Labadie Town Commission Meeting Minutes Date: April 06, 2021 Page 4 of 8 mentioned a reference could be added to the ordinance referring individuals to the Construction Site Management Handbook. He also mentioned adding the elements as an appendix in the Construction Site Management Handbook. He then talked about the revisions to the ordinance related to swales. Further discussion followed about prohibiting newsracks; the dome -shaped buttons, no more than four inches in height, with a diameter no greater than six inches, without metal or wood stakes; the process for a property owner to engage in constructing or installing new trees in the right-of-way and swale area without obtaining a permit; reviewing and cross referencing the State of Florida Department of Transportation codes related to utility easements; looking at the City of Boca Raton's regulations for swales; and utilities companies requesting approval from the town prior to digging in the right-of-way/swale areas. Town Planner Allen explained the intent of the current revised ordinance. She also looked at the City of Boca Raton's ordinance and referenced their language within the revised ordinance pertaining to what can be placed in a swale such as dome -shaped language and mailboxes. There was a suggestion to include a reference in the Town's ordinance that refer to the State of Florida Department of Transportation codes and also incorporate a list of prohibited trees and plants. It was the recommendation of the Town Commission for staff to make some additional changes to the ordinance and bring the item back to a future Town Commission meeting. B. Continued discussion of Highland Beach Fire Department Feasibility Study Town Manager Labadie presented this item. He explained that the Town Commission was not finished with its tasks and suggested to hold off until the April 20, 2021, Town Commission meeting. Mayor Hillman talked about his meeting with Mayor Shelly Petrolia of City of Delray Beach as it relates to the Town's concerns with the contract, costs, and the service provided by Delray Beach Fire and Rescue. Commissioner Gossett -Seidman spoke about the research she compiled on Indian River Shores Public Safety Department in Martin County, a combined police and fire service department and the City of Coconut Creek initiation to separate from the City of Margate to establish its own fire department. 1. Financial Advisory Board Recommendation Mayor Hillman presented this item and explained that the Financial Advisory Board recommendation was for the Town Commission to continue to work on the three alternatives related to Fire and Rescue and EMS services. Town Commission Meeting Minutes Date: April 06, 2021 Page 5 of 8 C. Update on Charter Review Board Vacancies Town Manager Labadie provided an update on the Charter Review Board vacancies. The Clerk's Office received five applications and prepared an article for the Coastal Star Newspaper extending the application deadline to April 14, 2021. Town Staff will prepare an agenda item for the April 20 Town Commission meeting for further discussion on how to proceed with this matter. D. Continued discussion on Board Membership and Residency Requirements Mayor Hillman introduced this item. Discussion followed about the residency requirements for board membership, expanding the definition of residency requirements to allow property owners, business owners, or renters within Highland Beach jurisdiction to participate on a non -quasi-judicial advisory board or committee, and including limitations that will allow no more than two non - domiciled residents to serve on an advisory board or committee. It was the recommendation of the Town Commission for Town Attorney Torcivia to research and define residency and bring the item back at the April 20 Town Commission meeting. E. Consideration of Financial Advisory Board Recommendation for Town Commission Salary Increase Mayor Hillman read Item 10E title into the record. Town Manager Labadie presented this item. Discussion followed regarding the Financial Advisory Board's recommendation to increase the Town Commission salary and establishing a process to increase the commission salary in the future. Commissioner Shoemaker and Vice Mayor Moore made a motion to approve the recommendation from the Financial Advisory Board for a 20% increase in the Town Commission and Mayor salaries. It was suggested to amend the motion and to put a policy in place to review the salaries once every ten years. Town Manager Labadie explained an ordinance is required to change the Town Commission salaries. Lastly, Town Attorney Torcivia asked whether the Commission thought about an annual increase of one, two or three percent or consider the consumer price index (CPI). AMENDED MOTION: Shoemaker/Moore - To accept the Financial Advisory Board recommendation for a 20% increase in the salaries of the Town Commission and institute a Consumer Price Index (CPI) increase for future years effective with the annual budget. Town Commission Meeting Minutes Date: April 06, 2021 Page 6 of 8 Upon roll call, the motion passed on a 5 to 0 vote. 11. NEW BUSINESS A. Discussion on fire hydrants and services on private streets. Commissioner Gossett -Seidman Mayor Hillman read Item 11A into the record. Commissioner Gossett -Seidman spoke about an email she received from the President of The Enclave Homeowner Association regarding an invoice and asking how many Associations had private fire hydrant. Mayor Hillman explained that this was not a matter for the Town Commission because it was an internal billing issue. B. Authorize and approve Commissioner Gossett -Seidman to participation as a League of City County Board Member Mayor Hillman read Item 11 B title into the record. Commissioner Gossett -Seidman presented this item. MOTION: David/Hillman — To allow the appointment of Commissioner Gossett - Seidman to the Board for Florida League of Cities. The motion passed unanimously 5 to 0. 12. TOWN COMMISSION REPORTS Commissioner John Shoemaker spoke about the following: • Meeting with Town Clerk Gaskins and Assistant to Town Manager Cuebas related to creating a webpage with Highland Beach veteran residents' information. Also, he has been collecting and creating content for the webpage. • Thanked Commissioner David for referring to the veterans in her newsletter. • His recent interview with former Comm issionerNice Mayor Mr. John Rand, and preparation of an article on Mr. Rand. Commissioner Evalyn David thanked Commissioner Shoemaker for his hard work. She mentioned the title "Heroes of Highland Beach" was a wonderful idea. Commissioner Peggy Gossett -Seidman presented a report on the following: A. Report on Tallahassee • Secretary of State Laurel Lee's explanation on the efforts made by the Florida Department of Justice in dealing with emailed threats against Florida voters that traced Town Commission Meeting Minutes Date: April 06, 2021 Page 7 of 8 back to Iran and they were able to sever them in time to ensure a valid election. When the COVID-19 pandemic hit, high quality masks were obtained from Taiwan. • Chief Financial Officer (CFO) of the Florida Jimmy Patronis discussion how last year's veto of one billion dollars in bills was a record and there is a chance that there will be another veto this year. • Florida Attorney General Ashley Moody discussion on the legal system and her top priority on maintaining safe communities throughout Florida. • Speaker of the Florida House of Representatives Chris Sprowls explained how the state is cracking down on internet piracy and the issues they found in Florida with ties to China. • Moffitt Cancer Center was harboring a government representative of China. A person who was obtaining information and transmitting it unlawfully back to China. • Visit Florida Chief Executive Officer Dana Young explained prior to the COVID-19 pandemic, the State of Florida had forty-seven million visitors in one year. This year the state is down twenty million dollars in visitors. For one dollar spent by a tourist in Florida, it saves one dollar in general in terms of wages earned, benefits, and having no state income tax. • Florida Governor Ron DeSantis spoke about the COVID-19 pandemic, the budget, and grants. • Met with Florida State Representative Michael Caruso (District 89) and Florida State Senator Tina Polsky (District 29) and they fully support the Town. • She spoke with Reporter John Kennedy of Gannet News Chain and he now files report for 18 newspapers. • US Highway 27 is named as "Purple Heart Highway" and the signage has not been installed by the Florida Department of Transportation. • Bills that may be moving in the direction of the Town includes drones capable of being used by police for public safety and security, sea level rise bill is moving quickly, wastewater discharge bill, home based business bill is not going well, and the Wayfair bill is moving along well. Vice Mayor Natasha Moore had no comments. Mayor Douglas Hillman met with Town Manager Labadie and Chris Leighton of Leighton Design Group concerning the work that will be done in front of Town Hall. They found a landscape architect and will be meeting on this Thursday. 13. TOWN ATTORNEY'S REPORT Town Attorney Torcivia had nothing to report. TOWN MANAGER'S REPORT Town Manager Labadie provided the following report: • Library Director Lois Albertson ordered Mr. Elliott's book which will be available in the library in a few weeks. • Managers Minutes/Highland Beach Communications: The Highlander Newsletter will be dropped; funding will be put towards mailing the Managers Minutes to the residents via the U.S. Postal Service. • Residents are encouraged to read the Executive Summary of the Fire and Rescue Feasibility Study. • The Public Information Request will be submitted to the City of Delray Beach Fire and Rescue Department. 15.
