Highland Beach, Florida 1. CALL TO ORDER Chairperson Burnich called the meeting to order at 2:00 P.M. 2. PRESENT UPON ROLL CALL Member Joel Leinson Member Bryan Perliman Member Michael Cherbini Member Jane Perlow (virtually) Member Myles Schlam Chairperson Thomas "Tim" Burnich Town Attorney Leonard Rubin Deputy Town Clerk Beverly Wright ADDITIONAL STAFF PRESENT Code Enforcement Officer Jason Manko 3. PLEDGE OF ALLEGIANCE The Code Enforcement Board led the Pledge of Allegiance. 4. APPROVAL OF THE AGENDA Chairperson Burnich asked the Board members if there were any additions or deletions to the agenda. Hearing none, he called for a motion to approve the agenda as presented, which resulted as follows: MOTION: Burnich/Perliman - Moved to accept Agenda Item 4, as presented. The motion passed on a 6 to 0 vote 5. SWEARING IN OF THE PUBLIC Deputy Town Clerk Wright sworn in those giving testimony. 6. January 12, 2021 Chairperson Burnich asked if there were any corrections to the January 12, 2021, Regular Meeting Minutes. Hearing none, he called for a motion to approve the minutes as presented, which resulted as follows: MOTION: Schlam/Cherbini — Moved to approve the Minutes of the January 12, 2021 meeting. The motion passed on a 6 to 0 vote 8. UNFINISHED BUSINESS There was no unfinished business. 9. NEW BUSINESS A. Case No. CC2021-01-011 David Kaufman Trust, David 1 3012 S. Ocean Blvd., #C Legal: Townhomes K/A Unit 33 AS IN OR4391 P846 PCN: 24-43-46-33-21-000-0330 Code Section: 30-122(a) - Building Permits Required Violation: Observed complete pool restoration without permit. Chairperson Burnich read item 9A into records and asked the Board if they had any Ex Parte communications to disclose in the matter? Hearing none, he opened the violation hearing and called for Code Enforcement Officer Manko to give testimony and recommendations regarding the violations. Code Enforcement Officer Manko provided testimony that on April 26, 2021, the above case was brought into compliance, a permit was issued and the case was closed. Case No. CC2021-01-003 Mikhail & Elena Vesselov 2564 S Ocean Blvd. Legal: Byrd Beach Sub IN PCN.- 24-43-46-28-09-000-0161 Code Section: 6-130 Maintenance: Seawall/Bulkhead and 6-29 Property Maintenance Code Violation: Observed dock/pilings in disrepair creating waterway hazard. Chairperson Burnich read item 9B into records and asked the Board if they had any Ex Parte communications to disclose in the matter? Hearing none, he opened the violation hearing and called for Code Enforcement Officer Manko to give testimony and recommendations regarding the violations. Code Enforcement Officer Manko presented a brief timeline for Case No. CC2021-01, which included submittal of evidence, proof of service, supporting documents, and photos taken of the property that fairly and accurately represented what was observed during his inspections on January 05, 2021 and on April 27, 2021. A Notice of Violation was sent to the owner listed on the Property Appraiser Public Access Tax Role. On April 01, 2021, service was obtained by posting at the property address and at Town Hall. As a result of this, the town is recommending 30 days to comply the violations at a cost of $250.00 per day and $250.00 for the cost of prosecution if the matter is not resolved within the 30 days. Chairperson Burnich asked the Board members if they had any questions of staff? Hearing none, he advised the offender to give testimony. Mr. Michael Carey, the Vice President of International Construction Associates gave testimony that his company was contracted to... (due to equipment failure, the audio is inaudible to transcribe). Chairperson Burnich entertained a motion to find that there is a violation of the code. However, dialogue began amongst the Board members and Code Enforcement Officer Manko regarding response, the number of inspections conducted and a granted extension that was given to the offender. Mr. Carey provided additional comment that the owners had not been nonresponsive, they had contacted Code Enforcement Officer Manko. He advised they had contracted for a Design Engineer and the design work had been done. He said a new survey was needed and it had been a little difficult to get consultants moving during this time. He said they had possession of the needed documentation to apply for a permit and that is where they are. Code Enforcement Board Meeting Minutes Page 4 of 4 April 27, 2021 Conversation arose about the site appearing hazardous, the exact date all the work will be completed, how long the permitting process will take, about demolition verses a construction/reconstruction permit and about the removal of the hazards (for more information about this item, please visit the Town's Media Archives & Minutes webpage to access and view the audio/video recording). Chairperson Burnich asked if there were any other comments? Hearing none, he asked the Board members if they were ready to proceed with a motion? MOTION: Leinson/Perliman - moved to approve 45 days from today (04.27.21) that the demolition work needs to be completed. Should it not be completed, a fine of$250.00 a day will begin, plus the administrative cost of$250.00 (the motion was clarified by Chairperson Burnich). The motion passed on a 6 to 0 vote 10.
