~-~iee-Chair John L. Papera called the meeting to order at 9:30 a.m. In attendance were
John J. Pagliaro, Martin Sahn and Frank Colarullo. Jack Halpern and Sydel Frohlich
were absent. Also in attendance was Town Attorney Larry Corman, Building Official Bob
Dawson and members of the public.
Case No. 2004-06 - Nathalie Barnes
Mr. Dawson noted that Ms. Barnes did not receive the notice of hearing in time to make
arrangements to attend the meeting. Mr. Blaskovich spoke on his behalf regarding the
issue.
MOTION was made by Mr. Sahn/Mr. Pagliaro, to grant a postponement to a Special
Meeting. Upon MOTION by Mr. Pagliaro/Mr. Sahn MOTION met with unanimous
approval.
• MOTION was made by Mr. Pagliaro/Mr. Sahn, to deny time accommodation for Ms.
Barnes for an afternoon meeting.
The date of December 15, 2004 at 9:00 a.m. was scheduled.
Case No. 2004-03 Marc Andrea Musa Holdings Ltd.
Recording Secretary swore in all who would be testifying. Mr. Dawson explained the
case being a timeshare issue. Mr. Musa is renting his property to a timeshare
corporation, who in turn is offering it as a timeshare. He noted how Mr. Musa received
proper notice of hearing, yet no one is here on his behalf.
Mr. Dawson asked Mr. Archie Stoltz to come to the podium for his position in this matter.
Mr. Stoltz noted that he is with Stoltz Management, the property management Company
for Byrd Beach Estates, residence address 401 N.E. Mizner Blvd., #T06. He noted that
re lot #8, Byrd Beach Estates, Marc Musa was a resident and put properly up for
sale/lease. Association did not know it was leased to a timeshare company,
Ambercrombie & Kent. Other residents noticed different people at the property weekly.
Elizabeth Suskind, 2629 Byrd Beach Estates testified that she saw people coming and
going from the property. John Caldwell, 2635 S. Ocean, testified that Mr. Musa told him
that he was renting the house through Abercrombie & Kent.
MOTION was made by Mr. Papera/Mrs. Colarullo that Marc Andrea Musa is in violation
• of Town Code prohibiting timeshare. Motion met with unanimous approval.

MOTION was made by Mr. Pagliaro/Mrs. Colarullo that Mr. Musa has ten (10) days to
cease timeshare from date of receipt of certified letter (Order attached hereto and made
a part of these minutes), with attached ordinance, or a fine of $250 per day will be
imposed. A copy of Order will be sent to Abercrombie & Kent.
ADJOURNMENT
With no further business to come before the Board, MOTION to adjourn was made by
MR. PAGLIARO/MR. SAHN at 10:45 a.m.
