TOWN OF HIGHLAND BEACH • CODE ENFORCEMENT BOARD SPECIAL MEETING Wednesday August 16. 2006 9:30 a.m. Chair John Pagliaro called the meeting to order at 9:30 a.m. Present were Chair Pagliaro, Vice-Chair Martin Sahn, Frank Colarullo, Jack Halpern, Eugene Diliberto, Louis Reidenberg and Paul Resnick. Town Attorney Larry Corman was present, as well as members of the general public. NEW BUSINESS Case No. 2006-02 Boca Cove Condominium Association, Inc. Lorenzo Sciortino, Registered Agent 4513 S. Ocean Blvd., #1 Highland Beach, FL 33487 Re: Violation of Chapter 6, Article III; Building Code (failure to obtain a Building. Permit) and Chapter 17-3 Nuisances (unsightly roof conditions) Recording Secretary swore in all who would be testifying. The following was discussed as to the issues at hand. • . Mr. Dawson noted that the building dept received application to demo part of the beach deck landing, but work cannot be done until after turtle season. . Roof repair -wood is rotted over the area where people walk underneath -safety issue. . abandoned equipment on roof is a nuisance issue. . roof needs to be repainted and cleaned up. Residents Nike Coffum and Rose Oraes both of 4511 S. Ocean Blvd., residents of the neighboring condo which looks down upon this property expressed their concerns. Additionally, correspondence was received from other residents which is attached hereto and made a part of these minutes. There was lengthy discussion regarding all the problems of this complex. Mr. Sciortino noted that he will remedy all issues and can do so within the 60 days. MOTION was made by MR. REIDENBERG/MR. COLARULLO as follows: APPLICANT HAS 60 DAYS FROM THIS DATE TO COMPLETE ALL NECESSARY REPAIRS TO THE ROOF AS DISCUSSED. MOTION was made by MR. REIDENBERG/MR. SAHN as follows: IF REPAIRS. HAVE NOT BEEN COMPLETED WITHIN THE 60 DAYS, A.FINE OF $100 PER DAY SHALL BE IMPOSED. Code Enforcement Board • August 16 2006 Page 2 of 2 Motion carried with Mr. Halpern abstaining due to conflict of interest (he lives at 4511 S. Ocean Blvd.) MOTION was made by MR. REIDENBERG/MR. SAHN as follows: THAT THE DECK REPAIRS BE COMPLETED 30 DAYS FROM NOVEMBER 1 (NOVEMBER 11) AND THAT A FINE OF $100 BE IMPOSED PER DAY THEREAFTER. Motion carried with Mr. Halpern abstaining. The Board's Order stating Findings of Fact, Conclusions of Law and Order is attached hereto and made a part of these minutes. These are in disgraceful condition, and not only are they an eyesore to interfere with the wonderful view we enjoy, they also affect the property values very negatively of those units facing that property. After years of pleading with the owners at 4513 for clean-up, without response, we trust the town will find a remedy. Eastern Standard Time From: NJBavaro To: AmbSouthCondo August 14, 2006 This letter relates to conditions of the roof top of 4513 South Ocean Blvd. which my apartment overlooks. My apartment is located on ~e 9th floor of 4511 South Ocean Blvd. The roof is in such bad condition. It has pockets of mildew, where rain has settled in and has caused many ugly black pockets to form, The roof has many tears and many patches. It has rusty, broken old air-conditioning units which will never be used. The roof has wires that have been cut, disconnected and left in various disarray. The view from my terrace is awful, The first comment which my guests have is "who lives in those slum units"? We believe that the conditions on the roof and other areas that are not maintained, such as unpainted walls, no doors on storage areas and clutter on the walkways have an adverse effect on the value of the units facing 4513 South Ocean Blvd. • Any improvements which the Highland Beach Code Enforcement Board can do on said property will certainly be appreciated. Florida ' Dear Sirs: Since I have lived in this building, I have been complaining that the building at 4513 has been in very poor condition and since the " Wilma hurricane of 2005, the roof has been in exceptionally poor condition and has never been repaired. Also, the side of the building facing my balcony is also in very ' poor condition and there has never been any attempt on their part to repair it also. . I have been advised that this condition has a depressing effect on the real estate value of my unit and 1 believe that an attempt should ' 'be made to correct this situation without any further delay. Sincerely, L PAULINE KOZOL • August 15, 2006 RE: The property located at 4513 South of Bldg 4511 Highland Beach Code Enforcement Meeting As 1 will not be able to attend the meeting scheduled at Town Hall tomorrow, 8!16/06, at 9:30am, I am communicating my opinion via written correspondence. My view from 4511 S. Ocean Blvd. #605 could be absolutely beautiful. Unfortunately, the property located below my apartment at 4513 S. Ocean Blvd. is hindering the natural beauty. Every time I have a guest to my apartment, they mention the property below and say it's too bad the owner doesn't take care of those buildings. It really hurts the view. It damages our property values as a result. Selling one's home is about presentation. Our presentation is damaged due to the eye sore next to us. Highland Beach is a beautiful community that should be kept up by all owners. . I'd like to see this owner take pride in his property and clean the roof regularly and update the building and improve its appearance. The roof of the Premises is owned by Boca Cove Condominium Association, lnc. 2. The Premises' roof is in need of repair and painting and the roof has a patch like appearance. There is unused equipment and other debris on the roof. The properties condition is ref/ected by the attached two photos. The roof's condition is detrimental to property owned by neighboring property owners because the roof's condition is causing or tends to cause substantial diminution in the neighboring property's value. 3. Boca Cove Condominium Association, lnc, did not obtain from the Town a building permit in connection with the construction of a platform on a stairway located on the Premises' East side, facing the beach. Boca Cove Condominium Association, /nc. is in violation of Chapter 6, Artic% /ll of the Town Code titled "Building Code"as the Association failed to obtain a building permit prior to or in connection with the Association's construction of a platform on the stairway located on the Premises' East side facing the beach. ORDER 1. Boca Cove Condominium Association, /nc. has sixty (60) days from the date of the August 16, 2006 hearing (i. e., until October 15, 2006) to comp/ete a// necessary repairs to the roof, to remove all unused equipment and other debris from the roof, and to paint or otherwise cover the roof so it has a consistent and uniform appearance. In the event all remedial steps are not completed on or before October 15, 2006, the Association sha//be fined One Hundred Dollars and No Cents (S 100.00) per day until such time as the conditions constituting the nuisance have been eliminated. 2. Boca Cove Condominium Association, lnc. has until November 30, 2006 to apply for and obtain a permit from the Town and to partially remove the stairway platform located on the East side of the Premises to the platform's size, location and • configuration complies with the Town's and all other applicable codes and statutes. In the event the Association does not obtain the permit and complete the work on the platform by the end of November 30, 2006, the Association shall be fined One Hundred Do/lars and No Cents ($100.00) per day until such time as the permit is procured and the work on the platform is completed.
