QUARTERLY MEETING

Chair John Pagliaro called the meeting to order at 9:30 a.m. In attendance were Chair
John Pagliaro, Vice Chair Martin Sahn, Frank Colarullo, Jack Halpern, Eugene Diliberto,
Paul Resnick and Louis Reidenberg. Town Attorney Larry Corman was present. Dick
Olbrych, Building Inspector, was present for Bob Dawson.
APPROVAL OF MINUTES
Upon MOTION by MR. SAHN/MR. RESNICK, the minutes of the July 19, 2006 and the
August 16, 2006 meetings were approved.
NEW BUSINESS

Chapter 17-3 NUISANCES: Trash in mangroves, upland portion of lot over grown, piles
• of vegetative trash along sidewalk.
Mr Olbrych offered as much information as he knew, as Mr. Dawson was covering this
project. Mr. Reidenberg felt it should be tabled, as description of the condition is
inadequate, and the Building Official should be here. Building Dept. should provide
photos of situation, and the Chair suggested the members visit the property.
MOTION was made by MR. REIDENBERG/MR. COLARULLO:
TABLE CASE UNTIL THE NEXT MEETING, SO THE BUILDING
OFFICIAL OR HIS REP BE PRESENT AND BE PREPARED TO
ADDRESS THE VIOLATION AND PRESENT EVIDENCE SO THE BOARD
CAN BE PREPARED TO MAKE A DETERMINATION.
MOTION carried unanimously.
The date of Friday, November 17 was set for a Special Meeting.

Attorney Corman will draft procedures to address at the November 17 meeting.Mr.
Reidenberg excused himself from participating in discussion, as he resides at Toscana.
It was noted that required handicapped parking spots were missing, but Mr. Olbrych said
that 12.7 spots are required and there are 14 there now. He did not the handicapped
spot signs should be 7 feet tall and some are too low. He noted that Toscana is not in
violation of the parking spots, and they are located in appropriate locations i.e. by the
elevators, etc. Michael Pascucci -Manager Toscana HOA, noted that paint (to repaint
blue lines and handicapped symbol) and the higher handicapped signs have been
ordered, and would like 90 days to complete work.
MOTION was made by MR. RESNICK/MR. COLARULLO:
TABLE TO .NOVEMBER 17, AND ALTHOUGH 90 DAYS FOR
COMPLETION WAS REQUESTED, HE HAVE IT COMPLETED IN 30
DAYS.
MOTION carried. Mr. Reidenberg abstained.

Chapter 17-3 NUISANCES: Remove dead trees, remove debris.
Recording Secretary noted that she received a call from Laura Troiano who just received
notice to appear two days ago, and was unable to travel to Florida for the meeting. It
was also noted that Mrs. Troiano has been working with the building dept., has been
maintaining the lot, and feels she has been doing what is necessary to maintain lot, that
this is a natural lot, not a landscaped lot. Attorney Corman noted that she did not
receive adequate notice to attend hearing, as notice was just sent on the 11th of
October.
It was recommended that this item be tabled to November 17, contact Mrs. Troiano.
Again there is lack of information. The following MOTION was made by MR. SAHN/MR.

OLD BUSINESS
CODE VIOLATION: BOCA COVE CONDOMINIUM ASSOCIATION, INC.
CASE NO. 2006-02 Lorenzo Sciortino, registered agent
4513 S. Ocean Blvd. #1

Failure to obtain building permit for platform on beach stairway.
Failure to maintain roof and equipment on roof.
It was noted that violator did not obtain a permit for construction of a beach deck or for
repair of roof. Mr. Sciortino said that he applied for and received an exploratory permit
(to allow contractor to go on roof to inspect problems) a week or so ago. Mr. Halpern
• said that nothing has changed as far as any work being done. Attorney Corman told Mr.
Sociortino he needs to be looking for any unused equipment on the roof, painting of the
roof, and general repairs to the roof. Jack Halpern, who lives next door, noted that
nothing has been repaired as of yet, spoke to Bob Dawson who said that an exploratory
permit was not issued. After more consideration, the following MOTION was made by
MR. REIDENBERG/MR. SAHN:
START ACCRUING A FINE, MAKE A DETERMINATION AT THE
NOVEMBER 17 MEETING DATE, FORGIVE THE FINE BASED ON THE
DETERMINATION.
Motion passed. Mr. Diliberto voted No. Mr. Halpern abstained.
Property owner will be sent notice that they have be found that they have not complied
with the citation, a fine will be accumulating and there will be another hearing on
November 17 at which time they may present that everything has been cured and the
Board will consider forgiving the fine, and failing the fine will continue to accrue.
Basically they have 30 days to correct these problems.
MOTION was made by MR. REIDENBERG/MR. RESNICK that Town Attorney be
authorized to direct notice to violator based on prior Motion.

OTHER BUSINESS
Letter from Paul Resnick to Chairman Pagliaro (attached hereto and made a part of
these minutes.) Mr. Resnick would like the Code Enforcement Officer to investigate
these issues, and if he finds a violation, cite property owner and bring before Code
Enforcement Board.
MOTION was made by MR. RESNICK/MR. SAHN to determine nature of the property
adjacent on the west side of the road and determine what limitations there are with
getting the use of that property.
ADJOURNMENT
With no further business to come before the Board, MOTION to adjourn was made by

Request for Action by Board
I bring the following items to your attention for action by our Board:
l .Fence in disrepair at north entrance to Boca Highlands -there is a chain link fence
running west from the north entrance to Boca Highlands toward Grand Cay which
then turns north to the Boca Highlands tennis courts which is visible from AlA. This
fence has been in disrepair for months if not years and is an eyesore which needs
replacement. I do not know if Boca Highlands or Mrs. Milani (I am told she owns the
vacant lot) is responsible for the fence, but whoever is should be made to take action.
2. Water on AlA due to over watering byhomeowners -water puddles on the east
side of AlA from homeowner watering on numerous properties but is especially bad
in front of two properties
A. 3425 North Ocean Blvd -across from the northern edge of the Catholic
Church parking lot
B. 2435 to 2445 North Ocean Blvd. -large homes at the northern end of
town.
These puddles (often large) are most often gone by noon (evaporation and drainage)
but in the early morning cause northbound traffic -both vehicles and bicycles- to veer
into the southbound lanes. This causes an unsightly mess and a dangerous situation
which needs to be corrected. Simple solution -reduce the watering amounts. These
same areas flood during heavy rains but the only solution for those times is re-grading
of the road and drainage ditches on the right-of -way. Mother Nature is beyond our
purview but homeowner watering should be corrected.
