SPECIAL MEETING
Wednesday. December 20. 2006 9.30 a m
Chair John Pagliaro called the meeting to order at 9:30 a.m. In attendance were Chair
John Pagliaro, Frank Colarullo, Jack Halpern, Eugene Diliberto and Louis Reidenberg.
Vice Chair Martin Sahn and member Paul Resnick were absent. Attorney Larry Corman
was present, as was Dick Olbrych, Building Inspector, present for Bob Dawson.
OTHER BUSINESS
There was discussion regarding the items allowed in the DOT rightaway. Some items
at issue are reflectors, shrubbery, condo name signs, cement "bumpers". Mr. Dawson
wrote a letter to DOT asking for their input on items such as these, and as of this date
has not received a foreman response. The Board made MOTION for the Chair to write
a letter to Mr. Sugerman asking to be placed on the next Town Commission agenda to
discuss whether the Town Commission would like to Board investigate and pursue this
matter, or prefer that the Town handle it. MOTION carried.

Failure to obtain building permit for platform on beach stairway.
Failure to maintain roof and equipment on roof.
Mr. Dawson showed recent pictures noting that the project was finished, with all issues
addressed and remedied. He stated that Mr. Sciortino has repaired and painted rooftop
and removed any unused equipment and debris from the rooftop. He also did obtain a
permit from the Building Department and partially remove the stairway platform located
on the East side of the premises to the platform's size.
Regarding the imposed fine, Mr. Halpern requested the fines be kept, as the issue has
been on going for nine months and the neighboring residents had to live with the unkept
property. Mr. Sortino claimed that he did not receive the earlier notices of violation
which is why he did not pursue correction of issues earlier. Chair Pagliaro stated the
Board had three options: 1) collect fines to the full extent 2) partial fine 3) waive entirely.
Discussion showed that the board felt there was a communication problem, issues took
longer to correct due to unavailability of contractors because of hurricane Wilma, and
that the violators intent was good, noting that many other residents are have the same
• type of problem with hiring contractors.

.MOTION was made to waive subject fine of one hundred dollars per day commencing
October 15, 2006 (roof) and November 30, 2006 (stairway) be waived. Order attached
hereto and made a part of these minutes. MOTION carried 4/0 (Mr. Halpern abstained.)

Chapter 17-3 NUISANCES: Remove dead trees, remove debris.
Mrs. Troiano asked for an extension of time on her violation, as she was not able to
travel back to Florida for today's meeting. She is planning on traveling to Florida. on
January 18 and would like to visit the property with Mr. Dawson to review property's
condition. The Board noted that they will meet Wednesday, January 24 at which time
the Board will determine if the property owner has complied with the December 7, 2006
order, and whether a fine will be imposed or not. MOTION was made by MR.
HALPERN/MR. COLARULLO that Mr. Dawson contact property owner, and order will
remain in place until such time that the property is cleaned up.
MOTION carried.
