Highland Beach, Florida 33487 1. CALL TO ORDER Chairperson Parks called the meeting to order at 1.02 P.M. 2. PRESENT UPON ROLL CALL Member Susan Amerling-Stern Member Diane Matthewman Member Jack Halpern Member Katharina Braun Vice Chairperson Nievecita Maraj Chairperson Steven Parks Administrative Support Specialist Ganelle Thompson ADDITIONAL STAFF PRESENT Town Planner Ingrid Allen Town Attorney Len Rubin ABSENT Member Dario Tertan 3. PLEDGE OF ALLEGIANCE The Board Members led the Pledge of Allegiance. 4. APPROVAL OF THE AGENDA Member Halpern added "The Great Beach Sweep" to the agenda as Item 8B under Unfinished Business. MOTION: Member Amerling-Stern moved to accept the agenda as amended. Member Matthewman seconded the motion, which passed (6 to 0) unanimously. Virtual Natural Resources Preservation Advisory Board Regular Meeting Minutes Date: December 09, 2020 Page 2 of 4 5. PUBLIC COMMENT There were no public comments. However, there was a discussion on how the Board should address an email received from Mr. Jeffrey Kleiman regarding whether or not it is the Board's responsibility to respond to public concerns. Ms. Thompson explained that it was unnecessary for the Board to respond to public concerns because the Town has protocols in place that allows for public participation at all Town meetings such as utilizing the public comment section on the Town's website and emailing the Town Clerk's office staff. 6. APPROVAL OF MINUTES A. September 23, 2020 - Regular Meeting Minutes MOTION: Member Amerling-Stern moved to accept the minutes as presented. Member Halpern seconded the motion, which passed (6 to 0) unanimously. 7. PRESENTATIONS: A. Sunshine Law and Public Records - Town Attorney Rubin Chairperson Parks read the title of Item 7A into the record. Town Attorney Rubin explained the Sunshine Law's purpose, when the law applies, the three basic requirements of the law, and the practical applications of the law to members of municipal boards. He explained that two or more board members could not privately discuss any matter that may come before the board for official action, regardless of when or where the discussion occurs. He explained the criminal consequences for violating the Sunshine Law and talked about the public records law and how it applies to the members' communication, the role and duties of the board, and the parliamentary procedures. There was a discussion about whether or not the board members are allowed to contact the Town Attorneys directly and about ordinances that may fall under the Natural Resource Preservation Board's purview for discussion. B. Beach Cleanup Related Liability Concerns - Town Attorney Rubin Chairperson Parks read the title of Item 7B into the record. Town Attorney Rubin explained the implications and liability concerns related to Town sponsored events, the Volunteer Protection Act, and the liability issues that may arise due to volunteer injury or damage caused by volunteers. There was a discussion about the code provisions and what the resident's responsibilities are for keeping the beach clean. Vice Chairperson Marai left the meeting at 1:56 P.M. and Ms. Thompson verified that a quorum was present. Update on the September 23, 2020 Board Recommendations to the Town Commission Town Planner Allen provided an update on the October 6, 2020, Town Commission review and consideration of the Board's recommendations regarding the following: implementation of bucket trees for the collection of beach refuse; publicizing Dan Bellante's PowerPoint Presentation on Dune restoration; and implementation of the "Great Beach Sweep" Initiative. She explained that the Town Commission tabled the "Great Beach Sweep" item and that the Town should not sponsor the event due to liability issues. She advised that the Town owns 25 trash grabbers and does not have a process for signing them out. She also discussed the possibility of the Town obtaining buckets for residents to use toward future beach cleanups. B. The Great Beach Sweep (THIS ITEM WAS ADDED TO THE AGENDA) Chairperson Parks introduced this item. He explained how the Board could educate and encourage the residents to clean the beach. MOTION: Member Amerling-Stern moved to change the banner title "Great Beach Sweep Project" to "Take Pride in Our Beach Education Initiative" and to incorporate the outline that Chairperson Parks prepared as the education piece of the initiative. Member Matthewman seconded the motion, which passed (5 to 0) unanimously. 9. NEW BUSINESS: A. Approval of Natural Resources Preservation Advisory Board Proposed 2021 Calendar Year Meeting Dates Chairperson Parks introduced this item and made a motion to accept the days proposed by the Town Clerk regarding the meetings that are set up for 2021 with the exception that the meeting times be changed to 1:00 P.M. in the afternoon as an inception point as opposed to 9:30 A.M., which is currently on the agenda. MOTION: Member Amerling-Stern moved to accept the motion. Member Matthewman seconded the motion, which passed (5 to 0) unanimously. Member Halpern seconded the motion, which passed (5 to 0) unanimously.
