REGULAR MEETING
Wednesday, February 21 2007 9.30 a m
Chair John Pagliaro called the Regular Meeting to order at 9:30 a.m. In attendance were
Chair John Pagliaro, Vice Chair Louis Reidenberg, Frank Colarullo, Eugene Diliberto,
Martin Sahn and Paul Resnick. Mr. Halpern was absent. Attorney Larry Corman and
Bob Dawson were present.
OLD BUSINESS
CODE VIOLATION: TROIANO MANAGEMENT COMPANY
CASE NO. 06-03 4611 S. Ocean Blvd.
Highland Beach, FL
Re: 4611 S. Ocean, west side of South Ocean
Chapter 17-3 NUISANCES: Remove dead trees, remove debris.
Chairman Pagliaro noted that he and Mr. Dawson visited the property. The dead trees
and the underbrush have been removed, and the property looks significantly better, and
the owner met the requirements of the Board. After further discussion, the Board noted
• that the property is not in violation and the nuisance was cured. Therefore, the fine
commencing January 8, 2007 has been waived.
MOTION was made by MR. RESNICK/MR. SAHN to waive fine. MOTION carried
unanimously.
CODE VIOLATION: FLORCAN DEVELOPMENT LLC
CASE NO. 2007-01 3511 SOUTH OCEAN BLVD.
HIGHLAND. BEACH, FL
The Board noted that a scrim had been placed along the fence of the entire frontage of
the property, the scrim showing a description of the future development. It was noted
that this constitutes a sign, which needs to come before the Planning Board, and needs
to be of a certain size. Mr. Meltzer, of Florcan Development noted that as of today, the
two ends of the scrim have been removed, reducing the size of the "sign".
MOTION was made by MR. REIDENBERG/MR. RESNICK that Mr. Meltzer has one
week to resolve issue with Mr. Dawson. If Mr. Dawson is not satisfied, a fine of $100
per day will be imposed. In the event the sign is taken down prior to the next Board
meeting, no fine will be imposed. MOTION carried.

OTHER BUSINESS
There was discussion re DOT issues and the memorandum sent from the Chair to Mr.
Sugerman, and Mr. Sugerman's response (attached hereto). Mr. Sugerman was present
to address the issues, answering Mr. Reidenberg's question of who has jurisdiction to
make changes in the right-a-way, and noting that the State and Town do. The Board
decided to wait to hear from the DOT, then proceed appropriately.
ADJOURNMENT
With no further business to come before the Board, MOTION to adjourn was made by
MR. PAGLIARO/MR. SAHN at 10:55 a.m.

Dear Mr. Pagliaro:
Thank you for your memorandum of January 25, 2007 regarding the maintenance of the
right-of--way of SR AlA. I appreciate all of the work that you and the Board have done
on this matter in the past. Working with the FDOT is a responsibility of the Town staff,
and therefore, while I am appreciative that you would like to take this matter to the Town
Commission for direction on the Board taking action with the FDOT, this issue is truly a
matter that should happen at the staff level.
• Therefore, I will be working directly with my contacts at FDOT to see if we can get them
to respond to our request(s). In the meantime, I thank you for your offer to investigate
and pursue this matter; however, I will plan on picking up the effort from this point.
In the meantime, via a copy of this letter to the members of the Town Commission, I will
be advising them of your offer so that they can see that you and the Code Enforcement
Board continue to do the fine work that you do.

RE: Attached letter from Robert S. Dawson to
State.of Florida DOT - December 8, 2006
At its January 24, 2007 Quarterly Meeting; the Board discussed
subject letter, and Mr. Dawson noted that- he had been in touch
with a gentlemen from DOT who wished to set up a meeting. The
gentleman also stated that the County has sub-contracted
maintenance, and these other questions on AlA within Palm Beach
County to a sub-contract firm, but nothing appears to be happening.
The Board would like myself and another Board member to be placed
on the next Regular Town Commission agenda to present this issue to
determine whether or not the Commission would like the Board to
investigate and pursue this matter, or prefer that the Town handle
it.

The Highland Beach Code Enforcement- Board is seeking information regarding items allowed in the
A-1-A Right of Way.
I am including some pictures recently taken on A-1-A to which I have notated several items.
Which, if any, of the following are allowed?
Reflectors?
. Low shrubbery?
Trees and/or hedges and other landscaping?
Condominium Name signs?
Our local ordinances address visibility triangles; however they do not address other items in the ROW.
