2007.07.18_CAB_Minutes_RegularTOWN OF HIGHLAND BEACH • CODE ENFORCEMENT BOARD REGULAR MEETING Wednesday, July 18, 2007 9:30 a.m. Chair John Pagliaro called the meeting to order at 9:30 a.m. Present were Chair Pagliaro, Vice-Chair Martin Sahn, Frank Colarullo, Jack Halpern, Eugene Diliberto, Louis Reidenberg and Paul Resnick. Town Attorney Larry Corman was present, as well as members of the general public. NEW BUSINESS Case No. 2007-5 WILLIAM P. OLSEN 20423 State Road 7, #6300 Boca Raton, FL 33498-6797 Re: 4325 Tranquility Drive Chapter 17-3 NUISANCES: Loose the and debris on roof. Recording Secretary swore in all who would be testifying. Mr. Dawson noted the following issues: • . Mr. Olsen was cited for loose tiles on the roof. Work started to repair, then stopped. Notice was sent when work did not resume after a standard period of time. A permit was pulled to re-roof the house. Work has started again, and is proceeding, and should be complete in approximately 30 days. Mr. Reidenberg felt the property owner should have attend today's hearing, even though he is in compliance with Town Code by .removing tiles an debris. Mr. Corman was in agreement. MOTION was made by MR. RESNICK/MR. HALPERN that the Board finds that the violation against Mr. William P. Olsen has been cured (loose tiles and debris removed from rooftop), and Mr. Olsen is in compliance with Town Code. MOTION carried unanimously. Order attached. Code Enforcement Board • July 18. 2007 Page 2 of 2 Recording Secretary swore in all who would be testifying. Mr. Dawson noted the following issues: . Mr. Berger asked .for a continuancy -Board did not grant. . Witnesses were present as to condition of the property. MOTION was made by MR. PAGLIARO/MR. HALPERN to let the witnesses testify even though Mr. Berger was not present. . Witnesses testified that in the six months they have lived across the waterway from the property, the house has been in disrepair the entire time. . After further discussion, the following MOTION was made by MR. HALPERN/MR. RESNICK that Mr. Berger shall paint all unpainted patches on the exterior of the east elevation so it has a consistent and uniform appearance. If violation not cured within 30 days of signed Order, Mr. Berger shall pay an amount of $100/per day until violation is cured. MOTION carried unanimously. Order attached. O/sen 20423 State Road 7, #6300 Boca Raton, FL 33498-6 79 7 Legal description: 4325 Tranquility Drive The Code Enforcement Board of the Town of Highland Beach heard testimony at a duly noticed public hearing on July 18, and based on the evidence presented at the hearing, the Code Enforcement Board enters the fol%wing FIND/NGS OF FACT, CONCLUSIONS OF LAW, and ORDER: F/ND/NGS OF FACT As of April 30, 2007, the property at 4325 Tranquility Drive was found to have loose • tiles and debris on the roof of the house. Testimony showed that as of today's date, the tiles and debris have been removed. CONCL US/ONS OF LA W The condition of the property /ocated at 4611 South Ocean Blvd. constituted and had created a nuisance pursuant to Section 17-3 of the Town of Highland Beach's Code .. of Ordinances. ORDER The Code Enforcement Board has determined that the violation has been cured, and that William P. Olsen is in compliance with the Town's Code of Ordinances. The Code Enforcement Board denied Roland Berger's written request that the hearing on the subject code violation be postponed. The Code Enforcement Board heard testimony and reviewed photographs provided by the testifying witnesses of the subject property. Based on the evidence presented at the hearing, the Code Enforcement Board made and hereby enters the fol%wing F/ND/NGS OF FACT, CONCLUSIONS OF LA W and ORDER: • F/ND/NGS OF FACT There are unpainted patches on the exterior of the house (east elevation). The house has been in this condition for a period in excess of what is a normal time frame for repairs to be completed. CONCL US/ONS OF LA W The condition of the property located at 4207 Tranquility Drive constitutes and has created a nuisance pursuant to Section ~ 7-3 of the Town of Highland Beach's Code of Ordinances.
