STAFF REPORT DATE: November 2, 2018 TO: Town Commission FROM: Mary McKinney, Town Planner THROUGH: Marshall Labadie, Town Manager MEETING OF: November 6, 2018 SUBJECT: 4211 & 4215 South Ocean Blvd. Request for Construction of a seawall Applicant Ocean Place Villas c/o Brad Roberts, Property Manager Property Characteristics Zoning District: RML, Residential Multiple Family Low Density Site Location: 4211 & 4215 South Ocean Boulevard Parcel PCN#: 24-43-47-04-56-001-0030 Request, Facts, and Analysis The applicant is proposing to construct a 206 linear feet seawall east of the Ocean Place Villas and west of the mean high water line of the Atlantic Ocean. The DEP issued a permit for construction in October 2013, which expired in October 2016. The applicant then requested an extension from the DEP and the DEP issued a 3 year permit extension to October 2019. The applicant, through its property manager, has advised the Town that it is now ready to construct the seawall. Staff has reviewed the request, drawings and plans. Although the applicant submitted modified plans which have not yet been approved by the DEP, it has advised the Town that it wishes to process the initial plans that have DEP approval. I.GENERAL INFORMATION: HIGHLAND BEACH BUILDING DEPARTMENT 3614 S. Ocean Boulevard Highland Beach, FL 33487 Ph: (561) 278-4540 AGENDA ITEM 6A Town Commission Regular Meeting November 6, 2018 Latest Version The Town code (Section 6-128(a)) governs this request. It provides: Sec. 6-128. - Approval required for bulkheads, seawalls, retaining walls; required notification of abutting property owners. (a) No bulkhead, seawall, or retaining wall shall be erected or constructed in any water, canal or lake, or on land abutting thereon, within the limits of the town, unless plans and specifications have been submitted to and approved by all federal, state and county agencies with jurisdiction over such construction activities, the town commission and the town consulting engineer, with a copy of such plans and specifications being filed with the town. All property owners abutting the proposed wall within one thousand (1,000) feet on the ocean or on the waterway shall be notified by the town at the applicant's expense. Motorized equipment used to install any of the above walls must stay in the littoral zone or obtain written consent of the owners of each private property whose property will be traversed, which consents must be submitted to the town manager prior to the commencement of such work. Consequently, in addition to DEP approval, and the commission’s approval, the town’s consulting engineer must review and approve the plans. The consulting engineer has been retained, and the report is forthcoming. The code also requires notice of the proposed seawall construction be sent to property owners within 1000 feet of the seawall. These notices were sent by the Town to comply with this requirement. Following approval by the Town Commission, the applicant will be required to obtain a building permit from the Town of Highland Beach to begin the construction. Finally, the applicant plans to access the beach area in Boca and proceed north to the Ocean Place villas. The applicant is in the process of obtaining approval from the property owners whose property they have to traverse to access the Ocean Place Villas site. Staff has reviewed the application, drawings, plans, and other agency approvals, and finds that the project meets the code. Staff recommends approval of the request to construct the proposed 206 linear feet seawall at the Ocean Place Villas subject to the following conditions: 1.The Town’s engineer must review and approve the plans submitted to the Town. 2.The applicant must obtain a building permit from the Town of Highland Beach to construct the approximate 206 linear feet seawall at the Ocean Place Villas. 3.If the commission does not amend its code removing the condition requiring the consent of property owners to traverse their properties, then the applicant must obtain written approval from the property owners to traverse their properties in the Town of Highland Beach from the staging area to the Ocean Place Villas prior to construction or in lieu of obtaining the consent, the applicant must submit a Hold Harmless Agreement indemnifying the Town of Highland Beach from any liability. The Hold Harmless Agreement must be in a form approved by the Town Attorney. No projects may occur within ten (10) feet ofa marked sea turtle nest.. 3.No construction, operation, transportation or storage of equipment or materials is authorized seaward of dune crest in marine turtle nesting habitat during the marine turtle nesting season, March 1 through October 31. 4.Upon locating a dead or injured sea turtle adult, hatchling or egg, that may have been harmed or dest:t·oyed as a direct or indirect result of the project, the permittee shall be responsible for notifying FWC at marineturtle@myfwc.com. Care shall be taken in handling injured sea turtles or eggs to ensure effective treatment or disposition, and in handling dead specimens to preserve biological materials in the best possible state for later analysis.
