CODE ENFORCEMENT BOARD
REGULAR MEETING MINUTES
DECEMBER 19 2007 9:30 A.M.
Chairman John Pagliazo called the meeting to order at 9:30 a.m. in Commission
Chambers. In attendance were Chairman Pagliazo, Vice Chair Louis Reidenberg, Jack
Halpern, Sec. and Members Martin Sahn, Frank Colarulo, Paul Resnick and Eugene
Diliberto. Also in attendance were Town Attorney Larry Corman, Building Official Bob
Dawson and members of the general public.
APPROVAL OF MINUTES
Upon MOTION by MR. SAHN/MR. HALPERN the minutes of the November 19, 2007
Regular meeting were unanimously approved.
NEW/OLD BUSINESS
REPORT (to Town Commission) OF JOHN PAGLIARO AND PUAL RESNICK
REGARDING DOT'S OBSERVATIONS OF OBSTRUCTIONS IN AlA RIGHT-OF-
WAY.
• Mr. Pagliazo thought the Commission would have agreed that the Board should proceed
with looking at the obstructions on AlA and how the issues could be corrected, but that
was not the Commission's response.
Mr. Resnick expressed his disappointment with the Commission's response, and felt as if
he were being chastised for getting involved in the matter. He noted that the Boazd had
been looking into this for sometime and was surprised at the outcome. Mr. Dawson felt
there was a communication problem as to whether the Commission wanted staff or the
Boazd to investigate the issues.
Chairman Pagliazo read into the record his letter to Mayor Hagelmann dated December
19, 2007 (attached hereto.) He thought the Commission would respond that there were
concerns that needed to be addressed, but felt the Commission may have interpreted it as
the Boazd was coming to them with what they want, and that was not the case. The board
wanted them to agree or disagree with what the board presented as their findings.
Mr. Reidenberg's comments noted that reflectors aze not a benefit to the Town and that is
an example of the type of items which aze unbecoming and should be addressed.
He felt that the issue was if the Commission wanted to address the obstructions or if they
wanted the Boazd to do it. Mr. Pagliaro felt that the Commission knows the Boards
concerns and expects that they aze going to address it through staff.

The following MOTION was made by MR. REIDENBERG/MR. HALPERN to authorize
Chairman Pagliaro to execute and direct the letter to be presented to the Mayor, which
was read and dated December 19, 2007. Motion carried unanimously.
Mr. Resnick presented a binder titled SAFE (Safety As Floridians Expect), in regard to
problems along AlA, from Linton Blvd. to Spanish River Blvd. Mr. Pagliaro will
review the binder, and give it back to Jane Dillon who will contact the other members to
pick it up to review.

Dear Mayor Hagelmann:
I want to thank you and the commission once again for the opp unity of allowing us to
present the Code Enforcement Board concerns regarding AIA ght of way at your
December 4, 2007 regular meeting.
It is. importantthat.I clarify that.the. Code Enforcement.Board's. .oncern is with the
appearance of the A 1 A right of way. Our intent was to present t ese concerns and hope
that the commission would take the necessary steps to rectify th m by creating codes that
would allow us to monitor and enforce same.
Again, we are not concerned with existing trees and permanent structures, but rather with
items that are temporary and unsightly.
It appears that the commission's concern is who would be respo sible as well as for the
logistical and procedural matters. My understanding is that the c nsensus of the
commission is. for the Town Manager and. his staff to recommen what codes, if any,
should be addressed. Clearly, the Cade Enfarcement Board wou d monitor and enforce
those codes.
