2009.02.18_CEB_Minutes_RegularTOWN OF HIGHLAND BEACH • CODE ENFORCEMENT REGULAR MEETING MINUTES Wednesday. February 18.2009 9:30 a.m. Members Present: Chair Paul Resnick; Secretary Frank Colarullo; Board Member Eugene Diliberto and Board Member Jack Halpern. Members Absent: Vice Chair Lori Wolin (Excused). Also Attending: Town Manager Dale Sugerman; Town Attorney Larry Corman; Acting Building Official Tom Forbes; Deputy Town Clerk Valerie E. Oakes and members of the general public. CALL TO ORDER Chair Resnick called the Regular Meeting to order at 9:30 a.m. Roll call was taken by Deputy Town Clerk Oakes. The Pledge of Allegiance followed. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA: There were no addition or deletions made to the agenda. PUBLIC COMMENTS AND REQUESTS: No one from the general public had comments or requests. PRESENTATIONS: • There were no presentations made at the meeting. APPROVAL OF MINUTES: MOTION: Board Member Diliberto moved to approve the minutes of December 17, 2008. Board Member Halpern seconded the motion, which passed unanimously. MOTION: Board Member Halpern moved to approve the minutes of January 21, 2009. Secretary Colarullo seconded the motion, which passed unanimously. OLD BUSINESS: Consideration to Modification to Section 23-7 of the Town Code -Permitted Signs Chair Resnick reminded the Board that this issue had been previously discussed primarily regarding the real estate signs and the request was turned down. Chair Resnick asked the Board would reconsider and he stated that he has not had contact with any realtors. The Chair feels that allowing an open house signs only from 2 p.m. to 4 p.m. on Sunday along AlA since it affects real estate values in the Town, affects every citizen, affects real estate prices and may/may not affect the revenue for the Town. Board Member Diliberto: It clutters the Town and should not be allowed. Secretary Colarullo: Agrees with Mr. Diliberto. Board Member Halpern: Remain as status quo. He would like the residents to be able to sell their property without making the Town an eyesore. • • • Code Enforcement Board Wednesday, February 18, 2009 Page 2 of 2 Villa Costa Condominium The Board had taken action on the case of Villa Costa. Town Manager Dale Sugerman informed the Board that action was taken on an item that was not agenized so that is a problem since this is a quasi judicial board. Chair Resnick noted that he was advised that the matter was resolved and there is no longer a violation. Town Attorney Corman stated that from a legal perspective the matter is effectively resolved and the inspector has determined the violation has been cured. It is the Town Attorneys' suggestion that the item be heard at the next meeting so that who ever may have an interest in the matter may appear before the board. NEW BUSINESS: Secretary Colarullo questioned if there are changes as to where vehicles are parked and if the Commission has responded to that issue. Town Manager. Sugerman reported that the Town Commission directed the Town Attorney to draft language regarding obstructions on AIA. ADJOURNMENT: MOTION: Board Member Halpern moved to adjourn the meeting at 10:15 a.m. Board Member Diliberto seconded the motion, which passed unanimously. APPROVAL: Paul Resnick, Ch. Lori Wolin, V.
