2008.04.16_CEB_Minutes_Special• TOWN OF HIGHLAND BEACH CODE ENFORCEMENT BOARD PUBLIC HEARING MINUTES APRIL 16.2008 Immediately following the 5:30 P.M. Regular Meeting Chairman Louis M. Reidenberg called the Regular Meeting to order at 5:30 p.m. In attendance were Chairman Reidenberg, Vice Chair Martin Sahn and Members Eugene Diliberto, Paul Resnick, Jack Halpern Frank Colarullo and Lori Wolin. Also in attendance was Town Attorney Larry Corman, Building Official Bob Dawson and members of the general public. Chairman Reidenberg noted that this was the second Public Hearing to address the obstructions on State Road AIA, which the Town Commission delegated to the Gode Enforcement Board to make a recommendation to them. Resident Joan Halpern, 4511 S. Ocean Blvd. She noted herd concerns as follows: . Bicyclist does not stay in the bicycle lane. Mr. Reidenberg noted that is a safety issue, not an obstruction of which the boazd is considering. The police should be contacted in this regazd. . When traveling out of Highland Beach going North and South, she doesn't see any obstructions: reflectors cement rounds, etc., she sees them only in Highland Beach, and is • always seeing trucks parking on the grass along the roadway. Don't allow any trucks to park. Mr. Dawson noted that code prohibits parking on the swales, unless the DOT issues permits to park. Attorney Gorman quoted Town Code Sec 16-3 - pazking on right of ways, noting that "it is unlawful for any motor vehicle to park on public right of way except those in distress, those designated as emergency vehicles, or unless special permission is granted by the police dept. Unlawful for any vehicle to park on private property in any azea which is not a paved parking space approved by the Town." Therefore, the Town Code prohibits this activity, even for contractors and for cable company vehicles. Is the police dept allowing this conduct to occur and if so, why? Mr. Resnick and Mr. Sahn both confirmed that there is code in place for vehicles not to park on the side of the roadways, and this was discussed over a yeaz ago by the Boazd. Mr. Dawson reminded the board that this is a "stick" issue, as how does one regulate a pool service, or any other type of service to the home where repair people need to pazk? He noted that Delray lots have more depth and are able to accommodate multiple vehicles in the driveways, whereas Highland Beach has narrow lots. Neil Mariano, Highland Beach Police Officer spoke as a resident of the Town, 4605 S. Ocean, Boca Highland. He noted that North or South on AlA in Highland Beach, you will notice hedges, reflectors, cement rounds and pyramids. Hedges OK, cement stones illegal, and reflectors very unattractive. He liked the idea of out of town parking for contractors. • Code Enforcement Boazd Aril 16.2008 Pace 2 of 3 Right of way is 55 feet from center line of roadway, and may go halfway up a person's lawn. With all the obstructions on the roadway, there is no place to pull over cazs, must stop in roadway to avoid these obstructions. He noted that the DOT occasionally picks up the illegal obstacles. Mr. Dawson clarif ed that DOT has asub-contractor who is suppose to do this, but they do nothing so these items never get removed anymore. Mr. Dawson also noted that if the pyramids are removed, many cases of lawn disrepair will be brought before the Boazd. Much of this is created by motorist passing on the right. Beverly Knight, 4203 S. Ocean Blvd. - While the DOT owns the right of way, the homeowners need to maintain their swales. After DOT dug into the swales to catch the rainwater, the swales aze very soft, so when a truck drives over the grass, it digs down in to the grass, digging it up. She supports having small hedges planted in place of the cement mounds. Noted that Palm Beach makes their construction workers park out of Town and trucks them in. Mr. Reidenberg noted that Mr. Sugarman noted that in his memo to the Boazd. Robert Patek. 4217 S. Ocean Blvd. - needs to place orange cones at the end of his driveway so the construction workers building next to his house do not park on his property. The trucks in front of the site block the North view from his driveway. Suggested using the proposed County Park parking lot for contractors and general • pazking. He also suggested placing signs at the Town's North and South entrance stating that pazking on the swale area is not allowed. While these signs may be hard to idernify, the police could at least use them as leverage in issuing a ticket. Lori Wolin suggested utilizing temporary, attractive barriers while construction is underway. Recommended obtaining the contract from DOT for the sub-contractor's regulations in monitoring/removing obstructions on Al A. Jack Hal„~ern suggested utilizing 5t. Lucy Parking lot for contractor parking. And suggested the Town Commission look into utilizing St. Lucy and condo pazking lots. Pam Westbera, suggested utilizing condo pazking lots in off season for contractor parking. The Boazd elected to have another Workshop Meeting after the May 21 Regulaz Meeting at 9:30 a.m. to discuss the issues and formulate a draft of same. Approval of Minutes Upon MOTION BY Mr. Sahn/Mr. Halpern, the Minutes of the March 19, 2008 Regulaz Meeting were approved. New/Old Business Case No. 2008-01 - Mazco Musa Holdings, LTD Mr. Dawson noted that he met with Mr. Musa's brother at the site to discuss the . numerous deficiencies in the building. Mr. Dawson stated that Mr. Musa may eventually want to take the building down, a.s he wants to develop the property differently. Mr. Dawson suggested that Mr. Musa's contractor get in touch with him to walk the contractor around the site to show him everything that needs to be fixed. The contractor could then prepaze an estimate for Mr. Musa who could then decide to make the repairs or take the house down. Mr. Dawson noted that the contractor has not been in touch with him at this point. The Order will be filed with Palm Beach County in order to create a lien on the property. Mr. Corman stated that he has been contacted by Atty. Dan Taylor of Tripp Scott, Ft. Lauderdale, who is representing Mr. Musa in connection with this matter, and just received the Order today from his client and was unable to attend today's hearing. He will meet with his client to try and resolve the issue. MOTION was made by Mr. Diliberto/Mr. Colarullo to file the Order with Palm Beach County.
