Reidenberg called the meeting to order at 9:30 a.m. In attendance were Chairman Reidenberg, Vice Chair Martin Sahn, Members Frank Colarullo, Eugene Diliberto and new member Lori Wolin. Jack Halpern and Paul Resnick were absent. Also in attendance were Town Attorney Larry Corman and Building Official Bob Dawson. Chairman Reidenberg presented a Certificate of Appreciation to former Chairman John J. Pagliaro. APPROVAL OF RTES Upon MOTION by Mr. Sahn/Mr. Colarullo, the minutes of the February 20, 2008 Regular Meeting was approved. NEW BUSINESS • CASE NO 2008-01 RE' 2719 SOUTH OCEAN BLVD Marco Musa Holdings, LTD 4800 N. Federal Highway, Suite 2018 Boca Raton, FL 33431-3408 In Violation of Town Code: . CHAPTER 17-3 NUISANCES -Failure to maintain property. House is missing siding.. . CHAPTER 28 LANDSCAPE/SECTIONS 10 AND 11 Failure to maintain property landscape. Recording Secretary swore in all who would be testifying at today's hearing. Mr. Dawson presented photos of the house (attached) showing the areas of violation, and did note that part of the from of the house had been sided. Edwardo Diaz, representative for Marco Musa was present to address the subject violations. The various enforcement issues were discussed, being missing siding from the house, balcony railings missing from the balconies, windows boarded up which need to be replace and missing roof shingles which need to be replaced. These are safety issues which need to be repaired. Mr. Dawson will look at the inside of the residence with Mr. Diaz in order to determine if there are any safety hazards which need to be repaired as well. n LJ • Code Enforcement Board March 19.2048 ~ Paee 2 of 2 The following MOTION was made by MR SAHN/MR. COLARULLO stating the Boazd's FINDING OF FACT, CONCLUSIONS OF LAW and the ORDER (attached.) Mr. Musa has thirty days to repair the violations, and a fine of $250/day will be imposed starting at today's date and until such repairs are complete. Mr. Musa's representative is to contact Mr. Dawson to make arrangements to tour the inside of the house. The Board will readdress the issue at next months Regular Meeting. (Order Attached hereto). The landscape violations were not addressed at today's hearing, therefore are not reflected in the Order. PUBLIC HEARING The Public Hearing, immediately following the Regular Meeting, was held to receive public input regarding the obstructions on State Road AIA. ~ry.~ierti~, Toscana West, supported allowing residents to plant hedges on the DOT right-of--ways, but disallow reflectors and the other unsightly items currently in place. Chairman Reidenberg called for any additional public comments, of which there were none. It was noted that the second Public Hearing is scheduled for April 16 at 5:30 p.m. • QT>~ER BUSINESS Mr. Corman refreshed the Board Members on the function and the Florida Sunshine Law. Federal Highway, Suite 2018 Boca Raton, FL 33431-3408 Legal Description: 2719 South Ocean Blvd The Code Enforcement Board of the Town of Highland Beach heard sworn testimony at a duly noticed public hearing on March 19, 2008, and based on the evidence presented at the hearing, the Code Enforcement Board enters the following FINDINGS OF FACT. CONCLUSIONS OFLAW. and ORDER: FINDINGS OF FACT As of February S, 2008 and continuing up to and including the date of the public hearing on March 19, 2008, the property at 2719 was determined and found to be in a state of disrepair for the following reasons: Missing siding from the house, balcorry railings missing from the balconies, windows boarded up which need to be replaced missing roof shingles which need to be replaced CONCLUSIONS OFLAW Marco Musa Holdings, L7D, is in violation of Chapter 17-3 of the Town Code titled "Nuisances ", as the premises' structure is in disrepair and constitutes a safety issue. ORDER Marco Musa Holdings, LTD has thirty (30) days from the date of the ~I~Iarch 19, 2008 hearing to complete all necessary repairs -replace siding, add railings to the open balconies, replace windows, replace roof shingles Repairs are to be completed such that the structure has a consistent and uniform appearance. In addition, Marco Musa Holdings, LTD, has thirty (30) days from the date of this Order in which to coordinate and conduct with the Building Inspector an inspection of the • structure's interior as agreed to by the owner's representative at the March 19, 2008 public hearing to determine whether arty other violations exist. Code Enforcement Board Marco Musa Holdings, LTD Case No 2008-01 Page 2 of 2 A frne of Two Hundred and F~ Dollars ($250) shall begin accruing March 19, 2008 until the required repairs are completed in compliance with applicable Town Codes and are approved by the Building Inspector. Property owner shall obtain the necessary permits from the Town's Building Department in order to complete the required work. A cert~ed copy of this Order shall be recorded in the O, ffice of the Clerk of the Circuit Court in and for Palm Beach County, in which the violation(s) exist and upon arty other real or personal property owned by the violator(s) pursuant to Chapter 162 of Florida Statutes.
