CODE ENFORCEMENT BOARD
REGULAR MEETING T~IlNUTES
FEBRUARY 20 2008 9:30 A.M.
Chairman John J. Pagliaro called the Regular Meeting to order at 9:30 a.m. In attendance
were Chairman Pagliaro, Vice Chair Louis Reidenberg, Martin Sahn, Frank Colarullo,
Paul Resnick and Eugene Diliberto. Jack Halpern was absent. Also in attendance was
Building Official Bob Dawson, and members of the general public.
APPROVAL OF MINUTES
Upon MOTION by MR. SAHN/MR. RESNICK, the minutes of the January 16, 2008
were unanimously approved.
NEW/OLD BUSINESS
LETTER DATED JAN. 31, 2008 FROM DALE SUGERMAN TO JOHN PAGLIARO:

• .Chairman Pagliaro read Mr. Sugerman's letter into the record (attached hereto), after
which Mr. Sugerman addressed the issues noted in the correspondence.
The Town Commission would like the Code Enforcement Board to handle the issue. The
Board is a quasi judicial Board, which means they have enforcement powers and they are
also an advisory Board. The obstruction issue falls under advisory, as they will advise
the Town Commission what to do.
Mr. Sugerman suggested the Board conduct Public Hearings, and sit as a neutral party
and hear resident's opinions on acceptable and not acceptable obstructions on AlA. Mr.
Sugerman suggested one or two public hearings, possibly at night to accommodate
working residents. At the conclusion of the public hearing, the Board gives their
recommendation to the Town Commission. Mr. Sugerman estimates this process may
take a year to 18 months. The Board felt if they move forward the Commission could
have their results within a few months.
Chairman Pagliaro asked for public comments.
Marla Wilson Donaldson, Toscana, suggested that contractors put a payment down to
cover any damage costs to resident's properties. If the contractor repairs any damage
they will receive the deposit back. If not, the Town will utilize the deposit for the repair.
Mr. Sugerman did note that the Building Dept. will not issue a C.O. until the property is
• cleaned up, which is the way this problem is regulated now.

After further discussion, the Board elected to conduct two Public Hearing meetings, to
obtain resident input. The first will be held during the day, with the second 30 days later
and night meeting. The following was scheduled:
March 19 Immediately after the 9:30 a.m. Regular Meeting
April 16 Immediately after the 5:30 p.m. Regular Meeting (Regular meeting
changed from 9:30 a.m. to 5:30 p.m.)
The two times will allow for residents to select whichever suits their schedules.
OTHER BUSINESS
Election of Officers for 2008: As Chairman Pagliaro's term is complete at the end
of February, election for a new Chairman was necessary. The following candidates were
nominated:
Mr. Sahn/Mr. Colarullo nominated Louis Reidenberg for Chairman
With no other nominations, MR. REIDENBERG was appointed unanimously as
CHAIRMAN.
Mr. Resnick/Mr. Reidenberg nominated Martin Sahn for Vice Chair. With no
other nominations, MR. SAHN was appointed unanimously as VICE CHAIRMAN.
• Mr. Reidenberg/Mr. Colarullo nominated Mr. Resnick for Secretary. With no
other nominations, MR. RESNICK was appointed unanimously as SECRETARY.
ADJOURNMENT
Prior to adjournment, Chairman Pagliaro offered some parting words to the Board.
With no other business to come before the Board, Motion to Adjourn was made by MR.
SAHN/MR. COLARULLO at 10:05 a.m.

This letter is to advise you and the entire Code Enforcement Board that, based upon your
letter of January 16, 2008 to Mayor Hagelmann, the Town Commission has determined
• that it is supportive of the Code Enforcement Board gathering the appropriate information
and conducting the necessary public hearings to determine how best to handle the issue of
obstructions in the right of way on SR AlA. The Commission asked me to write to you,
based upon a discussion they had at their January 29~' workshop meeting.
Please express my thanks to the entire Board for demonstrating a willingness to tackle
this issue. Please let me know if I can be of any assistance in this matter. Once the Board
has finished with its work on this topic, its recommendation should be forwarded directly
to the Town Commission.
