MINUTES OF THE
CODE ENFORCEMENT SPECIAL MAGISTRATE
REGULAR MEETING
Thursday, December 3, 2009 2:00 P.M.
Special Magistrate: Carolyn S. Ansay

CALL TO ORDER•
Special Magistrate Ansay called the Code Enforcement Hearing to order at 2:00 p.m.
• SWEARING IN•
Special Magistrate swore in all those who would testify.
VIOLATION HEARING•
Case#2009-11 2909 South Ocean Blvd., Wiltshire House
Juan Ferriol Code Enforcement Officer -The teekee/chickee was installed on the
property line. The accessory structure does not comply with the Town ordinance.
Evidence was entered into the record. The property owner is Wiltshire House
Condominium Association. The Town would like to recommend that the property come
into compliance within 30 days.
Phil Colletta. President of Wiltshire House - He was told that a permit was not needed
since the but was built by Indians. On July 20~', Geoffrey Vanore, former Building
Official, inspected the property. Mr. Vanore explained that the but did not comply with
the zoning code; a 5-foot easement is required. On July 26~', he received a certified
mailing. The former building official explained that a variance is possible. The structure
needs to be moved 2 '/Z feet to come into compliance, but it would ruin the look of the
property. They would like to obtain a variance.
• Special Magistrate -Finds the property in violation of code section 30.68(C)(1).
The property must come into compliance by January 15, 2010. If the property is
not in compliance, a daily fine could be incurred. No administrative fees were
assessed.
ADJOITRNMENT•
There being no further business the Special Magistrate adjourned the meeting at 2:30
p.m.
