1. CALL TO ORDER
Mayor Hillman called the meeting to order at 1:30 P.M.

3. PLEDGE OF ALLEGIANCE
The Town Commission led the pledge of allegiance.
4. ADDITIONS, DELETIONS, AND APPROVAL OF THE AGENDA
Commissioner Shoemaker added a "Discussion on Veterans Memorial" as Item 11F
under New Business.
MOTION: Commissioner David moved to accept the agenda with the addition of a
Discussion on the Veterans Memorial. Vice Mayor Babij seconded the
motion, which passed (5 to 0) unanimously.
5. PRESENTATIONS / PROCLAMATIONS
A. National Hunger and Homeless Awareness Week Proclamation
Ms. Pamela Payne, Chief Executive Officer with the Homeless Coalition of Palm Beach
County, joined the meeting via Zoom and thanked the Town Commission for the
proclamation recognizing November 15 - 22 as National Hunger Homelessness
Awareness Week.
Town Clerk Gaskins read the abovementioned proclamation into the record.

B. Police Department Updates - Chief Craig Hartmann
Chief of Police Craig Hartmann presented a PowerPoint presentation. He spoke about
the crosswalks and pediatrician safety, roadway and bicycle safety, student safety at
school bus stops along State Road A1A, the new wellness/fitness and training facility for
Highland Beach police officers, the ongoing emergency management meetings with Palm
Beach County, and the various ways that the residents can access and communicate with
the Police Department during the COVID-19 pandemic. He thanked the Town
Commission and the residents for supporting the Highland Beach Police Department. He
also spoke about the paved shoulders, the substandard-width lane and the Florida bicycle
law, and the pedestrians crossing at the crosswalks and vehicles approaching the
crosswalk areas.
6. PUBLIC COMMENTS AND REQUESTS
Mr. John Ross gave comment on Item 10B, modifying the construction work hours on
Saturdays, parking in the Bel Lido community, noise disturbance and condominiums
regulations.
Mr. David Stern was unavailable to participate in the meeting. He sent an email strongly
recommending a comparative salary analysis for the entire Town Commission. He
suggested that the Town Commission task the Financial Advisory Board with the
comparative salary analysis or a study.
Mayor Hillman recommended that Town Manager Labadie inform the Financial Advisory
Board that the Town Commission welcomed Mr. Stern's suggestion and if the Financial
Advisory Board would be willing to look into this matter, the Town Commission would be
happy to look at their results.
Town Manager Labadie will place this item on the Financial Advisory Board's upcoming
agenda for discussion.

8. ORDINANCES AND RESOLUTIONS
There were no ordinances and resolutions.
9. CONSENT AGENDA
A. Approve and authorize the Mayor to execute a proposal from Carrier
Commercial Services in an amount of $64,683.42 to provide the equipment for
the replacement of the east chiller at the Water Treatment Plant.
Mayor Hillman read the title of Item 9A into the record.
MOTION: Commissioner David moved to approve the contract to buy the new air
conditioning unit (Consent Agenda was approved as presented). Vice
Mayor Babil seconded the motion, which passed (5 to 0) unanimously.
10.UNFINISHED BUSINESS
A. Consideration of the proposed Commission Interaction Guidelines replacing
Resolution No. 19-008 R.
Mayor Hillman read the title of Item 10A into the record.
Town Manager Labadie introduced this item and explained that he along with
Commissioner David and Town Attorney Torcivia, come up with the proposed
Commission Interaction Guidelines. He explained that the proposed guidelines' premise
is for each Commissioner to report or communicate activities related to any engagements
or interactions at a Town Commission meeting.
The Town Commission decided that the proposed guidelines should be modified to
include the words "or an appointed commissioner" after the word "Mayor" in the Social
Interactions and Professional Organizations section.
Town Manager Labadie will make the changes to the proposed guidelines and bring them
back at a future Town Commission meeting.

B. Discussion on modifying the construction work hours and Saturday limitations.
Mayor Hillman read the title of Item 10B into the record.
Vice Mayor Babij presented this item.
Building Official Jeff Remas joined the meeting via Zoom and advised that he and Vice
Mayor Babij worked together on this subject matter and came up with a reasonable list of
exclusions for Saturdays. He mentioned that rotating Saturdays could create confusion
and potential issues.
There was comprehensive discussion about modifying the construction work hours and
the construction site restrictions on Saturdays (for more information about this item,
please visit the Town's Media Archives & Minutes webpage to access and view the
audio/video recording).
Mayor Hillman opened the item for public comments.
Ms. Diane Matthewman spoke about a survey she conducted in her neighborhood and
expressed her opposition with modifying the construction work hours.
Mr. Morley Wiener spoke about a survey he circulated to the residents in the Bel Lido
community. He shared his findings and expressed his opposition with modifying the
construction work hours.
Mr. Jack Halpern joined the meeting via Zoom and expressed his opposition with
modifying the construction work hours.
The following motions were made:
MOTION: Commissioner Gossett- Seidman moved to expand weekly hours from its
current 47 in a half on a 40-hour standard workweek to possibly 54, to survey
the residents to get full input from everyone for Saturdays and to reconvene
in a couple of weeks. The motion failed for lack of a second.
MOTION: Vice Mayor Babii moved to pass the current revisions as written with the
exceptions of a few changes: The first change, 7:30 A.M. on weekdays
instead of 8:00 A.M. The second change, 3:00 P.M. end time on Saturdays
(9:00 to 3:00). The third change, adding the use of compressors,
generators, and nail guns onto the total list (strictly prohibited list).
Commissioner David seconded the motion.
Further discussion was had about code enforcement on Saturdays.

Mayor Hillman suggested that Building Official Remas have a full-time code enforcement
officer on Saturdays for the first month that the modified construction work hours go into
effect. Building Official Jeffrey Remas and Town Manager Labadie will review the
collective bargaining agreement and make the necessary change for full-time staff on
Saturdays.
Town Clerk Gaskins conducted a roll call vote on the motion. Upon roll call the motion
passed (4 to 1) with Commissioner Gossett-Seidman dissenting.
Town Manager Labadie explained that the process requires an ordinance change, a first
read, public notice processing and a second read.
Mayor Hillman recessed the meeting at 4:24 P.M. The meeting reconvened at 4:32 P.M.
C. Right-of-Way ordinance update. Commissioner Shoemaker
Mayor Hillman introduced this item.
Commission Shoemaker presented this item providing the Town Commission with an
update on his meeting with Town Manager Labadie and Town Planner Allen. A
PowerPoint presentation was displayed depicting various streets in the town.
An outline will be presented at the next Town Commission meeting.
11.NEW BUSINESS
A. Resolution No. 20-022 / Amendment to Resolution No. 19-022 R
A resolution of the Town Commission of the Town of Highland Beach, Florida, amending
Resolution No. 19-022 R, which appropriated funds for the 2019-2020 fiscal year budget,
which began October 1, 2019, and ended September 30, 2020: providing an effective
date.
Town Manager Labadie introduced this item.
MOTION: Commissioner David moved to adopt Resolution No. 20-022 as
presented. Vice Mayor Babie seconded the motion, which passed (5 - 0)
unanimously.
B. Consideration to authorize Vice Mayor Babij to sponsor the review and propose
any amendment(s) to the accessory marine structure ordinance provisions.
Town Manager Labadie introduced this item.
Vice Mayor Babij presented the item explaining that the City of Boca Raton and the City
of Pompano Beach have clean ordinances. He also discussed how some municipalities
are moving towards a 3D type box concept.

MOTION: Commissioner David moved that Vice Mayor Babij continue to review the
accessory marine structure ordinance. Commissioner Gossett-Seidman
seconded the motion, which passed (5 to 0) unanimously.
C. Discussion on State Appropriation Funding Requests and Grant Possibilities.

Mayor Hillman read the title of Item 11 C into the record.
Commissioner Gossett-Seidman presented this item advising that Mr. Michael Caruso
was reelected as the Florida House of Representative for District 89. She spoke about
her conversations with Mr. Carso's office as it relates to reapplying for new State
appropriations for the upcoming year, refiling the crosswalks appropriation request with a
new title related to disabled seniors' critical crossings or disabled person, etc., and
awaiting a response on whether the current crosswalk funding allocation would act as
matching funds. She advised that Representative Caruso's suggested that the town
submit an appropriation request for the swale repairs. She also discussed an old state
law that prohibits the Florida Department of Transportation (FDOT) from correcting
swales in front of single-family homes. She stated that Representative Caruso offered to
act as a go between with FDOT and he encouraged the Town Commission to find out
what the town have for matching funds. Representative Caruso also agreed to consider
a third appropriation request for the wastewater relining project, if necessary. Further
dialog continued about matching funds and grant possibilities for other projects.
The Town Commission reaffirmed Commissioner Gossett-Seidman's continued efforts in
Tallahassee to seek grants and funding for the town.
D. Discussion on the Highlander Newsletter Fall/Winter Edition. Commissioner
Gossett-Seidman
Commissioner Gossett-Seidman presented this item indicating it would be nice to put a
Highlander Newsletter together between now and January.
Town Manager Labadie discussed what content would be included in the Highlander
Newsletter.
There was dialogue about the Town Commission sponsored letters to the residents.
It was the consensus of the Town Commission to move forward with preparing a
Highlander Newsletter.

Commissioner Gossett-Seidman indicated that she was recusing herself because she
had not reviewed the minutes.

MOTION: Commissioner Shoemaker moved to approve the Town Commission
minutes as detailed for September 01, September 08, September 15, and
September 22, 2020 with one minor change as noted. Vice Mayor Babil
seconded the motion, which passed (4 to 0) unanimously.
F. Discussion on Veterans Monument (THIS ITEM WAS ADDED TO THE AGENDA
AND DISCUSSED PRIOR TO ITEM 11 E)
Commissioner Shoemaker presented this item explaining that he is currently working on
a veteran recognition project to honor the veterans living in the Highland Beach
community. He asked Town Clerk Gaskins to comment on the ideas about a
proclamation. Town Clerk Gaskins explained that a proclamation could be prepared for
Veterans Days. The Governor issue a proclamation and various municipalities put the
proclamation on their agenda to recognize the veterans in their community. There was
discussion about a veteran's monument sign being included as part of the signage
redesign project.
The Town Commission supports Commissioner Shoemaker on this project.
12. TOWN COMMISSION COMMENTS
Commissioner John Shoemaker talked about the substantial beach erosion that he
observed during his hike along the beach from the hotel to the south line. He also talked
about the flooding on the roadways and sidewalks because of the rain.
Commissioner Evalyn David had no comments.
Commissioner Peggy Gossett-Seidman spoke about a Zoom meeting that she attended
last Friday regarding the Florida League of Cities statewide group and will give a report
at the next meeting.
Vice Mayor Greg Babij had no comments.

Mayor Douglas Hillman reminded the residents about the aerial beach photograph event
on the beach tomorrow at 10:00 a.m. He mentioned two great movies on Netflix—Queens
Gambit and The Crown.
13. TOWN ATTORNEY'S REPORT
Town Attorney Glenn Torcivia informed the Town Commission about the Governor
rescinding the quorum requirements, hence the reason for meeting in-person. The cities
of Boca Raton, Boynton are challenging this matter and are meeting remotely. They are
proceeding under the home rule and a state law that gives local government emergency
authority.
14. TOWN MANAGER'S REPORT
Town Manager Labadie mentioned that the City of Delray Beach will be talking about
conducting all virtual meetings. He has some reservations to this platform for public
meetings and suggested that the Natural Resources Preservation Board and the
Financial Advisory Board meetings continues via the Zoom platform because these
boards only make recommendations. He spoke about the hybrid virtual meeting type
platform.
Mr. Labadie explained that FDOT will no longer include the embedded lights with the
three RRR's project due to the costly nature. The Town will save money by doing this
portion of the project.
He informed the Town Commission about-
1.
bout:1. The objection letter that was sent to the City of Delray Beach and the Army
Corps; and,
2. The Water & Sewer Rate Study coming back on the December 1 meeting
agenda; and,
3. The Fire-Rescue Study was pending based on receiving data from the City of
Delray Beach; and,
4. The crosswalk lighting and state appropriation funding; and
5. The Water Supply Plan, the Communication Plan, and working with the Town
Attorney regarding the boat slips.
Mayor Hillman proposed speaking with Mr. Pierce about the boats on the property. He
elaborated and stated that he would include a conversation on the height, putting in boats
without closed bridges as well as, up-to-date boats.
MOTION: Commissioner David moved that Mayor Hillman contact Mr. Pierce. Vice
Mayor Babil seconded the motion, which passed (5 to 0) unanimously.

15. ADJOURNMENT
There being no further business, Mayor Hillman adjourned the meeting at 5:52 P.M.
APPROVED at the January 05, 2021 Town Commission Meeting.
