TOWN COMMISSION MEETING MINUTES

1. CALL TO ORDER
Mayor Hillman called the meeting to order at 1:30 P.M
2. PRESENT UPON ROLL CALL

3. PLEDGE OF ALLEGIANCE
The Town Commission led the Pledge of Allegiance.
4. ADDITIONS. DELETIONS. AND APPROVAL OF THE AGENDA
Commissioner Gossett -Seidman added a "Discussion of the Agenda Submission Date"
as Item 11G under New Business.
MOTION: Commissioner David moved to accept the agenda as presented with
Commissioner Gossett-Seidman's addition. Vice Mayor Babii seconded the
motion, which passed (5 to 0) unanimously.
5. PRESENTATIONS / PROCLAMATIONS (THIS ITEM WAS HEARD AFTER ITEM 6
PUBLIC COMMENTS AND REQUESTS)
A. Introduction of Barbara Herrera, Government Affairs Manager, Waste
Management of Florida, Inc.
Ms. Barbara Herrera, the Government Affairs Manager with Waste Management
introduced herself and mentioned that she is now the service provider for the Town of
Highland Beach.

6. PUBLIC COMMENTS AND REQUESTS (THIS ITEM WAS BEFORE ITEM 5
PRESENTATIONS / PROCLAMATIONS)
Mr. John Ross commented about his participation on numerous Zoom meetings since
March, the crosswalks, the water rate study, and the fire -rescue contract.
7. ANNOUNCEMENTS
Mayor Hillman mentioned the following Board Vacancies.
A. Board Vacancies
Board of Adjustment & Appeals Board - Two vacancies for a three-year term.
Financial Advisory Board - One vacancy for a three-year term.
B. Meetings and Events
November 11, 2020 — Town Hall closed in observance of Veterans Day
November 12, 2020 - 9:30 A.M. Planning Board Regular Meeting
November 17, 2020 - 1:30 P.M. Town Commission Meeting
November 19, 2020 - 2:00 P.M. Financial Advisory Board Special Meeting
November 26, 2020 - Town Hall closed in observance of Thanksgiving
November 27, 2020 - Town Hall closed the Day after Thanksgiving
C. Board Action Report
1. October 2020 Board Action Report
Mayor Hillman mentioned that the board report was in reference to the October 29, 2020,
Code Enforcement Board meeting.
Town Manager Labadie indicated that he and Town Attorney Torcivia are working on the
accessory use provision application as it relates to the metes and bounds lots in question.
He will provide the Town Commission with the updates at next Town Commission
meeting.

8. ORDINANCES AND RESOLUTIONS
A. ORDINANCE NO. 20-005
AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING THE
CODE OF ORDINANCES, CHAPTER 12 "CONSTRUCTION SITES," CHAPTER 25
"STREETS, SIDEWALKS AND BICYCLEIWALKWAY PATHS" AND CHAPTER 30,
"ZONING CODE," TO PROVIDE PUBLIC RIGHT-OF-WAY PERMITTING
REGULATIONS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN
CONFLICT; PROVIDING FOR SEVERABILITY AND CODIFICATION; AND
PROVIDING AN EFFECTIVE DATE.
Mayor Hillman read the title of Ordinance No. 20-005 into the record.
Town Manager Labadie presented this item.
Commissioner Shoemaker agreed to take on the assignment to sponsor the Right -of -Way
ordinance that deals with key issues such as gas and cable lines and discuss an outline
about it at the Town Commission meeting.
The Town Commission agreed that Town staff would go out in the community and take
photographs of the items obstructing the right of ways and swale areas on the side streets.
9. CONSENT AGENDA
A. There were no Consent Agenda items.
10. UNFINISHED BUSINESS
A. Continued discussion on 2020 Water/Wastewater Revenue Sufficiency Rate
Study — Water and Wastewater Systems
Town Manager Labadie introduced this item.
Mr. Robert Ori, Executive Vice President and Mr. Mark Tuma. Consultant with Raftelis
Financial Consultant, Inc., joined the meeting virtually and presented an updated
PowerPoint presentation on the 2020 Water/Wastewater Revenue Sufficiency Rate
Study.
Town Manager Labadie will work with Finance Director Matthew Lalla, Mr. Ori, and Mr.
Tuma on the tiered methods and bring the item back to Town Commission in December.

11. NEW BUSINESS
A. Approve and authorize the Town Manager to execute a one (1) year renewal
letter for the agreement with Cleaning Systems Inc. for janitorial services for the
Town Hall complex.
Mayor Hillman read the title of Item 11A into the record.
Pat Roman, Public Works Director spoke about the satisfactory services provided by
Cleaning Systems Inc., for janitorial services.
MOTION: Commissioner Gossett -Seidman moved to accept the one-year contract
extension for CSI (Cleaning Systems Inc.) Commissioner David seconded
the motion, which passed (5 to 0) unanimously.
B. Approve and authorize the Town Manager to execute a one (1) year renewal
letter for the agreement with Model Row Inc. for landscaping services for the
Town Hall complex and other Town -owned properties.
Mayor Hillman read the title of Item 11B into the record.
Pat Roman, Public Works Director spoke about the satisfactory services provided by
Model Row Inc. for landscaping services.
MOTION: Commissioner Shoemaker moved to approve the contractual services
provided by Model Row, Inc. Commissioner David seconded the motion,
which passed (5 to 0) unanimously.
C. City of Delray Beach — 2021 Beach Re -Nourishment Project
Mayor Hillman introduced this item and spoke about the objection letter prepared by Town
Manager Labadie.
Town Commission agreed that Town Manager Labadie would send the objection letter to
the Florida Department of Environmental Protection, the Army Corp of Engineering and
send copies to the City of Delray Beach Mayor and Commissioners, Senator Tina Polsky,
and the Coastal Star Manager.
D. Construction Work Hours - Mayor Douglas Hillman
Mayor Hillman presented this item discussing the various construction work hours in
neighboring municipalities.
Jeffrey Remas, Building Official joined the meeting virtually and provided comments.
The item was opened for Public Comments.
Mr. Kevin Ormes was in favor of changing the construction work hours.

Ms. Maude Weiner of 4409 Intracoastal Drive joined the meeting virtually at 4:01 P.M.
and was opposed to changing the construction work hours.
There being no further comments, the Public Comments was closed.
There was discussion about the construction work hours during the week and on
Saturdays, Vice Mayor Babij working with Town Staff to define quiet work on Saturday,
allowing construction work hours on the following holidays: Presidents Day, Columbus
Day, Veterans Day, the day after Thanksgiving, and Martin Luther King Day, and an easy
way to describe the limitations of hammer drilling, jack hammering and the changing out
of dumpsters.
Town Staff would bring something back at the next Town Commission meeting. Town
Manager Labadie explained that this matter would be an ordinance change which
requires legal advertisement for the second reading. The ordinance would come before
Town Commission in January.
Vice Mayor Babij is sponsoring the ordinance.
E. Florida League of Cities Full Report and Committee Update - Commissioner
Gossett -Seidman
Commissioner Gossett -Seidman spoke about the Florida League of Cities zoom meeting
that she recently participated on. She explained that the Legislative Policy Committees
are looking for municipal officials from across the state to participate on the Committees
She will be participating on the next zoom meeting in November and will bring back some
information to share with the Town Commission. She also spoke about the Sadowski
Fund for low income housing (affordable housing).

MOTION: Commissioner David moved to accept the August 02, 2020, August 06,
2020, August 13, 2020, and August 18, 2020 Commission Minutes as
amended. Commissioner Gossett -Seidman seconded the motion, which
passed (5 to 0) unanimously.
G. Discussion on the Agenda Submission Date (THIS ITEM WAS ADDED TO THE
AGENDA)
Commissioner Gossett- Seidman introduced this item and asked for more flexibility with
the agenda submission dates. Mayor Hillman suggested that Commissioner Gossett -
Seidman work with Town Clerk Gaskins in order to come up with a more suitable
schedule.

12. TOWN COMMISSION COMMENTS
Commissioner John Shoemaker had no comments.
Commissioner Evalvn David had no comments.
Commissioner Peggy Gossett -Seidman commented on her attendance at Impact 100
Palm Beach County event and grants related to the appropriation request 2021.
Vice Mayor Greg Babii had no comments.
Mayor Douglas Hillman briefly spoke about Milani Park and the upcoming Beach Meet -
up event on November 18, 2020 at 10:00 A.M.
13. TOWN ATTORNEY'S REPORT
Town Attorney Glen Torcivia provided comments about the in -person meetings.
14. TOWN MANAGER'S REPORT
Town Manager Labadie read a public comment from Carol Wittenberg and provided an
update on the following project: the crosswalk street signs, painting the new town's logo
on the water tower, landings, the ongoing work with the consultant about the Fire Rescue
information, and the community wave of COVID-19 cases coming back. He encouraged
everyone to continue to take precautions to remain safe.
