CALL TO ORDER Mayor Hillman called the meeting to order at 1:38 P.M 2. PLEDGE OF ALLEGIANCE The Town Commission led the Pledge of Allegiance. 4. ADDITIONS, DELETIONS, AND APPROVAL OF THE AGENDA Mayor Hillman added "Revisit of the Hiring Freeze" as Item 10D under Unfinished Business and "Wearing face mask in Highland Beach" as Item 11 H under New Business. MOTION: Commissioner David moved to accept the agenda as amended. Commissioner Gossett -Seidman seconded the motion, which passed (5 to 0) unanimously. 5. PRESENTATIONS / PROCLAMATIONS A. Domestic Violence Awareness Month Proclamation Mayor Hillman read the title of Item 5A into the record. Chief of Police Craig Hartmann presented this item discussing the impact of domestic violence in Palm Beach County. Town Clerk Gaskins read the Domestic Violence Awareness Month Proclamation. Mr. Eugene Garrett Email Mayor Hillman mentioned that there was an email received from Mr. Eugene Garrett. Town Clerk Gaskins mentioned that an email was received from Mr. Rick Greenwald and that there were no additional public comments. 7. ANNOUNCEMENTS A. Board Vacancies Board of Adjustment & Appeals Board - Two vacancies for a three-year term. Financial Advisory Board - One vacancy for a three-year term. B. Meetings and Events October 12, 2020 - October 20, 2020 - 1:30 P.M October 22, 2020 - 2:00 P.M C. Board Action Report Town Hall Closed in observance of Columbus Day Virtual Town Commission Meeting Virtual Financial Advisory Board Meeting (Tentative) 1. Natural Resources Preservation Board and Financial Advisory Board Reports Town Planner Allen joined the meeting and presented this item. MOTION: Commissioner Shoemaker moved to adopt the suggestions on the bucket trees for helping clean the beach with four or less beach bucket trees. Commissioner David seconded the motion, which passed (5 to 0) unanimously. It was the consensus of the Town Commission to TABLE the Great Beach Sweep Project. 8. ORDINANCES AND RESOLUTIONS There were no Ordinances or Resolutions. 9. CONSENT AGENDA There were no Consent Agenda items. Virtual Town Commission Meeting Minutes Date: October 06, 2020 10. UNFINISHED BUSINESS 3of7 A. Approve and authorize the Mayor to execute an agreement with AT&T in the amount of $46,080 for fiber internet services for an additional three years. Mayor Hillman read the title of Item 10A into the record. Town Manager Labadie introduced this item explaining that the Town has been working with AT&T to extend the contract and improve the level of service including the bandwidth. Assistant to the Town Manager Terisha Cuebas explained the current service provided by AT&T, the need to increase the media technology for the Zoom platform to the bandwidth to 250 megabits per second, and the mobility services. Mark Rutledge of NodeO IT, the Town's IT Consultant, spoke about the conversation with AT&T regarding 5G service in Highland Beach, which was not available to the Highland Beach area. He then explained the current infrastructure of the Town, the bandwidth issues, the poor cellular phone service, and the request to AT&T regarding the angle of their antenna to increase coverage service. He also discussed a signal booster for cellular phone services. Mayor Hillman suggested Commissioner Shoemaker get with Ms. Cuebas and Mr. Rutledge to discuss the item. He TABLED the item until the October 20, 2020 Town Commission meeting. B. Consideration on evaluating the impact and effectiveness of a 4X the fee for working without a permit. Mayor Hillman read the title for Item 10B into the record. MOTION: Mayor Hillman moved to approve the impact and effectiveness of the 2'/2 times fee with a $10,000 maximum. Commissioner David seconded the motion. Based upon roll call, the motion carried on a 4 to 1 vote with Commissioner Gossett -Seidman dissenting. C. Continued discussion on 2020 Water/Wastewater Revenue Sufficiency Rate Study — Water and Wastewater Systems. Mayor Hillman read the title of Item 10C into the record. Town Manager Labadie introduced this item and referred the item to Finance Director Lalla, who discussed the changes in the millage rate associated with the Water and Sewer Rate Study implementation. Robert Ori, Executive Vice President and Mark Tuma, Consultant with Raftelis Financial Consultant, Inc., joined the meeting via Zoom. Revisit the Hiring Freeze as Item (THIS ITEM WAS ADDED TO THE AGENDA) The Town Commission agreed to let the hiring freeze expire. 11. NEW BUSINESS A. Consideration of the proposed Commission Meeting Schedule for FY 2020/2021. Mayor Hillman read the title of Item 11A into the record. Town Manager Labadie introduced this item. It was the consensus of the Town Commission to move the November 3, 2020 Commission meeting date to Thursday, November 5, 2020 because November 3, 2020 was the United States presidential election day. MOTION: Commissioner David moved to approve the Commission Meeting schedule for FY 2020-2021 as amended. Commissioner Shoemaker seconded the motion, which passed (5 to 0) unanimously. B. Discussion on the 2020 Light Up the Holidays Community Event. Mayor Hillman read the title of Item 11 B into the record. Town Manager Labadie introduced this item. The Town Commission agreed to cancel the 2020 Light Up the Holidays Community Event. C. Consideration of Applied Technology and Management, Inc (ATM) accessory marine structures ordinance review to the Planning Board. Mayor Hillman read the title of Item 11C into the record. Town Manager Labadie introduced this item. It was the consensus of the Town Commission that Town Planner Allen would research the City of Boca Raton codes related to the accessory marine structure ordinance. Approve the Bid Award and authorize the Mayor to execute an Agreement with La Porta Contracting in the amount of $131,581.76 with an 18% contingency for unforeseen roof repairs for the Town Hall Roof Replacement Project (Invitation to Bid No. 20-007). Mayor Hillman read the title of Item 11 D into the record. Town Manager Labadie introduced this item. MOTION: Mayor Hillman moved to conditionally approve Item 11 D. Commissioner David seconded the motion, which passed (5 to 0) unanimously. E. Approve the extension to the Auditing Services Contract with Grau & Associates for an additional three fiscal years ending September of 2022. Mayor Hillman read the title of Item 11 E into the record. Town Manager Labadie introduced this item explaining that the Financial Advisory Board recommendations were to continue with Grau & Associates for the next three years. He referred the item to Finance Director Matthew Lalla who then explained that it was important to use a firm who was familiar with the Town as it goes through the ERP implementation. MOTION: Commissioner David moved to approve the extension with Grau & Associates. Commissioner Shoemaker seconded the motion, which passed (5 to 0) unanimously. F. Approval of Commission Meeting Minutes April 07, 2020 - Commission Meeting Minutes May 05, 2020 - Commission Meeting Minutes May 19, 2020 - Commission Meeting Minutes June 06, 2020 - Commission Meeting Minutes Mayor Hillman read the title of Item 11 F into the records. MOTION: Commissioner David moved to approve the meeting minutes, as amended. Commissioner Gossett -Seidman seconded the motion, which passed (5 to 0) unanimously. G. Recognition for Residents - Commissioner Gossett -Seidman Commissioner Gossett -Seidman spoke about the benefits of recognizing and honoring residents and veterans in the Highland Beach community and perhaps coming up with a process. Wearing face mask in Highland Beach — Mayor Hillman (THIS ITEM WAS ADDED TO THE AGENDA) Town Manager Labadie mentioned that Palm Beach County currently has an Executive Order in place regarding facial covering. However, Governor DeSantis passed an executive order prohibiting the enforcement of facial covering or impose penalties. Basically, the Town of Highland Beach can educate the residents but cannot enforce facial covering. Town Manager Labadie will respond to the resident who sent an email expressing concerns about wearing face coverings in Highland Beach. 12. TOWN COMMISSION COMMENTS Commissioner John Shoemaker had no comments. Commissioner Evalyn David had no comments. Commissioner Peggy Gossett -Seidman inquired about the abandoned sailboat on the ocean. Town Manager Labadie noted that he would provide an update during the Town Manager's report. Vice Mayor Greg Babii had no comments Mayor Douglas Hillman had no comments. 13. TOWN ATTORNEY'S REPORT Town Attorney Leonard Rubin had nothing to report. 14.TOWN MANAGER'S REPORT Town Manager Labadie provided updates on the derelict vessel, the Annual Copper and Lead numbers, an email regarding the beach nourishment projects and on the Building Department's switch over. He gave kudos to Police Department employees, Detective Dwayne Fernandes and Officer Erik Colon for assisting Mr. Hightower with a missing persons incident, to Accreditation Manager Eric Aronowitz for his work on a grant and assisting with a Boy Scouts Beach Cleanup event, to Officer Jeffrey Miller for assisting Carol Wittenberg with a police related matter and discussed the possibility of having a blood drive.
