The regular meeting of the Town Commission was called to order by Mayor
Horton on January 7th, 1969 at 7:10 P. M. All Commissioners were present.
The minutes of the regular December 3rd meeting and workshop meeting of
January 4th were read. All minutes stood as read by the affirmative vote
of all present.
Correspondence read by Mr. Beekman included a letter from Paul Robin John,
architect, received at 4:P. M. that day amending the reading of a bait
and tackle shop to sporting goods store. It was referred to the zoning com-
mittee; communication concerning library facilities and taxing of the town
for same, and a letter from Florida Power & Light requesting buried cable.
The Commission moved last Saturday to adopt the request.
Mayor Horton reported the legal representation was changed from Mr. Mowry
to Mr. Poulton, former attorney for Boca Raton.
The Town Commission accepted with regret the resignation of Town Manager,
Eileen Mognet. Mrs. Elaine Roberts has been hired as Office Manager and
was introduced by Mayor Horton. The Auditors were directed to run an audit
as of December 13th and the Post Office ran an audit as of December 27th.
A shortage of $163.04 was found which Mrs. Mognet personally replaced.
Mr. Beekman moved that the Town reimburse her by check. This was seconded
by Mr. McCook, and .was unanimously adopted.
Mr. Beekman reported the taxes collected to date were $41,384.39, out=
• standing $14,473.24
Mr. McCook had no financial report, but stated that the auditors will be
here within the next few weeks to work out a new system on the books and
go over them with Mrs. Roberts. He also reported a government bond was
taken out for $15,000.00 giving us 52~ interest, to cover the May payment
of interest and principal on the Water Plant bonds. A separate account
has been set up for the road repair fund.
Mrs. Noble reported that Timothy Barrows, who is very busy at this time
would like a special meeting after Jan 15th to determine exactly what the
Town Commission desires in the way of planning and zoning. The Town Att-
orney is doing further research about changing ordinances. The application
for a bait and tackle shop was not accepted because the committee has not
reviewed the construction plans. Mayor Horton referred to the letter
changing the name to Sporting Goods shop.
At this time Mr. Hubert asked to be heard. He is the Attorney representing
the Marina developers. He asked when the developers could expect issuance of
a building permit. Mayor Horton answered that because the letter regarding
the name change had been received only that day, there had been no oppor-
tunity for the zoning committee to consider the change. He suggested that
Mr. Hubert might like to attend a workshop meeting after the groundwork is
laid. Mr. Hubert said he understood the building inspector had ok'd the
plans. Mayor Horton said no; the plans were not passed by Mrs. Noble, nor
• had Mr. Crego gone over them in detail. Mr. Hubert asked if the plans mgt
ordinance #106 of Code could they expect a permit? He also added that it
appeared the Commission has opposition to any business use of the property.
Mr. Horton said that the citizenry objects; the Commission is interested
only in defining and. interpreting the ordinances.
Commissioner Hackman reported in his Public Works report that water

• consumption was up about two million gallons more in December. The con-
dition of the water is rated AAA by the County, there is an increase in
the demand, but as yet the softening process has not been activated. The
new lime pump has not yet been installed.There was an adjustment on D.
Gallrs water bill, a broken meter on the south end was repaired, and
a letter is to be sent to the property owners on Russell Rd. when the
cost is estimated. Mr. Hackman further stated the Southern Plumbing
Code will be presented when Mr. Crego completes his study, we are moving
along with Delray on the buried cable matter from Florida Power & Light,
the Bel Lido bridge is being painted and other repairs made, and he said
more hydrants are needed on unimproved property. Mr. Hackman has bids
of about $600.00 for two, considered sufficient by the Fire underwriters.
He also stated that progress is slow on the water plant.
The sign committee has completed its work and the final reading will be
later tonight.
Mr. Vedder reported they were waiting for the engineers on the sewers.
Mayor Horton read the Police protection contract in the absence of Mr.
Stewart. Commissioner Hackman offered a suggestion to have a five year
contract instead of one year. Mr. Boyer said this was not economically
feasible. Open discussion followed as to number of patrols; radio contact
with the County Sherriff's Office and the Cites of Boca and Delray; and
adopting the one year contract or working out a five contract. Commissioner
• Beekman moved the contract as stands be approved. Commissioner McCook
seconded the motion. It was passed with one dissenting vote from Com-
missioner Hackman.
Mr. Jess Julian introduced Mr. Novotny, President of Novo Investment,
who is building Seagate Highlands and together they showed a preliminary
site plan of four biuldings, 79 units each, 10 stories high,
A discussion was held as to a~article in the Sun Sentinel about rezoning
in Delray so to combat a cone ete jungle such as in Ft. Lauderdale and
Pompano. Mayor Horton said the concern was shared by the zoning committee
and Mrs. Noble added that Mr. Burrows has been contacted about this in
detail. A guestion was raised as to changing ordinances, especially about
the Marina property and limited business. One of the permitted businesses.
is a sporting goods s#i~re, Mrs. Noble explained the Commission"s res-
ponsibility was to enforce ordinances passed at behest of the peoplein
town. Even though the ordinances on the books are outdated, if the plans
melt regulations the Commission has no basis for denying a request. A
citizens meeting is planned to discuss the marina plans.
Bills were read and approved for payment.
Commissioner Beekman read the proposed ordinance change. This was the second
reading, .but the wording was not specific as to 35feet or two stories in
height so a final reading was not possible at this time. Open discussion
followed as to spot rezoning, wording in ordinance, and more direct not-
• ification when changes are proposed. Commissioner Hackman suggested a
postponement, Mrs. Noble explained this was the second reading and there-~,
fore unfair to object at this time. She asked for ~ a motion but more
discussion:,_followed. Commisioner Beekman said this request from Roth's
had met with complete cooperation from Commission and was in the best
interest of Bel Lido Association and residents of the Town. Mrs. Noble
again made a motion but there was no second, so Mayor Horton postponed

• adopting the change until the wording is changed.
The second reading of the Sign Ordinance was held. Commissioner Beekman
moved it be adopted, seconded by Commissioner McCook. It was unanimously
passed.
